Consumer Complaint: To whom this may concern : Im filing this complaint because NationStar/Mr Cooper is once again, trying to fraudulently foreclose on my owner occupied property.! They promise to resolve this problem before! They said they would take 30days to give a FAIR REVIEW..! Instead we got a Unfair 3-5 day Denial, when they could clearly see that we should have gotten a modification that was affordable.. They can also see that we have the income for it, but they would just rather take our home anyway Instead! They have on their RECORD SO MANY FALSE AND FOUNDED CHARGES.. To make us so guilty and unworthy, It should be crime! If I did not feel that I am right about this Whole situation, I would Honestly and Proudly walk away and leave it all alone.!!! But I can not just give up on being DONE WRONG..! This is all a simple fix, stop stonewalling us put us back on track of the terms of our XX/XX/2012 modification.. Allow us too get at least Two years of clean mortgage history and we Refinance out. drop all of those other charges put us back at the AMOUNT WE REALLY OWE $ XXXX. AND WE MOVE ON WITH OUR LIFE.!! No more court issues of pointing fingers back and forth at each other..!! And Most of All put all of my XXXX THOUGHTS AND ANGUISH, OVER HOW MY FAMILY HAVE TREATED!!!!! OVER THIS ENTIRE SITUATION YOU GUYS HAVE PUT ME THRU ...!!

Consumer Complaint: Our mortgage was through XXXX XXXX XXXX. XXXX sold our paper to NationStar. We received notice of the new name and address to send our payments to. As we were in bankruptcy at the time, we received no billing statements to show the amount due or credits being applied for 2 or more years. We had been paying {$1400.00} each month. Not once did they ever inform us that our payment amount was actually {$1400.00}. We had transposed a number and it was never corrected. Then in XX/XX/XXXX our bankruptcy attorney gets information that we are over {$5500.00} in arrears and that we had n't paid our mortgage since XX/XX/XXXX. We sent all the proof that we were paying our bills and every person and attorney that our attorney spoke with had a different explanation and amount that was due. Needless to say, we determined that it was the difference between the {$1400.00} and the {$1400.00} that had actually caused the shortages and brought our account 100 % current in XX/XX/XXXX. Now on XX/XX/XXXX we get 3 letters dated within 1 day of each other advising us that we are in arrears {$5200.00} which is money owed since XX/XX/XXXX. They are trying to steal our money and steal my home! They also claim that they are sending documents certified mail and they are not. No one signed for anything and it was delivered in an envelope with our regular mail. They are now calling themselves XXXX XXXX. They are threatening to foreclose on our property and we are not even 30 days late to them.

Mr. Cooper has made at least eight ( 8 ) emails, a dozen ( 12 ) calls to my cell phone, and today called my employer 's Human Resource Department. I spoke to Mr. Cooper today after they called my employer. Mr. Cooper said that I have a sixty ( 60 ) day grace period for payments made to the previous lender to be transferred. Yet I am being harassed. These are illegal collection calls. I want the collection calls to cease and my credit report to not reflect any late payments. Mr. Cooper is not due a true payment from me until XX/XX/XXXX as payment was made to XXXX for XX/XX/XXXX.

Consumer Complaint: I am writing because I am one of many citizens that are in a status in which HARP does not help but yet, we suffer from the same problems. I bought my house back in 2005, shortly before the fall of the housing market. Like millions of others, I was under water ( almost by 1/3 ) as soon as it happened. I have not been able to get any help at fixing my situation and am worried about losing my home and maybe even having to go bankrupt. Not something that is appealing to me. I am not trying to reduce what I owe, I just want to get into a situation where I am not at risk by the rise of the interest rates. I understand that it is because of my ignorance and not truly researching my options when buying my home. It was just a dream and the builder made it so easy to get into the house and told me I would be able to refinance within a year. Well, that opportunity never presented itself after the decline in the market. I am a veteran and should have used my veteran 's benefits, but did not. I am not sure why we are excluded from the help that millions of others that just happened to use XXXX XXXX or XXXX XXXX are provided.

Consumer Complaint: LOAN NO.,XXXX Seven months ago as inheritor of the Estate of XXXX XXXX (legally registered in XXXX County Probate court) I approached Nationstart dba Champion Mortgage to pursue a shortsale on the property. We were assigned as our contact person XXXX XXXX (Tel XXXX email: "XXXX XXXX" ) , who informed us of the requirements. We submitted an inspection report, an appraisal, and Sales contract. Days later the content of the inspection report was ingnore and the entire package was rejected, then Champion decided to send their own appraiser who did not take into full consideration the dire condition of the property, and the net price that Champion agreed to was $XXXX. It is interesting to know that the Appraisal was completed by Champion Appraiser XXXX XXXX XXXX on XX/XX/XXXX yet we did not received Champion Approval letter until XX/XX/XXXX and this was after making several requests, that means that we were penalized for more than a month from the date of the bank appraisal. After discussing this buyer, I persuaded him to resubmit a new sales contract and HUD1 with the new price, several weeks later after requesting several times the confirmation letter we finally received it. The bank appraisal had an expiration date of XX/XX/XXXX. Unfortunately due to hurricane XXXX and the State of Emergency called by the Governor, we could not proceed with the closing as planned. Last week I emailed XXXX XXXX as well as my buyer requesting a short extension since the entire legal community and the courts were closed due to the aftermath of the hurricane. To my astonishment the two week extension was denied and now we are back to square one. The property incurred substantial damage yet due to past experience with bank appraisers, whoever they send will appraise the property at a higher price totally ignoring the condition of the property, this is done in a very SUBJECTIVE WAY as to minimize the lose the bank will incurred as a result. In a time when millions of us in Florida went through this catastrophic hurricane it is incomprehensible and completely unfair by Champion mtge to impose such deadline totally ignoring the facts on the ground. Summary: I EXPECT THIS AGENCY TO LOOK INTO THIS MATTER AND CONTACT THE POWERS THAT BE AT CHAMPION MORTGAGE TO WAVE THE XX/XX/XXXX DEADLINE AND GIVE US TWO WEEKS TO PROCEED WITH THE CLOSING ON THE PROPERTY. THIS TYPE OF BEHAVIOR BY A CORPORATION WITHOUT REGARD FOR THE ELDERLY WHEN WE HAVE JUST WENT THROUGH THE BIGGEST HURRICANE IN HISTORY IS TOTALLY UNCALLED FOR AND NEEDS TO BE FULLY ADDRESSED BY THE REGULATORY AGENCIES. SHOULD NATIONSTAR / CHAMPION MTGE REFUSES TO WAVE THE XX/XX/XXXXAPPRAISAL DEADLINE, MY BUYER AND I WILL BE FORCED TO FILE A COMPLAIN WITH THE SECRETARY OF HOUSING AND URBAN DEVELOPMENT THE GUARANTOR OF THE REVERSE MORTGAGE AND I WILL SEEK ALL LEGAL REMEDIES AVAILABLE TO ME TO ADDRESS THIS ISSUE.

I am writing in regards to an Investigation for POSTED UNAPPLIED MORTGAGE PAYMENTS, POSTED INTEREST PAYMENT REVERSAL AND PRICIPAL PAYMENT REVERSAL. You missed the mark on all the issues. Or perhaps you continue to do that on purpose hoping that we will just go away. So we will again attempt to spell out the issues to you. # 1 loan was closed with you as a HARP refinance : see exhibit 1 ( 1page ) However you did not comply with the HARP refinance guidelines as established. The biggest issue is we were charged an enormous amount of points ( XXXX ) to get a lower interest rate because of our LTV but HARP guidelines do not count the LTV. Also we should not have been charged the outrageous Origination fees ( {$990.00} ). Yes we were given pricing options but we did not know that a HARP loan doesnt not have this because that was never disclosed to us, so we chose what we thought was the best of the ones we were given. YOU are the underwriter and should have known that a HARP can not charge points, origination fees and most of the closing cost we were charged, not us!!! # 2 Settlement agreements : see exhibit 2 ( 14 pages ) You continue to miss the issue here!!!! We were given 3 different settlement agreements at closing. NONE of them were marked preliminary as you keep stating. You even provided CFPB with a copy of one marked preliminary that you insisted was what we were given, but the copy you provided was unsigned. WE provided you and CFPB copies of the ones that we did sign at closing ( SEE OUR SIGNATURES ON THESE ) and they WERE NOT MARKED PRELIMINARY!!!. # 3 Escrow Issues : You keep trying to explain using all this legal jargon but the ISSUE is there was a shortgage because your closing department screwed up. They were provided with copies of our Homeowners Policy and Property tax bill. But when YOUR closing department calculated the settlement charges for the escrow they showed our Homeowners Policy coming due in XX/XX/XXXX when it was and has always been due in XX/XX/XXXX!! Thus when the bill came in XX/XX/XXXX there wasnt enough in there. Theres your SHORTAGE!! # 4 The Collateral : THIS WAS A REFINANCE!!!!!! The original loan was purchased by you from XXXX and XXXX got it from XXXX XXXX XXXX who got it from XXXX XXXX XXXX. The original loan was secured by 5.30 acres and our home ONLY!!!! Exhibit # 3 ( 11 pages ) is a copy of the Deed to Secure Debt that YOU cancelled when we did the refinance : the last page includes the legal description of the property that was securing the original debt, PLEASE READ IT!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!. It states that the loan is secured by 5.30 acres. The deed we signed at closing did not include the legal description of the property, this wasnt an issue because WE knew that we were doing a refinance only. Exhibit # 4 ( 15 pages long ) The deed that YOU recorded is Exhibit # 5 ( 15 pages long ) and NOW is on a total of 13.79 acres. And in your response you stated that you would need a survey and a new appraisal to fix this. NO YOU DO NOT. We have had enough of the run around and games. We have clearly and accurately explained our issues and provided documented proof of your errors. Consumer Complaint: On XX/XX/XXXX, my bank electronically transferred {$1200.00} ( slightly more than 2 months payment as I had missed one month ) to Nationstar Mortgage. My loan was sold to them by XXXX in XX/XX/XXXX. On XX/XX/XXXX, I received a Notice that I was in default by something called XXXX XXXX. When I called and attempted to speak to someone at XXXX XXXX, the recording indicated that Nationstar was now XXXX XXXX. When I got through to XXXX XXXX by e-mail, I had to set up an account and it shows that I owe {$1100.00}. This is incorrect. In fact, I paid slightly more than that as proved by my bank 's confirmation # XXXX, delivered XX/XX/XXXX. The person that I finally got through to ( after 7 calls and hours of wait time ) told me I had to take out a credit report. This incorrect information is threatening my credit line and XXXX XXXX 's failure to properly credit my account could expose me to foreclosure. I want XXXX XXXX to correct its ' information. Further, I 've not received a bill for my next payment nor, in fact, any notice that XXXX XXXX is the proper party to pay.

Consumer Complaint: I have a mortgage with Nationstar, I fell behind because my husband was injured at work and was out on XXXX. I tried to make a payment to pay the mortgage current with the full amount past due, I was told I needed to pay attorney fees as well, they made me wait a week to get the payment meanwhile everyday the amount goes up. I finally get the payment they want which is XXXX dollars more then what my actual past due balance is, then they tell me i can apply for a modification, I applied and sent in everything they asked for, it took 2 weeks to hear back ( still accruing more fees ) finally I get a rejection on their website ( that I checked every single day ) and no explanation as to why. So now I am stuck having to find things to sell just to get this extra XXXX dollars in attorney fees to pay them current so they will accept the payment. I feel like it is set up so companies can take advantage of people already struggling. It should not be allowed for them to be able to reject a payment that does not include fees that the company opts to incur. I did not ask them to get an attorney I have been trying to catch the mortgage up, the attorney benefits them not me, why should I have to pay for it. I just want to pay them what I owe them and they reject it. Unfair to the consumer. Inconsiderate to people who are stuck in a temporary situation. Nationstar mortgage AKA Mr.Cooper only has one goal and that is to foreclose.
