Consumer Complaint: In XXXX XXXX 2011 XXXX XXXX XXXX XXXX XXXX sold my property to the same investor BANK OF NEW YORK XXXX XXXX XXXX XXXX I filed a lawsuit against them we did a seattlement obtaining a loan modification on the account but I never got title back, the property is not showing on my name the title is showing still with the name of XXXX ( XXXX ), I had contacted the attorney that represented the trustee and the investor with no results until now, they dont know what happend to my case and the lender who is now Nation Star said that I XXXX XXXX appear as the owner, but I have a person living in the property that I wanted to do an unlawfull detainer and is not possible because Im not holding title. This continues to affect my credit since is showing as Im late, I also have a city report with a ticket becuase of the bad condition of the proeprty I cant fixed becuase the tenant doesn allow me to enter in the house because according to him and his attorney Im not the owner.

Consumer Complaint: I paid off my XXXXyr XXXX mortgage on XXXX/XXXX/2015. Nationstar charged me interest through the end of XXXX. Per the Federal Register Volume 79, No. 165, Page 50835 24, CFR Part 20 ( RIN XXXX ) : interest is only allowed to be charged through the date the mortgage is paid. I have made multiple phone calls without any progress on my overpayment. Natoinstar 's customer service has no accountability and are grossly negligent. I will never do business with this mortgage provider again.

Consumer Complaint: Here is a copy of the letter I submitted to our mortgage servicer, Nationstar. After further research, Nationstar did contact our county for the tax amount, however, nobody seems to be referencing the figures shown on our XXXX, which reflects amounts necessary to cover our escrow needs. That is my chief complaint. Letter to Nationstar-After repeated, unsuccessful attempts to speak with a supervisor regarding our concern, I 'm now attempting to make contact and get answers this way. I want to dispute the increase of our payment based on a faulty escrow analysis performed on our account. According to the CSR 's that I have spoken with, an analysis was done, and revealed that we were short roughly {$2000.00}. This was based on an analysis that was done in XXXX, and based on an amount paid to our taxing authority, XXXX County. Had your analysis been done correctly, it/you would have discovered that the amount you paid to the county was for the last 2 months of XXXX, therefore making it a faulty analysis. Had you done the analysis correctly, you would have contacted the county, or perhaps even read the HUD1, and discovered that the amount to be set aside should have been $ XXXX, or {$2100.00}. An amount that would have more than covered the tax bill. I will not accept, nor be responsible for paying in the rears, and making up for an error made by your company that appears to coincide with your purchase of my loan, and shows the incompetence of Nationstar to properly service my loan. We will continue to make the necessary payments in an amount that will satisfy all current needs on our mortgage. Any shortages from XXXX can be absorbed by your company as a result of your own error. Figures below are based on Escrow Disclosure Statement dated XXXX/XXXX/XXXX, and the original HUD1 from our purchase of the home. P & I- {$900.00} Escrow- {$180.00} Homeowners- {$83.00} ( an increase over the HUD1amount of {$54.00} to cover actual insurance costs with Travelers ) MIP- {$200.00} Total- {$1300.00} This is the amount you will receive on our due date of XXXX XXXX, XXXX unless I hear from you with another option to correct this mess. If this does n't initiate some dialogue, then I 'll be submitting a legal QWR to resolve the issue. Thank you, XXXX XXXX

Consumer Complaint: Nationstar continues to tell us that there is no scheduled foreclosure sale date on the subject property, however, the borrower received a notice of trustee sale. Today, I talked to Nationstar and was told that once again there was no notice of sale. I called the trustee company and much to my surprise, the trustee company is owned by Nationstar. This trustee company said that they have not recently been specifically told by Nationstart mortgage to foreclose, however,. the file had a notice of default filed in XXXX and therefore a notice of trustee has followed. There is NO DATE on the Notice of Sale, NO SIGNATURE on the notice and NO RECORD OF RECORDING the notice on title. It was simply POSTED to the borrowers door.

Consumer Complaint: I submitted a form requesting acknowledgement within 5 days and response and proof of who is the legal trustee of my mortgage to Nationstar Mortgage, they finally submitted a letter with a forged and falsified balloon note on XXXX XXXX, when the request was sent on XXXX XXXX. They claim only XXXX holds the note, when I sent an email to the company it came back non deliverable. XXXX XXXX claims they hold the note but can not figure out how to reach them as when I call the company my s.s. does not come up. I have also tried to get a loan modification and they have said I did not send in the paperwork when I did and XXXX went to the bankruptcy court to dismiss my case when they have no proof of holding and certificate or note to foreclose without offering me any assistance to catch up. We had to make them an offer but I never signed any paperwork nor did the bankruptcy judge.

Consumer Complaint: I XXXX went to my mortgage company wanting a modification they give me XXXX saying it was in house I could afford my mortgage then they came back saying the house mortgage is over an give me permanent modification that was to high I ask for a lower interest rate other than the 6 % they give me they said they do n't have to I could not afford the mortgage an it got me behind in my payments. I had to go to my XXXX to get money to try an make those payments an that got me in trouble with the IRS an trying to make the house note left no money for anything else
