Consumer Complaint: First off, I believe that I am being wrongfully foreclosed on due to the following. On XX/XX/XXXX, the California XXXX XXXX posted publically, that XXXX XXXX XXXX, XXXX entity # XXXX was no longer allowed to do business in the State of California ; however, on XX/XX/XXXX, said company recorded a Notice of Default and Election of Sale under Deed of Trust in official records of XXXX XXXX. If XXXX was no longer allowed to do business in California, how were they able to issue foreclosure documents against my property. Next, XXXX XXXX XXXX is the new Trustee as of XX/XX/XXXX. Since this time, XXXX XXXX XXXX has recorded a Notice of Trustee Sale against my property piggybacking off of XXXX fraudulent Notice of Default. By failing to adhere to both California law and the rules under CFPB, The party ( ies ) complained of in my initial complaint are not compliant with rules regarding dual tracking. The Parties are " covered '' under both California XXXX and the CFPB 's strict guidelines. I have a valid and complete loan modification package that has been acknowledged as received and no notice of deficiency of documentation has been received by me. I just received another Notice of Trustee during the pendency of my application. The Parties have also failed to respond to the initial complaint with competent and reliable evidence that supports all facts contained within all recorded title documents that were used against my contract rights. Specifically, the assignment ( s ) of deed of trust to an un-verified entity, Notice of Default, Notice of Trustee Sale. No authenticated evidence has been offered by the offending Parties by any person with personal, first-hand knowledge of those facts. I am not in default to an unknown, un-authenticated party that is currently in my chain of title without competent evidence to support the beneficial interest.

Consumer Complaint: Regarding the handling of homeowners insurance related to a mortgage loan held by now Nationstar Mortgage that was transferred from XXXX Mortgage in XXXX 2015. Previously we have n't been escrowing for homeowners insurance and then independently Nationstar did not update the mortgagee clause nor set this up as non escrowed account then tried to first force place insurance and then not post a payment due to the escrow shortage. Even with showing proof of insurance they are now trying to force me to escrow even though i have this set up to pay with our insurance company causing me to stay on hold for over an hour to correct their errors. Still not convinced they are going to handle this correctly.

Consumer Complaint: As a homeowner, financial hardship was experienced. The mortgage company was contacted for assistance ( loan modification ). The initial request for assistance was over two years ago. All documents requested by the lender were submitted, but there were frequent requests for additional information. As time went by, documents needed updating. And, on multiple occasions, the full package had to be resubmitted. To make matters worst, a XXXX Sale notice was posted in XXXX. A representative at the mortgage company said this was in error and would be put on hold since a review for assistance was in progress. Unfortunately, the mortgage company dropped the ball again as the XXXX Sale was not postponed. The homeowner was able to get an extension, but as per policy this should not have happened. The homeowners are elderly and on fixed income. The time, effort and stress has adversely affected their well being. For over two years assistance was received from a HUD approved non-profit housing counseling agency. Prior to that, assistance was received from a family friend in local banking. They are now preparing to meet with an attorney for assistance.

Consumer Complaint: My mortgage company is Nationstar Mortgage. I pay $ XXXX/month in PMI. The PMI company is XXXX XXXX. I closed on my loan on XXXX XXXX, XXXX. My PMI certificate cites that my PMI rate is 1.83 % the first 10 years. Starting the beginning of the 11th year, the rate drops to .002 % which means that the PMI will drop to {$44.00}. That means my payment will drop {$360.00} starting XXXX XXXX, XXXX. I have sent certified letters to the company about the decrease in and initially they would only commit to the fact that the PMI would decrease. They refused to give me a quote on the amount of the new PMI rate. I continued to call, email and send certified letters to the company. They committed on several occasions to mail letters with the new amount and I never received the letters. I spent many hours on the phone to the company and made no less than XXXX calls since XXXX. I finally was able to talk to a XXXX XXXX XXXX from Nationstar on XXXX XXXX, XXXX. Within XXXX minutes, he emailed me a letter stating that the new PMI rate would drop from {$400.00} to {$44.00} starting XXXX XXXX, XXXX. Since the beginning of XXXX, XXXX, I have either called or emailed the company almost every day about the reduction in payment. My XXXX house payment is currently due and they have not reduced the payment. I refuse to pay the additional {$360.00}. The XXXX Homeowners Act specifically addresses PMI and disclosure. The company is supposed to disclose annually all the details of PMI. I have fought for several years with Naitonstar for information. If my property was appraised today, I would be able to drop out of PMI. But I have been unable to get the company to make any type of commitment or put in writing what would get me out of the PMI. They have violated the law by not disclosing this information. Unfortunately, I think I will have to result to legal action to make them do what they are legally supposed to disclose. They without a doubt have many individuals that are not qualified and the I am appalled at the their customer service. On one day, I made a total of XXXX phone calls and was on hold for hours without getting any help. My mortgage is the most important bill and to have the company so obviously disregard my emails and complaints is beyond ridiculous.

Consumer Complaint: I have a mortage with Nationstar Mortgage. Every few months I have to request payment history to check how the money is applied. Most of the time they do n't apply it correctly. I have been sending extra {$200.00} a month towards principal. XX/XX/XXXX I got the payment history and {$1000.00} ( XX/XX/XXXX-XX/XX/XXXX ) was not applied to principal. The money went to Corporate Advance??? account, Misc. account not to the Principal like I requested on the check. XX/XX/XXXX I sent an e-mail to NationStar. To this day I did not receive the copy of the corrected account which I requested. Nobody got back to me. The only letter and e-mial is the confirmation of receiving the complain. When the mortgage was with XXXX XXXX XXXX everything was clear. With Nationstar nothing is clear and the fact that they refused to sent me a statement make them do what they want.

Consumer Complaint: I took out a reverse mortgage a few years ago. I understood the stipulations to keep the insurance and taxes paid. However, I became very ill, we got into a financial bind and fell behind on the insurance and all this was explained to the bank. The loan started with XXXX XXXX XXXX, then sold to Nations Star Mortgage, then sold to Champion Mortgage. At this time we have obtained proper insurance coverage, worked out a repayment agreement with Champion Mortgage a document signed by both the mortgage company and the home owners. However, the first payment was returned and the house was bought back by the mortgage company stating that they received the agreement and the payment on different dates. We 've obtained legal counsel and have had XXXX court appearances to resolve the matter. Each appearance there has been a different attorney representing Champion Mortgage. This has been our home for 42 years, and XXXX generations, it 's too much history and too many memories to just let go. A 10 day notice was sent via USPS, and then an eviction was filed on another occasion to vacate the premises in 10 days. It is imperative that the public know that Champion Mortgage has done this to elderly couples before, the difference is with us we have others fighting on our behalf to retrieve our from the mortgage company.

Consumer Complaint: I have a house in XXXX and was living in XXXX when my loan was sold or given to Nationstar. During that time of my loan going to Nationstar my 2 payments were sent back to my checking account and I was behind on my payment and not aware that they had my loan until then. I had to call the old mortgage company to find out who had the loan and I caught the payments up. But at that time they had sent someone to the house and they ripped the glass storm door off the frame and the door is no good and the front door has to be re-framed and a new glass door had to be bought. Then the person went to the back door and changed the lock and broke the frame where we had to re-framed because the door knob would n't even keep the door closed. We moved back in the house XX/XX/2015 and have made calls everyday about what they were going to do about it. They have told me that they are checking into it and will advise me the out come and it been over a month. I have spent over {$1500.00} to buy a new door and reframe both door and they charged me for the person to come and destroy my house.
