Consumer Complaint: Property was Foreclosed while under protection of Active Bankruptcy Chapter XXXX I was in default on my mortgage due to unemployment. I filed for bankruptcy protection under Chapter XXXX. In XX/XX/XXXX, while in Chapter XXXX, my Bankruptcy attorney had a medical emergency and several of his cases including mine, slipped through the cracks and were dismissed in error on XX/XX/XXXX. An attorney stepped in and filed a motion to vacate the dismissal of the BK on my behalf. At a court hearing on XX/XX/XXXX the judge approved the vacating of the dismissal of the bankruptcy and the bankruptcy was reinstated. On XX/XX/XXXX Nationstar Mortgage, dba Mr. Cooper foreclosed on my property while I was still under the protection of the Bankruptcy stay. As of today, XX/XX/XXXX, I am still under the protection of the bankruptcy and they are proceeding with trying to evict me and they do not have a right to do that. Under the BK statute all attempts to collect a debt must cease. I am now employed and will be working full time and do not want to give up the home I worked so hard to keep.

Consumer Complaint: Starting back in XXXX XXXX My Mortgage was with XXXX XXXX XXXX. I had called them and asked if I could push one payment back since I was never late in 10 years and had loss my business of 18 years overnight. They said they could not do that. I was unable to pay the XXXX, XXXX, and XXXX payment when I suddenly get a call from XXXX stating that they want to work with me. I received a forbearance agreement which called for half of my regular payment to be made for 12 months. I made the 12 agreed payments, then contacted them and I was told that they were working on it. 3 months go by and all of a sudden XXXX XXXX services went out of XXXX! I waited to see who would pick up my loan and lo and behold it 's Nationstar!, who contacted me 5 months after XXXX went under. I explained to XXXX that I had completed my forbearance agreement and was on the cusp of completing my loan modification. At that point I was told that I would have to start the process all over!! Between XXXX XXXX and XXXX XXXX I must have given them my Loan application at least 11times!! 6 of those within 1 year!! ( XXXX XXXX - XXXX XXXX XXXX Finally, in XXXX XXXX I get a loan Modification approved, made my XXXX trial payments and was to begin in XXXX of XXXX with my First payment. That month I was rear ended at a red light at XXXX, after i was released from the hospital, I called Nationstar to advise them that I 'm out of work at the moment due to the accident and will be starting rehab due to one of my XXXX XXXX XXXX. I asked what should I do because I did not want any problems with this loan mod since it took me almost 7 YEARS to acquire! The response they gave me was " Do the best you can '' While out of work and still in XXXX XXXX 2 months later, Nationstar called me and asked how things are going. I said I 'm still out of work and in rehab. I was told once again " do the best you can '', then a month later I was served with Foreclosure papers. While dealing with the foreclosure suit, the judge ordered it to mediation, upon meeting with the County 's Mediation Department, I was told if I had made ONE payment, they could have started the process all over. I said I have been dealing with incompetence from this Company ( Nationstar ) for over 6 years! I would get repeated calls and when I would answer they would hang up, Once i was waiting for the Escrow Dept. to call me back, I end up getting a call from loss mitigation offering me {$5000.00} to move!! I asked " do you guys talk between the departments? The girl said '' no '' I said " I can tell, I 'm waiting for Escrow to get back to me '', Not receiving Faxes that I sent upon request ( this happened multiple times ), etc. many more I could list. This could have been completed Years ago, but due to widespread incompetence on Nationstars part, this has now put me in a compromised position.

Consumer Complaint: I became late on my payments last year. Nationstar offered me a modification. I accepted even thought it would extend out the 20 out of the 30 years I hade left to 40 years. My intention was that I would pay on time for 2 years and refinance out of Nationstar. Then I found out that Nationstar closed my mortgage/note 5 years ago when I was in bankruptcy even after I reaffirmed and have been making payments. So I stopped paying to find out why and what could be done. Who pays 40 years on mortgage that can not be refinanced because it doesnt exist and you may never own it in the end or you think you have it paid off just to be told that you owe more money? I tried to refinance it sooner and that is how I found out there is no note. So then the foreclosure process has started. It has only gotten to their attorney filing papers and requesting it but a judge has not signed off yet and I have denied all claims because I want answers to their claims. Well, I have found a way to pay off my loan ( through my employer ) and in the pay off request they added {$30000.00} fees to my pay off. In XXXX my loan was at {$110000.00} in XXXX it went to {$110000.00} and the payoff for XX/XX/XXXX is for {$130000.00}. I bought this home for {$130000.00} in XXXX of XXXX. I was given a XXXX interest rate even with no less of a XXXX from all three credit reporting agencies. I have tried to contact XXXX XXXX at Nationstar who never answers her phone and never returns her phone calls. So this is what I want help with. I want a true buy out. Not the overinflated one they gave me. I want it noted that I am now sending a check via certified US Mail to make a payment of {$6800.00} since she will not answer her phone to take my payment over the phone. If this can not happen then my boss can buy my house for me at the foreclosure auction for half of what they want for a payoff and they can be out that money since Nationstar closed my note in my bankruptcy and they can not come after me for the difference.

Consumer Complaint: I have owned my home for 15 years and now face foreclosure auction on XXXX XXXX because my mortgage company Nationstar has not given me an opportunity to cure my missed payments. I missed payments because I was involved in a bad car accident that kept me in the hospital for months and out of work for a year and a half. Now that I have steady income coming in from XXXX and VA benefits I am in a place where I can make a fair payment but Nationstar has not been willing to consider me for a modification or restructured loan that would help me fix this problem. The company changed their name to Mr. Cooper and claims that they are a community based lender that wants to help. I am here to tell you that is not true. I am being overwhelmed with junk fees and legal fees and their agents have not been willing to help me get considered for a permanent option to save my home. This is very stressful and disconcerting. I refinanced my loan in XXXX XXXX right before the market crash with XXXX XXXX XXXX XXXX I later found out that the owner was indicted for mortgage fraud and this company went belly up so the loan was transferred to XXXX and then eventually went to Nationstar. At the time I was a XXXX XXXX at a XXXX XXXX ( had been in this line of work for 25 years ) and there were no financial issues. Then I was involved in a bad car accident in XXXX and ended up in the XXXX. I was XXXX for three months and then had 6 months of XXXX while dealing with the XXXX XXXX on my XXXX. I was essentially out of commission for 18 months and due to missing so much time my company let me go from my $ XXXX a year job. That was a tough time for me and I ended up defaulting on my mortgage. I am currently on XXXX XXXX and monitored by the VA doctors. I was eventually able to get approved for my XXXX XXXX and also my VA benefits and attempted to get back into good standing with my mortgage. However, Nationstars agents demanded that all past due payments be reinstated in order to save my home from foreclosure. I can make a fair payment but am not able to reinstate the loan. I feel that the loss mitigation department at Nationstar/Mr. Cooper has denied me access to government and internal programs that should be made available to me. I wanted some type of modification or restructured loan so that I can fix this problem, but their agents have claimed that there are no permanent options. I have been sending in payments in order to show good faith and Mr. Cooper has been accepting them, but at the same time they have set a foreclosure sale date of XX/XX/XXXX I believe this is known as dual tracking. I want and deserve a permanent option. I want and deserve an affordable plan and payment on my mortgage so that I can get out of foreclosure and have the comfort of knowing my house is not going to be taken from me.

Consumer Complaint: I am filling a complaint with our mortgage company on a residential investment property that we purchase in XXXX, the name of our mortgage company is Mr. Cooper Mortgage, and in wish a few months ago had a name change, from Nationstar MortgageXXXX XXXX To, Mr. Cooper Mortgage. The problem is that Mr. Cooper Mortgage ( Nationstar Mortgage ) have refused to comply with the court order from our chapter XXXX bankruptcy that was filed on XXXX XXXX, it was confirmed on XXXX/XXXX/XXXX, it was Discharged on XXXX/XXXX/XXXX, and it was closed on XXXX/XXXX/XXXX. The court order for Nationstar Mortgage was confirmed at XXXX at 5.25 % interest rate for a amortized 30 year loan with the first payment beginning on, XXXX/XXXX/XXXX. Prior to our Bankruptcy being close and the reason our case took an extra year to close was because on XXXX/XXXX/XXXX Nationstar Mortgage sent us a preliminary notice of foreclosure stating that we were {$9100.00} in default, with an unpaid balance of, {$150000.00}, we filed sanctions against Nationstar Mortgage for failing to comply with the court confirmation order, and to properly apply our mortgage payments to the loan. On XXXX/XXXX/XXXX we filed sanctions against Nationstar Mortgage, on XXXX/XXXX/XXXX we reached, and signed a Settlement Agreement with Nationstar Mortgage, moreover Nationstar Mortgage paid out {$7000.00} toward our attorney fees, and we paid our mortgage co. ( Nationstar Mortgage ) {$3000.00} to bring our mortgage loan current. On XXXX/XXXX/XXXX the sanctions were dismissed because both parties had resolved our issues according to the Settlement Agreement. Soon afterwards our bankruptcy case was finally closed on XXXX/XXXX/XXXX. From the date we closed our BK case till now XXXX/XXXX/XXXX Nationstar Mortgage, same as Mr. Cooper Mortgage has not corrected our mortgage loan, they have not send us any mortgage monthly statements, Mr. Cooper mortgage ( Nationstar mortgage ) has refused to comply with the court order, and our Settlement Agreement. I have contacted their customer service call center, and bankruptcy lost mitigation department every month, and several months every week, and twice per month in trying to get this mortgage company to get their accounting corrected. For the past 3 months they claim that it is in review for the cramp down, and settlement agreement, but they have had over 15 months since our BK was closed to correct our loan accounting, and to send us a monthly mortgage statement.

Consumer Complaint: XXXX is missing from escrow account # XXXX. Mr. Cooper claims this money was disbursed for tax ON XX/XX/XXXX, however it was never received by the county. In other words, on XX/XX/XXXX {$11000.00} was deducted from my escrow account ( Account # XXXX ) by Mr. Cooper with the reference number XXXX. This was marked as a disbursement for the XXXX County Tax. ( Note that this transaction took place right before my mortgage was transferred to a different company-XXXX XXXX ). This disbursement/payment, that Mr. Cooper claims was made, never reached the XXXX county tax department as of today ( XX/XX/XXXX ). I contacted Mr.Cooper several times and they ca n't locate where the funds are and it could take an indefinite amount of time before they can proceed with a resolution. My current mortgage company has already made another payment to the county ( in addition to the funds that were lost and deducted by Mr. Cooper ). This resulted in a negative escrow in my current mortgage account. The lack of clarity from Mr. Cooper regarding a resolution on the missing amount is not acceptable. To summarize : the funds that Mr. Cooper disbursed from my escrow account ( labeled as taxes ) have not been located as of today. The XXXX county tax office never received this tax disbursement and Mr. Cooper does not provide credible information regarding where these funds are. Mr. Cooper 's wait & see approach for locating these funds are not acceptable as the funds are missing/not received for well over 1 month now ( i.e. dating back to XX/XX/XXXX as per the attached loan history statement ). XXXX County tax department has no record of these funds coming in from Mr. Cooper and this is also confirmed by the county tax department. I would like a formal response from Mr. Cooper on this matter and a refund ASAP. I have tried several times contacting Mr. Cooper but no resolution has been provided until today.

Consumer Complaint: I have been involved in a predatorial loan For18 years now I purchased my home from an gentleman that does not exists as well as the bogus Company he used that no longer exists however when I purchased my home in XX/XX/XXXX for XXXX with a second mortgage of XXXX to be paid to the gentleman in which I tried to contact several times after closing would not respond to me for payment he sold my home to me for XXXX XXXX XXXX XXXX with a company name of XXXX XXXX after I closed on loan a new loan was filed three months later in the XXXX XXXX XXXX public records for XXXX on my property in which there is not a property within 25 miles of my address that apraises out for that much I did not find out for serveral years later however I was in a adjustable rate and needed to get out of I.T I refininced in XX/XX/XXXX with a lady XXXX XXXX in which she was known for fraudulent mortgage loans in which she led me to believe that in the refinicing that there was no more second out of adjustable rate so XXXX XXXX would no longer be addressed on my deed however he still is on my deed to this day he doesnt exsist and my loan has been sold over six times and none of the Companies dont hold the deed to my home but yet they try to foreclose with so much fraud before theyve gotten my loan I purchased my home for a total of XXXX in XX/XX/XXXX and today I still owe XXXX for my home Iive in and been in 18 years now I have applied for modifications numberous time was at 13 percent interest rate from XX/XX/XXXX til XX/XX/XXXX was denied in serveral ocassions as well as did not pay mortgage for over seven to nine years because I dont know whom I paying to or if I could ever own my home individually and without someone else that doesnt exsist listed on my deed I am now with Nationstar in which is Mr . Cooper I jus would like to see how I could go about getting a loan forensic to bring some of this fraud to the open

Consumer Complaint: I have a mortgage with Mr. Cooper ( formerly Nationstar ). I flooded in Hurricane Harvey, with my insurance settlement being {$190000.00} which is being held by Mr. Cooper. I have uploaded my paid receipts so far, amounting to {$67000.00} out of pocket plus another {$18000.00} paid to my contractor today. However, Mr. Cooper refuses to release more than 10 % of my loan, amounting {$37000.00}, until I have completed 50 % of my home repair ( which would amount to nearly {$100000.00} ), at which point they will release 50 % of remaining funds. They have repeatedly refused requests for interim releases of money, leaving me paralyzed with the inability to repair my property in a timely fashion. They are now requesting another inspection, with a turn-around time of at least 3 weeks, before even considering release of more money.

Issue: Problem with a credit reporting company's investigation into an existing problem

Consumer Complaint: Once again, there is activity that is INCORRECT being reported by Nationstar Mortgage, LLC regarding my mortgage loan. Once again, after filing a complaint. I am met by retaliation by someone within the company, Nationstar Mortgage, LLC. This is not the first time this has happened. It has happened on several occasions. I am now attaching screenshots of what is being reported by someone at Nationstar Mortgage, LLC. I have personally met with my personal bank and have attached all checks that were cashed per month by Nationstar Mortgage, LLC. I have also attached the payment history showing all payments that were paid to Nationstar Mortgage, LLC since the start of my VA mortgage loan. Those documents have been mailed off to each credit bureau. Now ... someone at Nationstar Mortgage, LLC is once again, turning in incorrect information regarding payments that are not being reported. I believe as a clear means as retaliation regarding complaints sent to several bureaus. Someone at Nationstar Mortgage, LLC is still removing payments that were prior on my credit report such as XX/XX/XXXX payment. If you are going to report my VA mortgage loan. You have an obligation to report it correctly. Nationstar Mortgage, LLC has literally changed my credit report information on more than five occasions since XX/XX/XXXX. The current reporting is INCORRECT. I have made payments that are not being shown. The payments need to be reported correctly that reflect the payment history sent by your company, Nationstar Mortgage, LLC. I have once again filed not just this complaint. But with all credit bureaus. Clearly this is abuse of power, flatulent and down right ridiculous to still continue with inaccurate reporting, not reporting or incorrectly reporting with regards to my VA mortgage loan payments. As told by an attorney. Nationstar Mortgage if they are to report your mortgage payments to the respected credit bureaus, in which, they clearly have to all three credit bureaus. Nationstar Mortgage, LLC has a responsibility to report it correctly. Someone at Nationstar Mortgage, LLC has reported as you can clearly see on screenshots. " Under a partial payment program. '' I am NOT under a partial payment program. I have paid more than on some payments, MORE, than my initial loan contract. Once again, I am demanding that my payment history reflect what is on the current Nationstar Mortgage LLC payment history that was mailed to my home. I am once again, demanding that my FICO score by reinstated to reflect the correct changes. As per my phone call with XXXX this morning. It is someone at Nationstar Mortgage, LLC submitting the incorrect information. Nationstar Mortgage LLC needs to fix this ongoing issue ASAP. Sincerely, XXXX XXXX
