Consumer Complaint: I have been on XXXX for two years and had fallen behind two months. I applied for a modification because I was told that XXXX was an allowable reason for assistance. My wife is the sole wage earner and after reviewing our case they denied us for a loan modification. The denial letter stated that the reason was due to NPV ( net present value ). The denial letter was supposed to state the figures used to arrive at this decision. Unfortunately the denial letter provided some figures on income, value ... .it just arrived but I believe that the figures used were incorrect. According to my housing counselor our ratios for Income vs the housing expense ( PITI ) which is what HAMP looks at is at XXXX % and our rate is at 6.5 %, so based on this data if they were to lower the rate to 2-3 % then our PITI ( housing expense ) would be around XXXX-XXXX % meaning it would be an affordable payment. The investor is XXXX XXXX and we meet all of the criteria but the NPV denial makes it seem like we have no options. We 'd like to be re-reviewed and be given the data and figures used to arrive at a NPV negative.

Consumer Complaint: After weeks of applying, XXXX with XXXX from which my mortgage was transferred to Nationstar, I was approved for a loan modification. First, my mortgage total amount was increased by approximately {$20000.00}. from the original amount. I thought that the modification was for the life of the mortgage, however, my mortgage payments have increased by over {$250.00} since it 's inception.and is scheduled for yet another increase in 2016. Once the increase was supposed to be for escrow shortage even though the expenditures had been met. When I try to reach the bank for clarification, the connection is dropped and clear and direct answers are never in writing. I have not missed a payment in five years, however I am besieged by by calls as early as the XXXX until the payment is posted. Since XXXX of the qualifications was that you have to be in foreclosure, shopping around for a less predatory and transferring my modification is not an option. What other options are available to me? I am a senior citizen who is retired and became XXXX about XXXX mos. ago. Because of the initial increase, my house value has been under water for the last 5 years.

Consumer Complaint: I have a trial period of loan modification HARP. My mortgage was sold. Mortgage company will not send a statement. I sent my payment to the address on time. They will not acknowledge my modification, and take my payment and wo n't apply to loan. they say I 'm 49 days overdue. It is absolutely impossible to get a human being on their telephone, you can go around in the same circle for hrs.

Consumer Complaint: My husband and I are in the process of divorcing. Our children and I remain in the home that he and I have a mortgage on through Nationstar Mortgage. Due to the debt to value ratio being severely upside down my husband 's lawyer advised him to file bankruptcy on the home. He refused to speak with the mortgage company. They called me and I informed them of our current situation. I asked them if there were any options available for me to be able to take over the payments and full ownership of the home. They provided me with a few options and informed me that because my husband had stopped paying the mortgage for the past 2 months that if I wanted to have any chance of saving the home I had to make up those payments as well as make the current payments. I let them know that as a stay at home mom who was just starting back into the work force I was n't positive that I would be able to do that. The representative told me it was the only way and that I would have to make XXXX {$750.00} payments for the next two months or the phone calls would n't stop. I told him I was n't comfortable making the commitment at that time on the phone but would think about it and get back to him. He continued to pressure me into setting up the payments before I got off the phone. I refused XXXX more times and his pressure continued and so to get off the phone with him I agreed with the intent to call back and cancel the payments. I called back before the first payment was due at the end of XXXX and said I could not afford the payments and asked for them to be cancelled. The XXXX payment was not processed. To my surprise on XXXX XXXX a payment for {$780.00} was processed in my checking account. I immediately called the mortgage company and informed them that the payment should not be occurring and that they needed to stop it because I had requested it to be cancelled and I did n't have the funds in my account. They said they could n't because it had already processed. I called the branch of my XXXX account and asked them to stop it and they said they could n't either. I 've spent a great deal of my time on the phone with the mortgage company requesting that the payment be returned. XXXX representative promised that it would be, another told me it would n't because I was behind on the payments and another disconnected my call when I asked to speak with their supervisor. The original agreed amount was to be for XXXX {$750.00} payments, XXXX the end of XXXX and the XXXX the end of XXXX. The payment the end of XXXX exceeded the agreed amount by {$30.00}. I am displeased with the dishonesty and manner in which this has been handled and I would simply like the money returned to me. The money that has been used to cover the payment now is the child support payments that are made and the account is still overdrawn by {$220.00}.

Consumer Complaint: Nationstar took XXXX as part of my last loan modification agreement and held it in an escrow account. I paid the remainder of my XXXX house payment of XXXX plus dollars and the amount added up to the total XXXX house payment. NationStar never advised me that the XXXX was going to be held in an escrow account and they refuse to use these monies for my house payment. XXXX persons I had spoken with during the month of XXXX noted to me that these monies would go to my house payment. I called them again today, XXXX XXXX, 2015 and was told these monies have been denied to go to my payment. I can not have mark on my credit file due to their dishonestly. They are stated they have the XXXX in a suspense account and the remainder of the house payment is in an escrow account because " they did n't know where else to put it ''. The loan modification process is also awful. Their customer service is awful and they have many persons in their customer service that refuse to give direct phone numbers to a manager. It took me over XXXX hour on the phone to speak with someone in another department and he spent another XXXX hour with me on the phone. At the end, he said I need to call back to their " loss mitigation department '' I know NationStar received federal $ $ for assisting with the housing crisis. I completely understand why a class action lawsuit was filed against them.

Consumer Complaint: XXXXUpdate to Complaint XXXX regarding Nationstar Mortgage ; I was paid on the afternoon of Friday, XXXX XXXX. I logged into XXXX to pay my mortgage principle, interest, actual escrow, and late fee. Nationstar 's online system would not allow me to pay ANY AMOUNT except the total amount they deem owed - i.e. the additional $ 400+ they are trying to collect as a RESPA ALLOWABLE 'cushion '. I called Customer Service and was told that they can not accept any payments except the TOTAL AMOUNT NATIONSTAR DEMANDS either. I was told I could mail or XXXX XXXX a payment but until the Escrow Account Dispute was settled, my payments would be held in suspense, and I would have to pay the additional 'Escrow Shortage ' - THERE IS NO ACTUAL ESCROW SHORTAGE on my account for my payments to be credited and not considered in default. I asked repeatedly if that tactic was legal?? I was attempting to pay IN GOOD FAITH the amounts I owe to principle, interest, actual escrow amount, and late fee! How could Nationstar refuse? I was told over and over that they were trying to HELP ME and give me alternatives to pay what I 'wanted to pay via XXXX XXXX or the postal service. ' We can escalate a resolution but it would n't be solved for at least XXXX more days - within XX/XX/XXXX. I asked - why just escalating now? I filed a complaint with the CFPB and have received a mailed written response from Nationstar that it was being 'reviewed ' - NOW you can escalate it - but without accepting XX/XX/XXXX 's payments I am trying to make, and keeping XX/XX/XXXX 's payments in 'SUSPENSE ' - tomorrow I will be in the second month of DEFAULT? How is this legal? or HELPING ME? I hung up. I immediately emailed Nationstar Customer Service with the above complaint. I had to leave to go to work - I could not go to the bank, then to a XXXX XXXX provider to wire the payment I legally owe and am happy to pay. Today, Nationstar has my mortgage account in 2 month default.

Consumer Complaint: For the XXXX time in the 26 months since taking over servicing of our mortgage, Nationstar Mortgage has failed to provide a monthly mortgage statement. This follows previous complaints about this same issue, with the first XXXX filed with the CFPB on XXXX XXXX, XXXX as Case number XXXX. The first complaint concerned not providing mortgage statements in XXXX and XXXX of XXXX. Nationstar then did not provide mortgage statements in XXXX and XXXX XXXX, and XXXX XXXX. That caused us to file complaint number XXXX on XXXX XXXX, XXXX. We subsequently also filed a complaint over the failure to provide the disclosures required by 12 CFR 1026.20 ( d ) between 210 and 240 days prior to the reset of a mortgage payment, and Nationstar refusing to provide a copy of the Note with " any modifications thereto '' as required by California Civil Code section 2943 ( b ). 12 CFR 1026.41 provides the exceptions to providing a monthly statement, and our case does not fall within any of the exceptions. Nationstar has cited the existence of litigation as their excuse for not sending the required statements, but in our situation, only a filing of bankruptcy by a borrower provides a reason for not providing a mortgage statement. We have never filed bankruptcy.

Consumer Complaint: Nationstar Mortgage , LLC has recently taken over the serving of our mortgage. My husband has been making extra payments on the loan. As he soon as he began paying extra on our mortgage, Nationstar Mortgage , LLC started charging illegal and unjustified charges to account. Although we have paid in advance and above our monthly payments, Nationstar Mortgage is claiming we are in default. Among the unjustified charages, Nationstar Mortgage has charged us {$1600.00} in legal fees, a fee of {$19.00} ( unexplained ), and a property inspection fee of {$100.00}. Nationstar is claiming that we are in default and must pay {$2.00}, XXXX to cure the default. Actually we are current on our payments and have paid over {$200.00} extra in payments. But Nationstar will not credit our payments is and is making up fees. None of these fees are permitted per my mortgage documents. More importantly none of them are legitimate. I would like CFPB to criminally charge this group. I am not the only victim of this comapny.

Consumer Complaint: I filed a lawsuit against Nationstar Mortgage , LLC, hereinafter referred to as Nationstar, my servicer, and my original lender for various causes of action. I have been fighting them for at least the past three years but more so this past year. My fight has gone on deaths ' ears with the California Judges and they keep dismissing my case for reasons they go against the actual laws, more specifically California Homeowners Bill of Rights. Presently, I have a Motion for Reconsideration that is scheduled for XXXX XXXX, 2015. The new facts that I have presented in my Motion for Reconsideration involves a Notice of Rescission. On XXXX XXXX, 2015, I sent a Notice of XXXX to Nationstar. They received the Notice of Rescission on XXXX XXXX, 2015. Under the Federal Truth In Lending Act, my debt obligation, the promissory note and the deed of trust were canceled immediately, by operation of law. Under the statute, the creditor 's interest in the property is " automatically negated regardless of its status and whether or not it was recorded or perfected ''. Also under the Act, Nationstar had 20 days from XXXX XXXX, 2015 to challenge my Notice of Rescission by filing a lawsuit against me. They have failed to take any action regarding my Notice of Rescission. Because of their failure to challenge the rescission, they have forever waived any and all defenses to my rescission. Under the Act, Nationstar is now in violation of the law, and they are blatantly disregarding my loan rescission rights. I have sent them a letter of non-compliance and have requested they cancel the sale date that is scheduled on my home Thursday, XXXX XXXX, 2015 and that they forward me a release and a reconveyance as required under the statute. I am filing this complaint to inform the CFPB that Nationstar continues to ignore the law and that they are in violation of a Federal Act. Their actions are unacceptable. I request the CFPB take some kind of disciplinary action against Nationstar for their blatant disregard for the law. I am hoping with your interaction, Nationstar will choose to abide by the Act and take the necessary steps that is required of them by law.
