Consumer Complaint: Originally I attended the XXXX XXXX XXXX in XXXX and XXXX in XXXX. When I XXXX my loans were eventually transferred to Navient. Navient has taken over my loans and throughout the years they were continuously placed in forebarance due to hardship Recently I found out through social media that the XXXX XXXXXXXX XXXX and Also Navient where my loans are currently with are both being sued for misleading students throughout the years and fraud activity and so on. My question to Navient which is where my loans are with is why hasnt the XXXX XXXX XXXX and Navient notified me on the lawsuits and why are they threatening my constantly for years about making payments when they know they are under a lawsuit which they did not inform me of. Also, this has caused me great XXXX and stress throughout the many years because economically I can not afford to make these payments and both the XXXX XXXX XXXX and Navient both knew they were misleading the students and knew we would never ever be able to fully repay these loans due to their misleading and scheming throughout the years. This is wrong and something needs to be done here because its affecting my credit. And they have refused to remove it from my credit.

Consumer Complaint: I am writing to file a formal complaint against Navient, the XXXX loan servicing company, regarding their persistent harassment and unfair practices in relation to my XXXX loans. My loans were originally with Navient but were subsequently refinanced with XXXX. The transition to XXXX was motivated by the need for a more flexible and reasonable repayment plan. However, despite the refinancing & lacking the ability to keep up with {$1500.00} - {$2000.00} a month payments, Navient continues to harass both myself and my immediate and extended family members, creating undue stress and hardship for us. I refinanced my XXXX loans with XXXX as Navient was unwilling to collaborate on establishing a livable monthly payment plan. Navient insisted on exorbitant monthly payments exceeding {$2000.00} for private loans alone, despite the knowledge of my concurrent federal loans. This lack of cooperation and consideration has compelled me to seek a more reasonable arrangement with XXXX. The primary issue I am reporting involves the relentless and intrusive communication from Navient. They contact not only me but also my family members, including my parents, aunts, uncles, great aunts, great uncles, and cousins, multiple times daily. Despite my numerous requests for them to document my concerns and desist from this harassment, Navient has not only failed to comply but has also continued to propose unattainable monthly payment plans and forbearance options. These proposed solutions not only fail to address the underlying issue but also risk exacerbating my already substantial debt by incurring additional unlivable interest. Furthermore, I have expressed the impact of this incessant harassment on my parents ' declining health conditions, and yet Navient remains unresponsive to my pleas for a reasonable and amicable resolution. Their refusal to cease communication with additional parties not listed on file, beyond myself and my cell phone number, is both intrusive and inappropriate. I am left with no choice but to inform Navient of my intent to report and pursue legal action against them for harassment and unfair practices. Despite this, their persistence in their actions continues unabated. I kindly request that the Consumer Financial Protection Bureau conduct a thorough investigation into this matter and take appropriate action against Navient for their violation of fair debt collection practices. I believe that my rights as a borrower are being egregiously disregarded, and I trust that the Bureau will intervene to rectify this situation. Thank you for your attention to this matter, and I look forward to a swift resolution.

Consumer Complaint: In XXXX of XXXX, I mailed a letter to Navient ( XXXX XXXX XXXX ) requesting their assistance in removing XXXX closed student loan accounts from my credit reports. In the letter to Navient ( dated XX/XX/XXXX ), I indicated that I was a former customer of Navient, that I previously had XXXX XXXX loans serviced by Navient, and that the loans had been paid in full and closed. I further informed Navient of my attempts at asking the credit bureaus to remove the closed accounts from my account history, given that the late payment history in the closed accounts were inhibiting my ability to qualify for other forms of credit. To date, XXXX is the only bureau to honor my request and to remove the closed accounts from my credit report. Unfortunately, XXXX, XXXX, and XXXX will not remove the accounts UNLESS NAVIENT INSTRUCTS THEM DIRECTLY TO REMOVE THE CLOSED ACCOUNTS. The basis of my request was that the closed accounts were old ( opened between XXXX and XXXX ) and that none of the bureaus had record of the first delinquency dates to validate and justify removal. Only Navient had that information on hand. Given that I have satisfied the accounts and that they are now closed, I have asked Navient to tell XXXX, XXXX, and XXXX to delete the closed accounts from my account history. This will help increase my chances of qualifying for a home mortgage, auto loan, and lower auto insurance rates. Navient XXXX XXXX XXXX responded with a letter on XX/XX/XXXX completely missing the point to my letter and stating that I was disputing the accuracy of the information reported to the credit bureaus. I responded with a second letter ( dated XX/XX/XXXX ) basically calling them out on misunderstanding my initial letter. I stated that the intent behind my letter was not to dispute the accuracy of the information reported to the credit bureaus. Rather, the intent behind my initial letter was to tell Navient to instruct removal of the XXXX CLOSED student loan tradelines from my XXXX, XXXX, and XXXX credit reports. The tradelines are OLD and CLOSED. THE BUREAUS ARE WILLING TO DELETE THE CLOSED ACCOUNTS, BUT CAN NOT DELETE UNTIL NAVIENT INSTRUCTS THEM TO. Based on my research, I know creditors often instruct credit bureaus to remove old tradelines, especially when requested. I asked Navient again to contact XXXX, XXXX, and XXXX, and to tell them to remove the closed tradelines from my reports. The credit bureaus will remove the tradelines, but they can not remove the tradelines until Navient tells them to do so. I have confirmed this with the credit bureaus. On XX/XX/XXXX, Navient replied with another letter again missing the point to my two previous letters. I did not ask them to investigate the accuracy of their reporting. All I wanted was for them to tell the bureaus to delete the XXXX closed accounts from my reports. The bureaus will not delete the accounts until Navient tells them to do so, and Navient ( for some odd reason ) will not budge. As a consumer, I feel like I am stuck between a rock and a hard place. I have done my part and have paid off the loans. The least they could do ( as a goodwill adjustment ) is help delete the delinquent accounts and payment history from my reports so that I can get on the road to financial freedom and security. I hate to take it to this level, but have no other options ( outside of securing a consumer protection attorney ).

Consumer Complaint: Navient, after already having issues with them, continued to call and harass me about the Navient student loan. They called and left messages on my cell phone 3-5x a day for several months. They also add on unnecessary fees and refuse to defer or adjust the loan as necessary due to inability to repay. They said they couldnt do anything for me. With {$1500.00} per call that is against the fair debt collection act, this should nullify the loan to be marked as paid in full. I have proof of the voicemails and illegal calls.

Consumer Complaint: I had called to discuss why my income based repayment plan payments had jumped from {$270.00} in XXXX to begin in XX/XX/XXXX in the amount of {$560.00}. When I asked the customer service representative, why the payments had doubled I was given the run around. I asked how they came to the payment they did based on my most recent tax return. I was given they had my tax return of XXXX. That was incorrect, since I had submitted my XXXX tax return documentation for my annual income based renewal certification which was approved on XX/XX/XXXX. They could not verify that they had my XXXX tax return. I was told they based my income payment on the 15 % of yearly income divided by 12 months on the poverty line. It doesnt make sense on how the income reflects the payment per month and the calculations they gave me. I inquired further as to be given an XXXX number so I can call to get information on how they go about figuring out the repayment amount. I was told it was by a processing team and they didnt have a phone number. I also inquired if there is no number, to get information in writing because there is nothing documented on the Navient app in full detail as shown on their document approving my income based repayment request renewal. I wasnt given any information or told the information that would be mailed to me. I notified them that I had a drop in my income due to a new job and my husband had a drop in income as well. I was told I could send them copies of our paystubs no more than 90 days old and they can re-certify based on my new income documentation.

On XX/XX/XXXX I was notified via Email that my College, XXXX XXXX XXXX XXXX XXXX XXXX XXXX was closing effective immediately. I was currently enrolled in their Bachelors program as a XXXX XXXX XXXX. I was told that the school would be sending us transcripts and attempting to transfer our credits to other Colleges. I checked online and the federal government website states that " If youre a student loan borrower ( or a parent who took out PLUS loans on behalf of a student ), you may be eligible for a 100 % discharge of federal student loan funds borrowed to attend your school under any of these circumstances. Your school closed while you were enrolled, and you did not complete your program because of the closure. If you were on an approved leave of absence for purposes of the federal student aid programs, you are considered to have been enrolled at the school ''. Therefore I submitted my documentation to the Federal Department of Education to have my loans Discharged. Since Navient is the Provider for my private loans, I contacted them to obtain more information about my options to discharge them as well. The Customer service representative said that they had not heard of any school closing but that they can escalate my case to their management in order to reach a resolution. Every time that I have called after XX/XX/XXXX ( XX/XX/XXXX, XXXX, XXXX and XX/XX/XXXX ) I have been met with another Customer Service Representative that states that their case notes provide no resolution, that my case has been escalated with no updated information. On the last attempt to speak to customer service they stated that I have no remaining Forbearance or Deferment options so I am forced to continue to pay while a decision is being made on my account. I was given no other options or information other than " My account was put under review and will be updated in a week '' prompting my search for other methods of assistance.

Consumer Complaint: FACTS I have been making payments since XXXX According to my records, the principal has been repaid on this loan as well as thousands in interest. Recently, I identified multiple account discrepancies and math errors with my Navient-serviced loan. I sought a complete history on multiple occasions, but to date, Navient has failed to provide a complete copy of my account. Instead, Navient unilaterally changed my payoff dates, created unauthorized documents, misstated amounts owed, loan terms, and payment schedules, which are substantiated by written evidence from their own office. Failure to Fully Respond to Verification/File Request Despite my numerous requests for a complete copy of my file, I have only obtained partial data consisting of the following : 1. A brief Status History letter dated XX/XX/XXXX 2. XX/XX/XXXXXXXX XXXX Federal Stafford Loan Application 3. XX/XX/XXXX Federal Consolidation Loan Application 4. Income Sensitive Repayment XX/XX/XXXX, Federal Consolidation Loan Application, Grad Choice 3. 5. An alleged electronically signed XX/XX/XXXX reapplication form that expired in XXXX for extended standard repayment for DIRECT Loans, when I was already in extended standard repayment for my FFELP Loans. Missing documents never received from Navient despite request : 1. Deferment documentation ; 2. Conclusion of Income Sensitive Repayment in XXXXXXXX XXXX and change to Extended Standard Repayment in XXXX 3. Supporting documents for reamortization in XXXX Extended Standard Repayment Plan in XXXX ; 4. Documents for forged and unauthorized ISR Repayment Plan dated XXXX currently in effect ; 5. Income Worksheet/Proof of Income for current ISR plan that would even permit an ISR Repayment Plan. ( There never was one, because it was not applied for, but I have requested this information in case it too was forged without my consent ) ; 6. Explanation for a XXXX payment reduction in 9 months. 7. Resolution of Loan surpassing the XXXX loan term. 8. Disclosures showing permission to Re-Amortize my loan at will. 9. Resolution of miscalculations. 10. Contact information for all parties handling my account through the term of the loan. History of Payments and Miscalculations After making payments for several years, in XXXXXXXX I discovered that Navient, XXXX XXXX XXXX, had put me in a payment plan that would not even cover the principal and interest every month and was causing my interest to capitalize, although this was not disclosed to me that this would occur. ESP Plan. Thereafter, I enrolled in 'Extended Standard Repayment, defined as Extended Payment Plan, which allows borrowers with debt in excess of XXXX dollars to repay over a XXXX period on either a standard or graduated schedule. Originally, I was advised that the end date of the loan was XX/XX/XXXX. The interest rate is fixed, not variable. Lump Sum Improperly Applied. I made a {$25000.00} lump sum payment in XXXX but did not intend to extend repayment. I recently discovered that Navient extended my loan without disclosing this to me. Even now, Navient 's calculations are obviously contradictory, as is evident from their correspondence discussed below : Calculations Are Obviously Wrong, Even On Their Own Correspondence On or about XX/XX/XXXXXXXX I was advised that 'Extended Standard Repayment was entered into on XX/XX/XXXXXXXX Despite my assertion that the ESP plans reamortized my loans without authorization, the math is ridiculous on its face. As anyone who has a calculator can determine, 300 months XXXX later, is XX/XX/XXXX. However, in XX/XX/XXXXXXXX XXXX Navient claimed in the same email that payments were to be made until XX/XX/XXXX, which is 330 months and 18 days. Not 300 months, and is beyond the length of time of offered by any payment plan of Navient altogether! Further, I have always overpaid the principal, but my account notes were ignored and Navient applied the payments however it best served them. Unauthorized Re-Amortization/Failure of Disclosures/Extension of Loan When I questioned Navient 's math, Navient shockingly and unilaterally altered my loan terms in XX/XX/XXXX, extending my loan AGAIN to XX/XX/XXXX XXXX by claiming my loan had restarted and was now 31 years and 9 months, when I have already paid 16 years and I am only supposed to be paying a total of 25 years per their terms. This results in Navient gaining a net 11 years of interest. When I questioned it, Navient failed to furnish documents. Some documents were only produced to me when I sent yet ANOTHER letter, dated XX/XX/XXXX, despite my XXXX letter and several emailed requests for any and all documents in the interim months. Expired and inapplicable Electronically Signed Form produced by Navient to support unauthorized extension. When I finally received a copy of the alleged XX/XX/XXXX Repayment Plan Request Form that extended my loans, the form had expired via its own terms in the upper right corner on XX/XX/XXXX, but was allegedly electronically executed TWO YEARS LATER in XX/XX/XXXXXXXX Does not apply to FFELP loans. The XXXX XXXX Form does not even apply to FFELP loans, it only applies to Direct Loans. I only have FFELP loans. Additionally, the alleged Repayment Plan Request form dated XX/XX/XXXX, literally violates its own terms on its face as follows : The XX/XX/XXXX form states under the Extended Repayment Plan : For all loan types, the maximum repayment period is 25 years. XX/XX/XXXXXXXX XXXX Extension Conflicts on its Face. This maximum term limit conflicts with Navient 's Updated payment schedule correspondence dated XX/XX/XXXX which reset payments to XXXX payments, which equals XXXX years, and claims payoff is XX/XX/XXXXXXXX XXXX Again, please note that I have been making payments on these loans since XXXX although Navient is only counting from XXXX Regardless, in any case, this is well beyond 25 years, even if the reamortization was authorized. Fraudulent Cover Up With Obvious Miscalculations/Forged or Unauthorized Documents After I notified Navient of my multiple issues with this account, Navient representatives and employees unilaterally appear to be covering up fraud with my account as follows : Reduction of Loan by XXXX in a XXXX Period Proves Flagrant Fraud. This is supported via a letter dated XX/XX/XXXX that suddenly claims that within a XXXX period, I had had a XXXX payment reduction since XX/XX/XXXX, when Navient had claimed that XXXX had an alleged XXXX payments remaining, and that is now reduced to an alleged XXXX by XX/XX/XXXXXXXX Although I do make overpayments, this makes no mathematical sense, even with the overages I paid. Unauthorized ISR Notice/Not Applied For/Further Evidence of Fraud . Even more shocking, on XX/XX/XXXX, I received an 'Income Sensitive Repayment ' notice that indicates that I have now been placed in ISR for a year. This was not applied for, does not have any signatory proof, and makes no sense whatsoever as the ISR payment plan amount is EXACTLY the same amount of payment stated in the XX/XX/XXXX letter. This is further evidence of fraud. Failure of Disclosures Required by Law. Further, at no point has it ever been disclosed to me that a repayment plan change would start my plan over from day one, forcing me to make payments to Navient as a life sentence. No Authorization to Re-Amortize Loans. I have reviewed every single term and condition I have been provided, and nothing discloses this. Nothing appears to authorize Navient to randomly reamortize my loans. Failure to Adequately Respond and Turn Over Documents. Navient refused to provide a complete copy of my file, answer my verification requests regarding the foregoing and continues to fail to properly service and allocate payments. A complaint to the Ombudsman simply resulted in Navient forging the ISR plan it currently claims that I am in, when I do not even qualify! Refused COVID-19 Relief And XXXX Percent Interest Announced By The Department Of Education That Was Retroactive To XXXX XXXX XXXX Further, I made payments during the COVID emergency while these federal student loans were paused. Despite the Department of Educations Announcement found at https : XXXX, that made interest free student loan deferment available retroactively to XX/XX/XXXX, I was not offered XXXX percent interest by Navient. Instead, I was charged interest and received a 1098-E for XXXXXXXX in the amount of {$1900.00}, XXXX interest of {$2000.00} and in XXXX I paid {$2100.00} in interest. Violations of the Consumer Financial Protection Act of 2010, Fair Credit Reporting Act, Fair Debt Collection Practices Act In addition to the foregoing paragraphs, Navient specifically violated the federal protections to me, as a consumer by the following : Wrongful Reporting. The amounts reported to the credit bureau are inaccurate for the reasons described herein, in violation of the Fair Credit Reporting Act. Failure in principal responsibilities. Navient, as discussed herein has completely failed to perform its principal responsibilities in managing my account; processing monthly payments ; assisting me, a borrower to learn about, enroll in, and remain in alternative repayment plans ; and communicating directly with borrowers about the repayment of their loans. Navient blatantly breached the student loan contract and its fiduciary duties by its failures. Despite Ongoing Dispute Navient Unilaterally Failed to Respond and Reported to Credit Bureaus. Despite my numerous requests for information pertaining to my account, Navient simply forged documents, and closed the case. Recently, they have reported my account to the credit bureauclaiming the wrong amount is owed, even by their own documents. In sum, the unsanctioned repayment reset is alarming, as is the lack of disclosure and unexplained reamortizations. The pattern of Navient 's noncompliance and failure to properly service the loans is nothing short of deceptive trade practices.
