Consumer Complaint: I have a mortgage with Nation Star XXXX XXXX XXXX XXXX loan is XXXX old it was a 90 % purchase. Its a very hot real estate market in XXXX XXXX XXXX ID. Did my research and know what my house is worth which would put me close 70 % XXXX easy to qualify no PMI. I pick a re-value from a realitor. She came did it value came back {$22000.00} under purchase price from over 2 years ago. They did not send Xome valuation assessment until I ask for it once I got it immediately saw problem she listed it as a 2 bedroom vs a 4 bedroom ( appraisal from purchase has it listed as a 4 bedroom recorded as a 4 bedroom in county records ) Called Nation star told them of the mistake they said she a trained professional and I was wrong. I argued made my point said I would have to send all info I had to nationstar with all my facts and they would review. Have not heard or gotten anything in the mail from them very frustrating.

Issue: Struggling to pay mortgage

Consumer Complaint: Our home was foreclosed on unlawfully, and then barely 1 1/2 months later, was reverted back to us. Stating for reason, " miscommunication ''. XXXX XXXX, We fell behind on payments, due to employer unable to fulfill payroll, we applied for loan modification with lender. Modification dragged out, sending and resending documents, til XXXX XXXX, when per lenders lawyers, had us send new modification documents, because 1st attempt was processed improperly. XXXX XXXX, New Modification started, again dragged out til XXXX XXXX. Several attempts by phone messages and letters by express mail to lender to get status on modification, but were ignored. XXXX XXXX, we received 1 single document, with an amount due, we sent in a check to see if we could get a response, since no one has ever gotten back to us. We did get a response, the lender sent us another modification, with letter thanking us for requesting. XXXX XXXX, we sent the new mod documents back and included another letter stating, we are again in the middle of a mod. and still waiting for answer. This is the 3rd time. XXXX XXXX, we received letter saying we were being foreclosed. Called that #, asked what about the modification packet you just sent us and we sent back, and the others modification packets? We have never gotten notification. Was told we needed 1 more document. We asked were you going to let us know this. One of the reasons was, They said we did n't have our correct address. XXXX XXXX XXXX, we were foreclosed and evicted from our home of over 20yrs. XXXX XXXX, barely 1 1/2 months later we received a letter from lender stating, the foreclosure was being rescinded due to " miscommunication ''. XXXX XXXX, lender requested, again modification documents. XXXX XXXX, we were told beginning XXXX thru XXXX, we would have to do a 3 month trial period in order to now keep our home. No delaying. When we were evicted we had to sign a 1yr lease, and unable to get out so quickly. XXXX XXXX, we were told we could move back into our home, but we could n't because of the damage that had happened, while in the possession of our lender. Pipes burst and water damage throughout the home. We had to pay plumber {$2900.00}. to get fixed. Still have to get holes in walls, floor and ceilings fixed on all levels. Nevermind replacing carpets, flooring. XXXX XXXX, We paid the 3 month trial period, with exception of the XXXX payment, where we by absolute mistake, sent in the wrong payment amt, and they closed out our modification, requiring us to reapply. XXXX XXXX, the reapplication was with the same information, that was given when we received the mod ( 3 month trial ), but this time we were denied, and are now facing losing our home for a second time. ( the incorrect amt was pd, because of a statement we received from Nationstar, with due date being same, XXXX XXXX ) but we were told, we should 've ignored. It was a little over {$200.00}. difference, we asked could you have told us? We would 've sent difference by XXXX XXXX. They said it was too late. Once again, we have not received an official denial letter as of yet, but we have been told, that they have denied. We applied for the original modification, to get back on track with our mortgage, we have always wanted to keep our home. From original letter of modification, we thought it was only going to take 30 days, to get a decision. We did n't realize it would be dragged out over 2yrs. The " miscommunication '' just got so out of hand. We are asking for your help. The lender has said we have had too many chances. We applied originally, and other modification packets were sent due to the 1st not being processed correctly. Our chances started with the 3 month trial period, and if we had not received that 1 document with a different amount, we would n't be writing to you right now. That is how this " miscommunication '' has continued through this whole process with our lender. We just want to keep our home and get back on track. Thank you in advance for your help.

Consumer Complaint: My daughter and I fell behind with our mortgage. We contacted XXXX XXXX XXXX in XXXX XXXX, MI. We were referred to them for housing counseling to help us apply for a loan modification. Our counselor, XXXX XXXX, submitted a loan modification through the XXXX XXXX XXXX on XX/XX/2017. While we were waiting for the review, we received a letter on XX/XX/XXXX stating a sheriff sale has been scheduled for XX/XX/2017. We contacted our counselor. XXXX called Mr. Cooper ( formerly known as NationStar ) and they stated they did not get an application and that XXXX was not authorized on my account. I went to see XXXX on the XXXX and he showed me an email he received from NationStar stating that our application was rejected because our sheriff sale was less than 30 days. Our problem is that Mr. Cooper stated that there was no application and that XXXX was not authorized. They must have gotten an application if the application was rejected. We also got a loan modification application that was mailed on XX/XX/2017. The application stated that it had to be completed by XX/XX/2017. We called Mr. Cooper and they stated that it went sent the application by XX/XX/XXXX, that they would review and try to put a hold on the sheriff sale if we sent a complete application. We called XXXX and brought him the signed application and he submitted it for us. We contacted Mr. Cooper on XX/XX/XXXX and they stated that they received a completed application and were reviewing it. The sheriff sale was still scheduled for XX/XX/XXXX. We called Mr. Cooper on XX/XX/XXXX and they informed us that the application had gone to underwriting and that the sheriff was postponed to XXXX but later was put on hold till the underwriting process was completed. We contacted XXXX and he suggested that we get something in writing saying that the sheriff has been postponed or put on hold. Mr. Cooper stated that they do n't a form saying that sheriff had been put on hold but that XXXX can call them back and request something in writing since he was authorized. XXXX called Mr. Cooper and spoke to XXXX in Arizona. She told him that he was not authorized on the account. XXXX stated that he asked her to review the application that was sent on XX/XX/XXXX. She refused to review the application and told XXXX to fax or email the authorization which would take up to 72 hours. He called Mr. Cooper again and spoke to XXXX from Texas. XXXX put XXXX on hold for at least 20 minutes while he reviewed the application and then the call was disconnected. We are concerned because Mr. Cooper is giving us the run around by telling XXXX that he is not authorized, that we never sent an application, by sending XXXX an email saying that the application was denied, sending us a sheriff sale notice a few days after receiving a loan modification application, telling us that the application was received and telling XXXX that he is not authorized again. We are doing everything that we can to save our house and that 's why we contacted XXXX XXXX XXXX. We believe XXXX is trying to his job as a housing counselor but Mr. Cooper has not cooperated with him. We have also tried to contact XXXX XXXX XXXX, XXXX. which are their foreclosure attorneys. They do not answer their phone calls and do not return voicemail. We have been waiting for over a week to hear back from them. As of right now, we are taking Mr. Cooper 's word that the sheriff sale in on hold but we have no proof that that has happened.

Also we have not received all the information requested validation of debt and they are still rushing forward with the sale. Cancel Checks of Transaction Proof of license to collect debt in Georgia Verification copy of judgement Any assignment of mortgage that can declare legal standing records of all correspondence from you I have enclosed a copy certified affidavit just in case it has not uploaded to your office. I faxed the affidavit over to XXXX and mailed to the locations listedlisted in the attachment. Mortgage frau has been commited an they are not answering to i. Consumer Complaint: I sold my home X/XX/2017 and from the sale paid off my mortgage with Nationstar. My credit report is still showing the account is open with a balance of {$140000.00}. I received confirmation from Nationstar that my loan is paid in full. All of my other loans paid from the proceeds of the home sale reflect paid on my credit report ( i.e. car loan with XXXX XXXX XXXX, etc. ), with the exception of Nationstar. Please update my credit report immediately as this is false reporting.

Consumer Complaint: My wife XXXX and I requested a Loan Mod through Nationstar Mortgage Loan number XXXX in XXXX. We had a fixed rate FHA Loan at the time we requested the Loan Mod. Due to limited communication from Nationstar during the approval process of the Loan Mod which took Several months to approve we did n't know until we received paperwork to sign indicating there was an XXXX baloon payment being added. Out of desperation due to my wife being unemployed we accepted it. We felt that if we sold our home are Refinanced it the Baloon note would be included as part of our total payoff. We refinanced our Mortgage with XXXX XXXX in XXXX XXXX and received a Conventional loan, Loan. number XXXX. We were excited as we requested a Cash out Reference to take care of some home improvements. In XXXX XXXX we received a collection notice letter from XXXX XXXX with HUD regarding repayment of the XXXX balloon note. We also received a collection notice from US Dept of Housing attempting to collect debt. On XX/XX/XXXX I spoke with a Supervisor with Nationstar Mortgage now known as XXXX who provided me a paid in full letter to provide HUD and insisting the XXXX balloon not was a part of the Payoff and we owe nothing. I had to leave a message with XXXX XXXX with HUD XX/XX/XXXX asking her to contact us so we can provide the Paid in full letter provided by Nationstar Mortgage. Her voicemail stated she will be out of the office until Monday XX/XX/XXXX. Thus far HUD has reported this to the Credit Bureaus thus ruining our Credit and are threatening wage garnishment which will destroy our Finances as well. My wife was rescently hospitalized in XXXX with XXXX problems and has accrued a large amount of Debt from that. Any assistance you can provide in this matter would be greatly appreciated. Initially, XXXX XXXX XXXX advised the CFPB the debt was reinstated after their agent filed a Notice of Rescission. Now, XXXX XXXX XXXX has stated the Notice of Rescission is invalid and ineffective. Therefore, Nationstar has no debt to collect that XXXX XXXX XXXX allegedly assigned. However, Nationstar Mortgage is still reporting this alleged debt on my credit reports adversely without any substantiation and refuse to remove it.

Consumer Complaint: On XX/XX/XXXX, I spoke with XXXX XXXX a representative at XXXX regarding my XXXX mothers mortgage, she told me that the mortgage would be serviced by Nationstar starting XX/XX/XXXX. Foreclosure date was scheduled for XX/XX/XXXX. On XX/XX/XXXX, Nationstar started to service my XXXX mothers mortgage, Estate of XXXX XXXX from XXXX XXXX. I called Nationstar to discuss the impending foreclosure and to apply for a short sale and Nationstar stated that they did not have the information in their system yet and to call them onXX/XX/XXXX. OnXX/XX/XXXX, Nationstar officially changed its name to Mr. Cooper, which caused many software and integration issues, which made the process of transfer over my file even slower. Called onXX/XX/XXXX, spoke to XXXX, still the information on my mothers mortgage was not in their system and was asked to call back on Tuesday. Called back on XX/XX/XXXX, spoke to XXXX finally had the information in their system, but could not speak to me because they did not have the executor information, naming me the executor of my mothers estate. I was asked to email or fax over the necessary paperwork and that it would take them 3-5 business days to process in their system. Bear in mind, that all this information had been previously submitted to XXXX, was in part of the file that took the 10 days to download, but they were too lazy to read through the file. I emailed and faxed over the requested paperwork on XX/XX/XXXX Called onXX/XX/XXXX and spoke with XXXX XXXX. she told me there was not a foreclosure date scheduled yet and that it was on hold. Also spoke with XXXX in the short sale department and she told me to have my real estate agent enter the property information in the XXXX system. On XX/XX/XXXX, I called and was informed that the foreclosure sale date has been postponed and there is not a new date yet. My Realtor, XXXX XXXX, was having trouble uploading the property info into XXXX. the Short Sale contract had been executed on or around XX/XX/XXXX, and was just awaiting approval. It was from a very qualified third party buyer with excellent credit and income, and was offering to pay all-cash. On XX/XX/XXXX, the realtor was still having trouble uploading into XXXX short sale system, so she tried to give it to my attorneys assistant, XXXX XXXX, to enter. She was on vacation for a week then was in court for a week. On XX/XX/XXXX, I called Mr. Cooper and I was told that the property was still not in the system, and if it was not PRECISELY spelled and addressed as they have it, it will not upload. He said that they may have listed the address as XXXX XXXX XXXX XXXX, rather than the correct way of spelling it as XXXX XXXX, without the XXXX between XXXX and XXXX I relayed this information to XXXX XXXX, who promised to get it done. I gave her the contact info for XXXX software for help. I was also told to call the foreclosure attorneys, XXXX XXXX XXXX & XXXX, which I did, and left messages with several people, including XXXX XXXX, who is listed on the foreclosure sale as the contact person for the foreclosure. I never received a return call. XX/XX/XXXX, Saturday, I received a late email from XXXX XXXX that it was success uploaded to XXXX. OnXX/XX/XXXX, Monday, I called XXXX at Mr. Cooper, and she confirmed that info was successfully set up in XXXX. She told me it then had to be assigned a negotiator, and then he had to review the file, and assign it of an appraiser, who would then have to go to site and inspect, and write up an appraisal and submit back to negotiator. Negotiator would then have to decide it offer price in existing four-month-old short sale contract was adequate. This all had to be done before the XX/XX/XXXX foreclosure date, and they were not allowed to postpone the foreclosure unless they had an approved Short Sale. I was informed that this typically takes 37 days window, and it rarely gets approved any quicker. On XX/XX/XXXX, the short sale was declined because it was now too close to the scheduled foreclosure date. I feel I was set up for failure with Nationstar/Mr. Cooper. They could have told me everything I needed to do all at once instead of giving me bits and pieces, every time I called. They lied to me that the foreclose had been adjourned indefinitely subject to my good faith efforts to get the short sale approved. I received the same riggamoral from XXXX, the loan servicer prior to its transfer to Nationstar. I called the attorney representing the lender in the foreclosure, and left repeated messages, and they never returned any of my many calls. They also have me listed as a defendant incorrectly on the foreclosure complaint. I am listed not only as the executor of my mothers estate ( TRUE ), but also individually ( FALSE ). For months now, I have been telling everyone remotely involved in theirs mess that I am not part of this mortgage, and it was my mothers mortgage ( wherein, by the way, they charged her {$10000.00} in fees and points to refinance her existing {$40000.00} mortgage up to a {$60000.00} mortgage, so she paid {$10000.00} to obtain another {$20000.00} in mortgage amount, or a net amount of {$10000.00}. ) I was NEVER a co-signor or co-guarantor on this mortgage, yet I am being sued individually, which means they can execute a judgement against me personally.

Consumer Complaint: I 'm making payments to bring my account current, I reviewed the my account on line to verify that there 's a XXXX balance on my account. I asked what this balance represented and it was explained that this was due to sending someone to verify that I live at my property? In awe I said excuse me! The person indicated that we tried to contact you unsuccessfully and we sent someone to make sure you lived at the address. I said and how did you do that when since I 've purchase this home no one has ever come here to verify that I live here so how did you do it? she placed me on hold and came back a few moments later and said it 's a maintenance fee? I said maintenance of what she said whenever your mortgage payment is late we send someone to ensure you live there, again how did you verify this? This is a not so clever way to charge me a late fee even after incurring a late fee for paying my payment late yet your calling it something else! I want this charge removed from my account and it should be reviewed as fraudulent practices because it was never verified that I did live here other than the fact that I submit my mortgage payments, and I speak or have spoken with someone in this company at least once a month.
