Consumer Complaint: THIS IS NOT A DUPLICATE COMPLAINT!!!!!!! WHAT CHANGES DID NAVIENT REPRESENTATIVE MAKE TO MY ACCOUNT IN EARLY XXXX????????? Navient in a response to me says theyve mailed me several renewal reminders between XXXX - XXXX and they never received a response back from me. 1. I was homeless. Had no phone or internet service. And no mailing address. 2. NAVIENT HAD INCORRECT CONTACT INFORMATION ON ME BETWEEN XXXX - XXXX. Around XX/XX/XXXX YES I DID SUBMIT A {$0.00} XXXX. 1. I called and spoke with Navient customer representative informing him of my circumstances and situation. 2. Navient customer representative informed me to submit {$0.00} IBR and wait at least 6 months. Then submit a written letter with documentation and the late payments would be removed. NAVIENT IS NOT LISTENING TO A WORD IVE BEEN TRYING TO TELL THEM. In XXXX their representative made changes to my account. 1. I phoned in asking for help!!!!!! 2. I made the representative aware I was homeless and had no services. I also made the representative aware I wanted to update my account so that Id receive future correspondence by email. 3. I also made the representative aware I wanted help in fixing my account due to the extreme financial and emotional situation I was in. So my question is : 1. WHAT DID NAVIENT CUSTOMER REPRESENTATIVE CHANGE ON MY ACCOUNT BACK IN EARLY XXXX? Is there not a phone record or notes of that phone call? ARENT THEY REQUIRED TO DOCUMENT PHONE CALLS BETWEEN CALLERS!!!! GO BACK AND LOOK AT MY ACCOUNT!!!!! XXXX - XXXX I WAS IN DEFAULT YES!! I was in default for reasons I explained. I ASKED FOR HELP!!!!!! And none was given. So I am filing this complaint against Navient for not properly handling calls, complaints, and not thoroughly investigating matters. DOCUMENTS ATTACHED : 1. Consumer Complaint: In XX/XX/XXXX I co-signed a private loan for my son. It was required because he was a dependent student. Payment was initiated by me on about XX/XX/XXXX. At this time he had graduated. I continued those payments until about XX/XX/XXXX. At that time he updated my credit record to show that loan was initiated in XXXX. Contact was made with all parties that I thought would be able to help me clear up the data. I contacted the Credit Bureau and the response was that Navient claimed the report without showing that they performed any research to confirm. This occurred a few months after Sallie Mae split up and separated Federal and Private loan agencies. With no where else to go I found a lawyer that would take on my case. As this also involved my son, the lawyer added him as a plaintiff. Navient dragged out the process in the court system for about 3 years. As I had lost confidence in our legal team, finally I decided to drop the case without prejudice.

Consumer Complaint: After submitting my initial Complaint ( ID # XXXX ), I reached out to Navient on Monday XX/XX/21 in two separate emails, stating the following : # 1 Im on Social Security and no longer obligated to pay, if delinquent, on a co-signed Student Loan. Please contact the 3 Credit Bureaus and have Navients ( a private Student Loan lender ) account removed from my file as soon as possible. Im trying to get a refi loan that was denied, I believe, because of Navient. Thank you for your expedited movement on this request. # 2 SSI payments can not be levied or garnished. Treasury 's Financial Management Service can also offset, or reduce, your Social Security benefits to collect delinquent debts owed to other Federal agencies, such as student loans owed to the Department of Education. ( Navient is a Private Lender ) Generally, debt collectors can't take Social Security or VA benefits directly out of your bank account or prepaid card. Their response was : Weve received your inquiry. One of our knowledgeable specialists will review your account and respond shortly. There response came to CFPB as a no or rejection, that did not deal with this issue at all. Although in submitted Feedback, Im told it would go to Navient, but they are not obligated to response to that form of communication.

Consumer Complaint: Attended school from XXXX-XXXX with a few short breaks, for family reasons. I noticed on Fed Student Aid, that my loan amounts do not match with consolidated loan total. According to the Fed website my total loans are {$85000.00} with the breakdown of {$50000.00} consolidated which leaves an original loan amounts of {$35000.00} the difference being {$15000.00}. Navient has sent information regarding the consolidated amount but it seems there is roughly a {$10000.00} difference from my original loan amount and interest. I have been trying to find out if the difference is interest, a missing loan amount or an error. I have also contacted XXXX University, have not heard from them. Navient has sent me the same information, which reviewing is correct because they are going of of the information provided after XXXX. Also contact Fed Student Aid but they referred me back to Navient.

Consumer Complaint: Navient offered me an income repayment plan. But refuse to accept my application without my spouses signature, although my spouse is has never been on the loan. We file jointly, but my spouse is on Social Security and retired. I feel if my spouse signs anything that Navient will make my spouse responsible for the loan. Also mine is not a student loan but a parent plus loan originally. And my spouse has never signed anything for this and has no part in this loan. I have been trying to work with Navient on an income repayment plan since XX/XX/2020. In XX/XX/2020 I filled out an application and submitted my income proof, and was told that my spouse would not have to provide anything. Due to the FACT my spouse has nothing to do with this loan. But now they want him to sign the application also after I was told in XXXX by a Navient representative that my spouse did not have to sign or submit anything. Obviously they changed their story, or policy. Navient also calls me more than 3 times in a 24 hour day and leaves no message. They are harassing me.

Consumer Complaint: Navient will not stop calling me at work. They called four times on XXXX, XX/XX/XXXX, three times on XXXX, XX/XX/XXXX, two times on XXXX XX/XX/XXXX, and two times already this morning, XXXX, XX/XX/XXXX. They also continue to call my mother 's home, where I do not live. I already filed a complaint about this with the CFPB back in XXXX. The complaint ID is XXXX. Evidently, this issue has not been resolved, and Navient gave false information that it removed my mother 's phone number from their database. Navient also emails me multiple times per day, requesting that I contact them. Navient has been completely uncooperative, and in almost every case, belligerent, regarding my account. I have eight other complaints with the CFPB about their behavior dating back several years. These complaints have not had any impact on their behavior, their demeanor, or their unethical business practices. The US government has temporarily halted payments on Federal Student Loans until XX/XX/XXXX, as part of the COVID-19 relief effort. This does not apply to private student loans. Navient has not participated in any such relief effort with its private loans, and instead has become more belligerent with its communication, as they continue to disturb me at work. I am unable to resolve my issues with Navient because of this, and I refuse to spend a single moment of my time at work corresponding with their representatives due to the aforementioned issues. Moreover, when I am not at work, I am still looking for other sources of income or otherwise managing other responsibilities. I absolutely will not speak with representatives at Navient, who behave like bullies and refuse to provide options for relief. I responded on XXXX, XX/XX/XXXX, to one company representative, XXXX XXXX XXXX XXXX, with the terms under which I would be willing to speak with Navient. In that communcation, I stated that by continuing to contact me, Navient will enter the agreement contained in this email. Navient did not respond by email, but has continued to contact me by phone. I consider this an agreement to the terms, and as such, Navient assumes responsibility of the terms given.

Consumer Complaint: I contacted Navient 's rate reduction program department on XX/XX/21 explaining to them that I still have limited work and my income has been drastically impacted for over a year. I asked if I was eligible for temporary interest rate reduction so I could have more affordable monthly payments and still be able to pay my loans down. I explained since I had to extend these loans out the total payments since loans dispersed would be over 40+ years. They stated I have used up my interest rate reduction allotment, unwilling to accommodate even though I stated other private student loan services were able to. They only offered me interest only option which perpetuates this cycle of debt without allowing me to affordably pay down some principle.

Consumer Complaint: Please see the attached document that shows the bankruptcy was discharged INCLUDING ANY ALL STUDENT LOANS. Navient, the original creditor, is correctly reporting the loan as discharged in bankruptcy 3 years ago. XXXX, by law, is NOT ALLOWED to buy a debt that was discharged and then begin reporting it as collection owed. I will continue to fight this everyday until someone listens!!! STOP reporting it to my credit as collection, late!!!!

Consumer Complaint: I went to graduate school in the XXXX. Made my first payment to then Sallie Mae in XXXX. Have since paid off {$41000.00} of a {$34000.00} student loan. As of this writing, mostly due to capitalized interest my principal amount is {$38000.00}. My estimated total payment is {$100000.00}. In XXXX I had my principal amount down to {$19000.00}, because I had paid ahead, my next payment due was not until XX/XX/XXXX. I was on track and in striking distance of getting out from under this debt. I started a XXXX XXXX in XXXX. A year later my XXXX second-hand car broke beyond repair, so I got a brand-new-second-hand XXXX. Then came the Great Recession shortly thereafter. I was able to keep my fledgling business, by restructuring and was able to pay off my SBA backed loan not only on time ( balloon payment ), but without missing a single payment. I was also able to keep paying on my 5-year, $ XXXX/month car loan, again without missing a payment. It wasnt until I purchased this car that I became aware that credit scores stopped at XXXX, never gave it a thought, just always lived below my means and paid my bill on time. The finance guy, at the dealership, brought it to my attention. He told me that in all his years of working in the industry, he never met someone with an XXXX credit score. I was like, XXXX out of XXXX? He was like, no, XXXX out of XXXX. That was then. Thanks to Navient. In XX/XX/XXXX, two months before my next student loan payment was due, given the state of the economy and my current situation, I reached out to servicer inquiring as to what options were available to me. The answer came back file for Economic Hardship. So I did, only to get a reply stating that I had filed too earlier. It was XXXX and my next payment was not due until XXXX. According to them. I needed to file within 30 days of the date my next payment was due, which as I stated above was XX/XX/XXXX. Even though I was not delinquent at the time, I was sent a letter asking me to choose the date in the future when I wanted the economic hardship to apply and/or initial a specific spot in the letter for delinquent loan. These two options were in the same letter. Looking back I now suspect I was being set up to go into delinquency, I just didnt realize it at the time. And this is how my delinquency, administrative forbearance, late fees and capitalized interest journey started, and continues. Even though I complied with the request in the letter, the rest of XXXX, was a struggle to get to some definitive plan. As the months ticked by, I started getting past due notifications, then threating to report me to the various credit agencies notifications, and finally the threat of default. It was at this point that XXXX XXXX XXXX XXXX XXXX XXXX ( XXXX ) got involved. It wasnt until XXXX made me aware of an Income Sensitive Repayment Plan, that I realize such an option existed. When I finally made it on to this Plan in XX/XX/XXXX, my servicer had racked up late fees, capitalized interest, and anything else they could tack on to my loan amount. Ive been on this plan since then, however, every time Im in receipt of correspondence from Navient, the letters always state somewhere in there, Capitalized interest may apply. That should read Capitalized interest will most definitely apply, because I have never been shown any leniency when it came to tacking that on. And they have never given any example of when it may or may not be applied. It has come to my attention that while on the Plan, now refer to as Income Based Repayment, no interest should be capitalized. However, Ive recently noticed that in XXXX and XXXX capitalized interest in the amount of {$5300.00} and {$5900.00} were applied, respectively. I have maintained my IBR eligibility and status since XXXX. So there is a bit on contradiction there. Ive recently gotten my latest recertification letter a month behind schedule and had some concerns. Through the Ombudsmans office I was able to finally reach someone at Navient located within the boarder of the 50 States, but just like XXXX, I am getting nowhere. I do plan to contact HESC directly and see if they can also assist. Im just looking to get Navinet to communicate with me. I would add in a timely manner, but this late point, its not applicable. Steering me to file Economic Hardship when Income Sensitive Repayment was a much better option, not getting back to borrowers with time sensitive issues so the clock can tick and in turn rack up late fee and the likes is willful, predatory and unforgivable..
