Consumer Complaint: We purchased a new home XX/XX/XXXX. XX/XX/XXXX we had someone wanting to Assume our previous loan with NationStar Mortgage ( the house we moved out of. ) We began the Assumption process XX/XX/XXXX and submitted everything asked for at the time. We have now been working on this process for just over 14 MONTHS. We 've contacted them I can not even begin to say how many times. They 've given the run around to us from the get go. From telling us they can not do Assumptions ( yes, they can, it 's in our mortgage and loan contracts ), to we had to put her on our TITLE to our house before they could see if she 'd qualify for the assumption, to just plain no response, to documents are missing but no one can tell us what. XX/XX/XXXX we were finally given a list of documents needed including Purchase Agreement and Title Insurance Certificates. These documents were procured and then it took me approximately 3 weeks to get a fax number to submit these documents. On XX/XX/XXXX these were faxed in, all documents requested except for XXXX. They wanted a divorce decree and there WAS no divorce involved in our situation therefore no document to submit. I 've spent the past 3 1/2 months now trying to get an answer and update. All anyone will tell us is that it 's " in process. '' Then, XX/XX/XXXX, I was told that a letter had been mailed on XX/XX/XXXX and give it 7-10 business days to get to us. A letter still has not been received. When trying to call I 've been hung up on numerous times. The woman trying to assume our loan also called about three weeks ago and was ALSO told a letter was just mailed the day before. She also received nothing. This has to end. We 're just trying to do the assumption which is supposed to be a relatively easy process. They 're blatant incompetence and or down-right shadiness is inexcusable if not even, perhaps illegal. I guess we 'll find out.

Consumer Complaint: My credit was damaged when my mortgage company misapplied a payment and then accused me of missing payments. I make my payments the first of every month without fail. During an escrow analysis, I called customer service with a question. Unknown to me this triggered an inquiry which then led to my entire next mortgage payment being misapplied to the escrow account instead of to my mortgage. Again, unknown to me, all my subsequent payments were " late ''. When I was finally notified after several months, no one in customer service could tell me what had happened to my payment. After more than a month of calling and speaking to customer service and escrow representatives, all of whom assured me that they would take care of it and promised to call me back ( they never did ), I finally spoke to an intelligent young man in Escrow who figured it out and realized that the payment had been misapplied. At the same time I received checks from the company for a huge escrow overage ; the misapplied payment. This young man and a customer service rep managed to it straighten out and I used the escrow overage checks to make that " missing payment ''. When I asked about my credit ( score ) being damaged, I was assured that would n't happen. Of course, it did. When I contacted the mortgage company to ask that the negative information be corrected, I was informed by the " Research Department '' that this could n't be done as I had missed payments! Payment ( s ) that the mortgage company had misapplied. My credit has been damaged through no fault of mine, the mortgage company takes no responsibility, and I can not get through to anyone who can correct this misinformation and repair my credit score.

Consumer Complaint: I have spoken several times with Nationstar Mortgage, XXXX XXXX XXXX XXXX, XXXX Tx, XXXX. It has been over the accumulation of late charges and fees portion of the statements they have sent to us. Our Loan has been passed on to XXXX morgage companies in the past ten years. The last being XXXX XXXX. We had an agreement that a {$50.00} late fee would be applied to our monthly payments if we were late. When the transition took place Nationstar automatically said we owed XXXX in late charges and fees in a category included in our statement. I contacted them and told them to please get this corrected. That we have records showing all late charges/fees were up to date. With XXXX. Since that conversation XX/XX/XXXX the first month Nationstar took over. We have sent our {$50.00} late fee when applicable for being late. I have called them several more times about this issue in the last year. I got so frustrated trying to get someone to correct the problem I sent the fees along with my XXXX XXXX payment to balance this account. I sent my XXXX XXXX payment in with the {$50.00} late charge also since it was XX/XX/XXXX. Which should have balanced my account. I received a letter XXXX XXXX indicating that the money I have sent them. An accrued amount of XXXX for those fees real or added on has been put in suspense and they still are adding fees to my late charges when they are holding that money and telling me if I do n't sent another payment of XXXX for my XX/XX/XXXX payment they will send the XXXX back and add it to this XXXX. Making it look like I owe them XXXX for XX/XX/XXXX Plus more late charges/fees. My monthly payment is XXXX plus {$50.00} late fees. And that is it. I spoke with them today and asked why they keep accruing this Late/fee and keep charging me more charges and fees when they have this extra money that was sent along with my payments to clear these charges up. They said as long as I pay late at any time they are not going to apply these funds to my late charges fee to clear this up. I only owe XX/XX/XXXX payment right now. I estimated that if they pull this on a half a XXXX accounts out there ( which is probably a low estimate on the amount of mortgages they handle every month. ) and just XXXX dollars is tacked on to each loan in fees like this. They could be raking in XXXX XXXX dollars a month and no one would be the wiser. They keep asking me to send the money in and they keep accruing more charges on money they already have. I asked them again to put that money where they ask for it to be paid on and they refuse. These are the kind of things that XXXX, XXXX XXXX XXXX, XXXX XXXX pulled back in the trouble period with the congressional hearings and Dept of Treasury situation to make it look like people are behind for foreclosure attempts. This worries me that this company is using these tactics also to liquidate loans. Should I be concerned.

Consumer Complaint: In XXXX XXXX we were contacted by our Mortgage servicer stating we had missed XXXX mortgage payments XXXX XXXX, XXXX XXXX, XXXX XXXX, and XXXX XXXX. We acknowledged missing XXXX of those payments, XXXX XXXX. We submitted our checking account balance activity for the period of time that the missed payments were to have occurred. We also included photocopies of the endorsed checks stamped by the mortgage company showing they were deposited into the mortgage company 's XXXX XXXX account. We submitted a written qualified request XXXX XXXX, XXXX requesting a researched answer to the amount in arrears. We also have paid {$800.00} towards the amount we believe we are behind. Nationstar acknowledged receipt of this letter XXXX XXXX, XXXX and said they had 30 days to respond but most likely would have an answer within 7-10 days. We have yet to receive an answer from their research department. We 've received several other confusing communications from them. XXXX XXXX, XXXX I sent another letter requesting a researched answer. We assert our overdue amount is {$1800.00} of which we have already paid {$800.00} of. Our figure represents XXXX missed payment {$1300.00} for XXXX XXXX and 10 months of late fees {$410.00}. The confusing communication from Nationstar has included saying our overdue amount is anywhere from {$5500.00} to {$2900.00}. We received communication saying we have varying amounts in unapplied funds. We 've received communication stating they are returning funds to us- though those amounts have been deposited by Nationstar XXXX Also their communication states we face acceleration and possible foreclosure. It seems like the left hand does n't know what the right hand is doing. As soon as we were made aware of this issue we have researched and done our best to become current. This lack of a researched answer to our dispute has caused distress and anxiety.

Consumer Complaint: On XXXX XXXX, 2016 I appeared at an alleged creditor foreclosure hearing case number XXXX SP XXXX at the XXXX XXXX XXXX courthouse in front of an alleged assistant clerk named XXXX XXXX XXXX acting as a judge and whom is not an attorney nor a judge and was acting in and for a debt collector in violation of the FDCPA. I am a consumer under 1692a ( 3 ) and the creditor under 1692a ( 4 ) .The alleged assistant clerk knew or should have known what she was doing was illegal when she acted outside of her jurisdiction regarding a consumer transaction which was timely rescinded under federal law. The alleged assistant state court clerk allowed a debt collector 1692a ( 6 ) who was attempting to collect a personal, family and household debt 1692a ( 5 ) to be conducted in a creditor related non-judicial state court action in violation of the FDCPA 15 USC 1692i. The clerk threatened me stating she would call the bailiff into the room because I was objecting to statements made by a debt collector and because I asked if the court had given the debt collector prior written consent before they contacted me. The clerk was disrespectful to me by stating that I was to keep my mouth closed and only speak when spoken to ; and making statements that I should have gotten an attorney when I objected to my personal and private contracts being placed in the public record in violation of privacy laws. The assistant state court clerk additionally began advocating for the debt collector that an alleged debt was accelerated and I was given notice when I objected that I had not and asked for proof of delivery. For these reasons and the conduct and behavior stated above I am placing the complaint against XXXX XXXX XXXX with the Consumer Financial Protection Bureau.

Consumer Complaint: My wife and I sold our property XX/XX/XXXX. We have been waiting since that time to receive a corrected Discharge of the Mortgage that references a Modification Agreement and a XXXX Mortgage recorded XX/XX/XXXX. The original mortgage, obtained XX/XX/XXXX, was Discharged XX/XX/XXXX, post closing, but it did not include the reference to the Modification liens. The closing attorney will not release a portion of our proceeds until the XXXX modification liens were referenced in a Discharge. Subsequently, the lender, Nationstar Mortgage Company, LLC, sent a revised Discharge with a reference only to the Modification Agreement but not the Subordinate Mortgage. The lender keeps dragging its feet and has one excuse after another as to why they ca n't or wo n't reference the XXXX Mortgage. At first they said the payoff XX/XX/XXXX released both liens because they both had the same loan number, MIN number and FHA case number. Now they say they do n't have the authority to reference a Discharge for the XXXX Mortgage even though they prepared the documents. The latest tactic is to blame the Registry because they require a release of both liens and they do n't think it is required. My attorney has been working diligently with them but has lost all patience. She suggested I file this Complaint and see if it would do any good.

Consumer Complaint: Nationstar Mortgage is habitual in sending escrow overage checks and then raising the monthly payment amount to " cover escrow shortages '' in the same week. They have also paid for ( out of escrow which did n't have enough funds ) for coverages that were already paid for by the loan holder ( and Nationstar was TOLD that the coverages were PAID BY THE LOAN HOLDER and no payment was necessary. Yet, Nationstar created an escrow shortage and DOUBLE PAID the coverages. I have been trying to work this company on straightening out this situation since XXXX, 2015. I do n't believe that NATIONSTAR listens or provides ethical practices when it comes to dealing with their customers. What steps can I take. I am on a fixed income and can not refinance to " get out from under them. ".

Consumer Complaint: On XXXX XXXX, 2016 I appeared at an alleged creditor foreclosure hearing case number XXXX at the XXXX XXXX County courthouse defending my property against Nationstar Mortgage LLC who is a debt collector 1692a ( 6 ) who was attempting to collect an alleged debt that is for personal, family and household purpose 1692a ( 5 ). The consumer transaction had been timely rescinded pursuant to 15 USC 1635. I am a consumer under 1692a ( 3 ) and the creditor under 1692a ( 4 ). Nationstar Mortgage LLC knew or should have known what it was doing was illegal bringing a debt collection action into a creditor related non-judicial state court action in violation of the FDCPA 1692i. Nationstar Mortgage LLC through counsel did place my private and personal contracts into the public in violation of privacy laws causing further harm to me. For these reasons stated above I am placing a complaint against Nationstar Mortgage LCC based on their conduct and behavior with the Consumer Financial Protection Bureau.
