Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Their investigation did not fix an error on your report

Consumer Complaint: I've already talked to the bureaus. They need this updated information to come from Navient. You didn't answer or address my question from my previous complaint. My question was the months you reported my account as CURRENT to the credit bureaus, were not really current. You were charging me late fees the entire time. They were delinquent. I haven't been current since the last time I made a payment in XXXX. Also, the information you provided to XXXX at consolidation is not the same as what you reported to the credit bureaus. Months you show I was in forbearance to the XXXX do not line up with the months you reported as in forbearance to the credit bureaus. Will you please re-read my complaint and answer my concerns? My concern is you reported me as current to the credit bureaus pretty much from XXXX which is allowing these accounts to sit on my credit report for 7 years from the date it was closed in XXXX. My argument is I haven't actually been current since XXXX which was the last payment I made. If I was actually current as you were reporting me to the bureaus each month, then why were late fees being accumulated during this time? My argument is that these account as a whole should be deleted from my credit report based on the fact I haven't made a payment ( been current ) in over 7 years. ADDITIONAL COMMENTS Please re-read what I sent. Additionally, I'd like to receive all the documentation you have on my file for each occurrence I was granted forbearance.

Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: To whom it may concern, Currently, I have eleven student loans. Two student loans are with Navient Corporation and are up to date. Nine are with the Department of Education and are in default status. More than three years ago my wife and I decided to consolidate our individual student loans. We both contacted Navient by phone and set up consolidation plans. All her loans were consolidated by Navient. Unknown to me, all eleven of my loans were not consolidated. Navient only took two of the loans, so the other nine sat at the Department of Education without my knowledge. I was under the impression from Navient that all eleven had been consolidated back in XXXX. We filed our XXXX taxes in XX/XX/XXXX. We were to receive a refund. In XX/XX/XXXX, I received a letter from the IRS stating that they had seized, treasury offset, my tax refund because I had student loans in default. I immediately called the Department of Education and I was forwarded to their collection company, Consumer Research. I found out, by phone and online that nine of my student loans were in default since XXXX, with a principle balance of approximately {$44000.00}. Added onto the principle balance an {$8000.00} service fee by Consumer research. A total of around {$52000.00} was due. Over the last three years, I was under the impression that I was either paying monthly payments on my student loans or when employment was part time, Navient suggested that I either defer or do a forbearance due to economic hardship. The remaining student loans at the Department of Education sat for more than three years went into default and there was no attempt to communicate that information to me by mail, email, or phone by the Department of Education for the past three years. When I spoke to a representative from Consumer Research, I was certified and then told that I have three options to settle my defaulted student loans. None of which I could afford, so I have been currently working with a company called XXXX XXXX to attempt to get my student loans out of default. The Navient Corporation is currently being sued by five plus states including Washington, who have alleged improper actions on behalf of student loan borrowers. I have recently contacted the Washington State Attorney Generals office and filed a complaint against Navient. For Misallocated payments Steered me toward multiple forbearances instead of income-driven repayment plans, and Provided unclear information about how to re-enroll in income-driven repayment plans Created obstacles to repayment by providing bad information Processed payment incorrectly Failed to act when I complained Harmed the credit of XXXX veterans, I am a XXXX XXXX veteran. The Consumer Financial Protection Agency has alleged Navient has systematically and illegally failed borrowers at every stage of repayment. Thank you for your time. I appreciate and am grateful for the opportunity to explain my student loan situation.

Issue: Dealing with your lender or servicer

Subissue: Problem with customer service

Consumer Complaint: I submitted a request for XXXX to determine how many payments I have made during my loan history qualified for public service loan Forgiveness. This request was made in XX/XX/XXXX. The request has not been completed as of today ( XX/XX/XXXX ). When speaking with XXXX, they said that payment review is incomplete because Navient has not sent electronic records to XXXX. It has been over 10 months! This is unacceptable, negligent and fraudulent.

Issue: Struggling to repay your loan

Subissue: Can't temporarily delay making payments

Consumer Complaint: I have student loan debt with Navient Student Loans. This month will be the first time I couldn't afford to make a payment due to my rent increasing plus other unforeseen financial problems ( having to pay the IRS first time too ). So yesterday, XX/XX/XXXX, I went on my student loan website to apply for a deferment and forbearance and I was declined due to " not qualifying. '' I called the company today ( XX/XX/XXXX ) and the representative told me the same thing ... '' You don't qualify. '' I informed her that I need a temporary postponement until XX/XX/XXXX. She told me that my account will fall into " delinquency. '' I told her that is the very thing I'm trying to avoid happen because I have spent the last 2 1/2 years cleaning up my credit so I can buy a house and that I don't want student loans hitting my credit! Not only that, Navient is not the only student loan company that I'm paying this month. I have another company that I pay per month too, but won't be able to due to money issues this month. I personally believe that this company is a thief! They charge me a late fee of {$6.00} even though my payment is always made the month before the amount is due! Also, they charge me a {$31.00} " unpaid fees '' charge every month too. Then to add insult to injury, the one time I can't pay Navient can't help me even though they claim they are here to " Help. ''

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I continue to have issues with how payments are handled. I voiced my corncerns with how rude the reps are are a spoke with a supervisor today bythe name of XXXX. They expect you to know what they are talking about when you dont work at the company. I have made several lymph fum payments on my loans due to the fact that I have not consolidating them. On the website it states Congress sets interest rates however if I go into auto pay with them or will lower my interest rate. The information they provide is misleading I have made several lump sum payments I only once this year applied for forbearance today would have been my second time after speak iui mg with XXXX who was supposed to be a supervisor I voice my concerns with her as well once i said i would put in a complaint is when her tone changed. When I make my payments it states to postpone payment implaying due to over payment that anything due will not show as past due ... so in paying of my loans my amount due each much rises though I am in no payment plan you would think the more I pay off the lower my monthly payment would be however the opposite applies. Also when making over payments with the option I select it automatically places you I forbearance when it doesn't explicitly state that ad an option. I am not happy with the loan servicers. They have stolen my money over the years they have been my servicer enough is enough I am getting a lawyer involved. I have had enough.

Issue: False statements or representation

Subissue: Attempted to collect wrong amount

Consumer Complaint: I was a student at XXXX XXXX on Financial Aid. I had limited funds left, however, I was told I had enough for one more term with them, so I enrolled. When the loans got disbursed, it showed that I actually owed money instead of receiving money, so I immediately called and emailed my enrollment coach. They looked into, and I even got in touch with the Financial Aid office in XXXX, who stated she was confused because it showed I had money available. I immediately withdrew to avoid any further charges, and then I started getting collection notices from XXXX last XX/XX/XXXX. I wrote them back via email 3 times and with letters, 3 times as well stating the issue that I was not responsible for the amount they were charging me. The last email I sent was dated, XX/XX/XXXX. I didn't receive anything for awhile, so I thought they took care of it, and then last month it showed up on my credit. I disputed saying it was fraud, but the results came back saying it was verified and accurate. I don't agree with this as it wasn't my fault. The school gave me misleading information about funding I had available. They are responsible, and I want this removed from my credit. The account is in collection by a company called General Revenue Corp., XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, XXXX XXXX, XXXX x XXXX for the amount of {$390.00}, which is incorrect, the amount from XXXX is {$380.00}.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: In XX/XX/XXXX, I reached out to navient, for information regarding a payment plan to start paying back my loans. Although I had responded to their debt collection emails for years requesting information to be mailed out to me regarding different repayment options. Since XXXX, navient has sent emails to postpone or granting forbearances, requesting that I call them to review repayment options instead of just mailing out the information regarding different repayment options as I requested. In which it would give me time to decide which option would work best for me. So after a minimum of 10 years of postponing or granting forbearances, and having my request basically be ignored for information to be mailed out, I finally called navient and I was given a quote of a monthly payment quote in which was outrageous to say the least. I finally was advised to submit an application through their website to initiate the process. ( although I have asked for these steps throughout the years. ) I was advised by the customer service rep, that while my application was being processed, my loans will be in a forbearance period until XX/XX/XXXX. After my students loans were consolidated again and my interest rate went from a 2 % fixed rate to now 4 % rate, I received my IDR payment plan letter dated on XXXX. Stating that my plan starts on XXXX. A week later I received a bill, stating to avoid late fees I would have to pay XXXX by XX/XX/XXXX and my XX/XX/XXXX bill is XXXX. Keep in mind I was advised along with receiving a email stating I am in forbearance until XXXX. This has been a complete nightmare dealing with Navient.

Issue: False statements or representation

Subissue: Attempted to collect wrong amount

Consumer Complaint: I have filed 3 complaints with General Revenue Corporation and XXXX XXXX has illigally denied my access to copies of any contracts, bills, statements or records that show that I owe any balance to Indiana XXXX or General Revenue. The only documents that XXXX XXXX from General Revenue Corporation are collection bills for the amount of {$450.00} and a collection balance {$90.00} totaling {$540.00} I believe your company has violated several of my consumer rights. Specifically, I have requested General Revenue Corporation upload copies of all documents already sent and any response to this notice through the Consumer Financial Protection Bureau Portal with the response- If you have the documentation needed legally and have already sent it in XX/XX/2019 to verify that this debt is owed to Indiana XXXX and that you have the rights to collect on behalf of Indiana XXXX . ( FDCPA ) 15 USC 1692f 809 ( A ) ( 4 ) ( B ) I hereby demand that you produce for my inspection, an original contract that establishes the existence of a debt to which I am obligated to you or your principal. General Revenue Corporation is trying to collect interest, fees, or other charges on top of the charges they accuse, is illegal according to the Fair Debt Collection Practices Act ( FDCPA ) 15- USC 1692f 808 ( 1 ) Unfair Practices- Not only have you ignored my prior requests for validation of debt ( proof enclosed- receipt copies or letter copies ), but you continue to report this debt to the credit bureaus, causing damage to my character. This letter will again request that you follow the FDCPA and provide the following : Validation of Debt Request Proof of your right to own/collect this alleged debt Balance claimed including all fees, interest, and penalties Contract bearing my personal signature As you may be aware, " Estoppel by Silence '' legally means that you had a duty to speak, but failed to do so. Therefore, that must mean you agree with me that this debt is false. I will use the Estoppel in my defense. I expect to receive proof requested above by mail and by uploaded response to the Consumer Financial Protection Bureau XXXXomplaint Web Portal, within 15 days of this letter. Should you again ignore my request for validation of debt I reserve the right to sue your company for violations of my consumer rights as indicated under both the FDCPA and the FCRA. I may seek damages from you if warranted.
