Consumer Complaint: Dear Sir or Madam : In Re : loan # XXXX reason for me writing is that I am in the middle of a loan modification but are also in the middle of a foreclosure file by Nationstar Mortgage behind your back, who scheduled a sale of my property for XXXX XXXX, 2015, that I was not aware of, feeling secure while relying on the mortgage company 's promise that they " we will not foreclose while I am in the process of obtaining a loan modification. Furthermore, I believe the mortgage had already turned my loan over to a foreclosure attorney while luring me into believing that they are trying to work on a loan modification. This due process is called dual tracking and refers to the practice of a mortgage company running the foreclosure process at the same time of running the loan modification process and this is a violation of the National Mortgage Settlement. Lastly, I have submitted the form XXXX, Hardship Affidavit ; and Dodd-Frank Certification to my dedicated loan Specialist XXXX XXXX XXXX who is working on my file. Nationstar Mortgage purchased the loan from XXXX XXXX XXXX. Nationstar is now telling us there is no assumption clause despite paperwork I have to the contrary. I have no legal contract with Nationstar, all my contracts are with XXXX XXXX XXXX. By purchasing the loan, Nationstar assumes the terms and conditions of the original contract. I have spent countless hours on the phone with Nationstar representatives to no avail. They are refusing to honor the legal terms of my original loan that they purchased from XXXX XXXX XXXX.

Consumer Complaint: Unjust Enrichment of my Escrow monies on a new loan originated on XXXX XXXX. " I received your reply dated XXXX XXXX, XXXX. I still contest the ledger on my escrow account is wrong. The investigation is not conclusive in regards to my request because it does not address the core issue with the accounting of my escrow monies. The escrow transfer credit on line XXXX is the correct amount @ {$7000.00}, but these funds were intended to be paid out at the time of closing to our Village and our Insurance company for XX/XX/XXXX invoices. The estimated escrow payment at origination was and still is enough to cover all of the escrow expenses that have occurred, and the projected expenses for the near future, with the overage originally calculated and applied. Your letter is showing a negative adjustment to the escrow account for {$7000.00} ( I 'm assuming to fund the taxes and insurance ), which would put the escrow balance at {$1200.00} at the time of closing. But your reported escrow balance is not true because Nationstar did not pay the entire property tax bill at the time of closing. The starting escrow balance, and our escrow payments in XX/XX/XXXX were enough to fund the taxes and insurance for XXXX, XXXX, and will be for XX/XX/XXXX. ( Including escrow padding ) The amount of {$3400.00} was not an 'advance ' in XX/XX/XXXX, it should have been CREDITED from your stated escrow balance of {$8200.00}. And the tax payment was short, and I had to contact Nationstar to make the additional payment of {$2400.00} in XXXX XXXX - which is a LATE payment. This amount should also have been credited from the stated escrow balance. These XXXX payment total {$5900.00} to the Village of XXXX XXXX - not {$7800.00} ( as stated in your reply letter ). Also, at the closing Nationstar cut a check to XXXX for hazard insurance for {$1200.00}, which should have been credited from the escrow balance. Nationstar 's ensuing management of my escrow monies and account charges are negligent at best. And the amount of harassment put, as a responsibility on me is unjust and erroneous. The errors have all occurred as a result of Nationstar mishandling my escrow ledger. This was election I made to make my accounting simpler - I do n't need to have an escrow account.

I had to go through a complete maze of entering numbers and finally had to blast my phone with rapid XXXX and # # # # to get someone on the line. Then when someone answered and I told them of their horrific system they got downright nasty with me!!!!

At the time Nationstar executed the Purchase contract they agreed to give me {$36000.00} in relocation fees, which they are reneging on. XXXX : XXXX - Short Sale - XXXX XXXX XXXX XXXX, XXXX, Ca. The Discharge and Final Decree from the XXXX Bankruptcy Court, XXXX California XXXX XXXX ) lists XXXX XXXX ( taken over by XXXX Bank XXXX as a creditor, and confirms the debt was discharged. Attached also find the notification from the creditors meeting, confirming the date of recording, and that the court has determined the date of the lien is XX/XX/XXXX. This can be also be confirmed by the title report in your possession, and has been confirmed to us by the Nationstar 's attorney at XXXX Foreclosure Corporation. Also, attached please find the Notice of Motion for Relief of Automatic Stay, Proof of Service of Notice for Motion for Relief of Automatic Stay, and Relief from Stay. In the bankruptcy, only the XXXX lien, which is the mechanics lien, and the XXXX lien, the deed of trust now held by Nationstar, were not discharged. All other debts, including the debt of XXXX XXXX, the lien for which is now held by XXXX Bank, were discharged. The bankruptcy documents clearly show the XXXX XXXX debt as discharged. The bankruptcy documents clearly show that the only XXXX valid liens are the mechanics lien, and the Nationstar deed of trust, and these same documents confirm that the XXXX lien is the mechanics lien, and the XXXX lien is the Nationstar deed of trust. Consumer Complaint: I have tried to escalate this matter with NationStar multiple times in the past. I have opened a case with FTC - XXXX as well as XXXX XXXX. The reports contains all of the details of all the fraud, identity theft and harm that has been caused to me in details. I have been struggling to clear the damages cause. I was guided by the FTC to open a new case to resolve this matter, and if that does n't work that it would be escalated with the Federal Trade Commission. From XXXX XXXX to XXXX XXXX XXXX XXXX was my tenant. During this time XXXX XXXX was able to compromise my account and make changes to the account such as changing my contact information so that I would not be aware of her delinquents, as NationStar was corresponding to XXXX XXXX, instead of me. These actions caused by her are fraud. - On XXXX XXXX, XXXX, XXXX XXXX made a loan modification to my account without my consent or awareness by calling the 'Making home affordable ' department. If you reference the document attached, on page XXXX of the document, it shows faxed by her. - On XXXX XXXX, XXXX, XXXX XXXX wrote a forfeit letter again professing to be me, granting herself authorization to my account. This was XXXX of many methods which she used to compromise my account. This forfeit letter was given to me by NationStar during XXXX of my escalation with XXXX XXXX on XXXX disputing the fraud activities cause to this account. This letter was written by XXXX XXXX pretending to be me. If you call the number on the letter, that is XXXX XXXX cell phone number, and if you track the fax, it would show that it was faxed from her job. - I 'm suspect there might be more fraudulent activities on this account. Below are the actions I took to secure my accounts : -XX/XX/XXXX-changed username and password. - XX/XX/XXXX-legal action to remove XXXX XXXX from the property. -XX/XX/XXXX-I requested in writing, to revoke XXXX XXXX access to my account. These security implementation made some progress, but do n't thoroughly secure my accounts as XXXX XXXX was still able to penetrate to my account and make changes such as removing bank account information around XXXX/XXXX/XXXX, also, when I call the support number, I seldom get asked for the password on my account. Consumer Complaint: After falling on hard times I submitted an application in XXXX of 2014 for a HAMP mortgage modification to my mortgage holder, Nationstar Mortgage LLC. They lost my original application and I re submiited another XXXX in XXXX. The process has gone on now for XXXX a year consisting of Nationstar and my spoc XXXX XXXX consistantly losing track of just about every document that I have sent them. Each time documents were requested I send them multiple times via email and certified mail. All along the way when XXXX eventually received the requested documents he and Nationstar would then ask for yet more up to date documents. Eventually after close to a year and at great expense to me ( paying an accountant to put together documentation ) I was told my case was in underwriting finally late in XXXX. My original mortgage was aprox. {$2000.00} per month. My understanding was that the HAMP program would make my payments lower. It made sence to me since my income had dropped by more than 50 %. I was finally contacted via email by XXXX XXXX of Nationstar Mortgage that I was approved for a XXXX month trial period with payments of over {$3000.00} per month, more than 30 % HIGHER than my original payment. There was no way that we could afford this. I asked XXXX to look into this explaining that there must be some mistake. XXXX response was that it did not matter, I had to pay it anyway but I could send in a dispute. I explained that the reason we were applying for relief was for a " more affordable '' payment and not a larger payment. He did not care XXXX bit. I have still not received any response from XXXX or Nationstar in regards to my dispute. Instead however, I received a foreclosure notice in the mail. I have once again notified Nationstar of all of this via their internal messaging system and not yet herd from them at all. This has been going on now for over XXXX year now

Consumer Complaint: I have a mortgage in which the legal description is incorrect. I have repeatedly requested that the company who holds the mortgage please correct the error. My title company has also sent an email request. All requests have been ignored to date. The house that has the incorrect legal description on the loan is showing up on the title for the property next door that I am trying to sell. I can not sell that property with the cloud on the title. I need Nationstar mortgage to release the title to XXXX ( incorrect legal description on the title ) and order a new title search and prepare a corrective deed for XXXX XXXX XXXX XXXX. The mortgage should be for XXXX alone. Again, all requests have been ignored. This needs to be serviced and Nationstar will provide no service or answers.
