I have maintained constant communication with NationStar and continue to advise NationStar that my home is occupied, so NationStar well knows that I continue live in my property. These frequent inspections consist of a door tag with NationStar 's contact number. Additionally NationStar has applied additional home inspection fees of {$640.00} and legal fees of {$2000.00} to my account with out justification. NationStar continues to violate California 's Home Owners Bill of Rights by adding unexplained fees to my Veterans Affairs mortgage loan.

Consumer Complaint: XX/XX/2015 I applied for and was granted a modification of my Mortgage with my lender Nation Star Mortgage. XX/XX/2015 I started my 3 trail Payments of {$880.00} for the three months of XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX, all of which were paid ahead of the scheduled time for the payments to be made. On XXXX XXXX 2015 ( I believe to be the accurate date ) I received notification that all of the trail payments were successfully applied and that my new modification payments of {$820.00} would start on the XX/XX/XXXX, I then made XX/XX/XXXX payment in advance and sent it in by XXXX XXXX to be applied for XX/XX/XXXX 's payment. However on XXXX XXXX I received notice that XX/XX/XXXX 's payment had not been made I immediately contacted Nation Stars customer service center to find out why they had not processed my XX/XX/XXXX payment. The response I got back was that we did not successfully complete the trail payment program to which I promptly stated that this was not accurate and produced the documentation to prove it. Nation star then informed me that they would begin an investigation and would contact me within 5 -10 business days with their findings, which they never return my repeated calls to them after the time limit for them to respond had expired. At that point I began to put the Mortgage Payments into escrow and informed them that I needed to know whether or not to send the payments to which they responded no because they would be placed in a hold until they completed their investigation. On XXXX XXXX I contacted Nation Star Mortgage again and inquired of them as to when there investigation would be done the receptionist on the line stated to me that there had not been and investigation initiated to which I responded that it should have begun XX/XX/XXXX and she stated again that there was no such investigation initiated. I the asked her to find out what happen and she said that after looking at the notes on her screen that there appears to be and inquiry of when you called and asked for the investigation by nothing was ever put in, to which she then stated that she would put the paperwork in. On XXXX XXXX I received an act XXXX stating that Nation Star Mortgage was initiating fore closer proceeding against me. I then went to see the people at American credit counseling agency and they informed me to file this compliant with you. I am hopeful that you can offer some assistance I currently still have in escrow three payments of {$820.00} totaling {$2400.00} and will continue to place my mortgage payments into this escrow.

Consumer Complaint: In XXXX of XXXX my husband and I obtained a Reverse Mortgage ( a lump sum distribution ) from XXXX Mortgage. Every month thereafter I have sent a check for the interest and the Mortgage Insurance Premium that accrues on our loan balance. In XXXX of XXXX I had to complain long and hard to get Generation Mtg to send us a " correct '' XXXX IRS form. It is too long of an explanation to include here, but the issue ( and other accounting issues ) with XXXX Mtg were finally resolved after I filed a formal complaint with the Consumer Financial Protection Bureau, XXXX, and XXXX Oregon. The XXXX for XXXX was finally issued correctly and we filed our income taxes accordingly. Our XXXX XXXX was issued by XXXX XXXX, and those issues have also been resolved. In XXXX, we made payments to XXXX XXXX for the months of XXXX, XXXX, XXXX, and XXXX. On XXXX XXXX, XXXX we received a " notice of assignment, sale, or transfer of servicing rights '' from XXXX XXXX introducing Champion Mortgage Company as the new servicer of our reverse mortgage. The Legal disclosure states Nationstar Mortgage LLC d/b/a Champion Mortgage Company. We continued to make monthly payments to Champion Mtg for the months of XXXX through XXXX of XXXX. On XXXX XXXX, XXXX we received the XXXX XXXX form for XXXX from XXXX Mtg with the CORRECT amounts entered in box XXXX ( mortgage interest ) of {$2500.00} and in box XXXX ( MIP ) {$1900.00}. In XXXX of XXXX, I started asking Champion Mtg when we might expect to see our XXXX for XXXX. On XXXX XXXX, XXXX I finally received the XXXX for XXXX from Champion Mtg. The amount entered in box XXXX ( interest ) and the amount entered in box XXXX XXXX MIP ) are XXXX INCORRECT. I have repeatedly asked ( on the phone ) and in emails, during at least XXXX or XXXX conversations, starting on XXXX XXXX, continuing through XXXX XXXX, for a corrected issue of my XXXX form. I have spoken to a " supervisor '' by the name of XXXX XXXX, and to a " Vice President '' by the name of XXXX XXXX. Both assured me that they " were working on it ''. I have supplied all the documentation that was requested. A quote from an email from XXXX XXXX reads " ... ..you should be able to ( file ) since we feel the figures are correct as well, and then the corrected XXXX will follow. " To date, NOTHING has been " corrected ''. It is so frustrating and time consuming to have to pursue XXXX simple document from a mortgage lender just so I can properly complete my income taxes. I am in the process of preparing to file our income tax return for XXXX. My husband and I pay a very knowledgeable and experienced CPA to do our returns. We will be filling our returns using the numbers we personally have compiled for our XXXX XXXX XXXX form from Champion Mtg. Obviously these numbers will not match what Champion has already sent to the XXXX, and our CPA has " warned '' us we may receive an XXXX inquiry. I am hoping that by filing this complaint with the CFPB, we will see Champion Mtg comply with the law regarding the proper reporting of our XXXX information. I will be sending a copy of this complaint to the Oregon XXXX ( formerly known as the XXXX Oregon ) and filing a complaint with their office as well. Consumer Complaint: We believe Nationstar is violating the Fair Credit Reporting Act. ( FCRA ). Nationstar, a mortgage servicing company, is inaccurately reporting mortgage payments and misapplying payments to an escrow account without notice to us and without our permission. I attach a statement from XXXX XXXX XXXX showing that we have timely paid electronically each monthly mortgage payment since XX/XX/XXXX until the present date. Rather than accurately reporting these timely payments, Nationstar is reporting that we are thirty days past due for the months of XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. Nationstar 's reporting is inaccurate and is adversely affecting our credit and our ability to obtain a mortgage for our new home in XXXX. We are selling our XXXX home in XX/XX/XXXX and when we applied for a mortgage for the XXXX home, we learned of Nationstar improperly and inaccurately reporting our monthly mortgage payments. Although it has promised to correct the credit reporting and remove all late fees assessed, Nationstar has not corrected the reporting and its violation of the FCRA is causing us severe financial and emotional damages. In XX/XX/XXXX, a Nationstar representative called our home and indicated that due to an increase in real estate taxes, our monthly mortgage payment in XX/XX/XXXX would need to increase from {$1200.00} to {$1400.00}. As requested, and as verified by the attached bank record, we increased my monthly payment. In XX/XX/XXXX, after we learned that Nationstar was reporting our mortgage payment in a delinquent status, we called Nationstar and learned it increased the escrow payment amount due in XX/XX/XXXX ( rather than XX/XX/XXXX ) and was assessing late fees and not crediting payments to the monthly mortgage amount, but was instead placing the payments in the escrow account. It did so without any written or oral notice to us. Nationstar then claimed that we were in arrears in the amount of {$1800.00} which we immediately paid on XX/XX/XXXX, even though no notice had been given to us regarding late fees, late charges, or an escrow payment increase beginning earlier than XX/XX/XXXX. Nationstar then researched the problem and told us orally that it would correct the credit reporting and remove all late charges. ( See attached email. That email indicates the waiver of the late fees, but does not admit the incorrect credit reporting and has not correctly given us credit for my monthly mortgage payments or apparently the appropriate increase paid into escrow ). Since we will be moving from our XXXX home in XX/XX/XXXX, and since the purchase of the XXXX home is on hold pending resolution of this credit reporting error, we have no choice but to rent storage for our home furnishings and rent temporary housing until Nationstar 's error is corrected. To enable you verify the authenticity of this complaint, We attach a photocopy of our licenses. We also attach the XXXX XXXX record and the XXXX XXXX, XXXX email from Nationstar. Consumer Complaint: During the process of applying for a loan modification I ask if I could make my payments and was told NO that it would mess up the underwriters figures. It took XXXX 1/2 months to receive the first denial answer ( which made me 4 months behind on my payments ). On the second application it took four months to receive a denial answer which made us 9 months behind, Nationstar Mortgage says for us to be re-instated it will take {$13000.00} which includes late monthly payments and legal fees. We did get a loan modification from Nationstar Mortgage XX/XX/XXXX and two months into XXXX I XXXX at work and was unable to work. This is when all this started, I sent Nationstar Mortgage letters from my Doctors stating my condition both the XXXX XXXX doctor and the XXXX Doctor stated I was unable to work. I was told by my loan specialist that the Underwriters did not even look at the letters because it did not fit into or with their guidelines. I told Nationstar Mortgage during the last modification that I had paid off both of my car loans and would be able to set it up with my bank to have an automatic withdrawal of {$750.00} or {$800.00} to be taken out for a house payment -- -but this was not good enough for Nationstars ' Underwriters '. I was also told that Nationstar Mortgage did their own underwriting and financing and did not receive any money from the Government in XXXX when the Federal Government bailed out a lot of banks, well I just so happen to have gotten a letter from Nationstar Mortgage in which it states and I quote '' you were evaluated for mortgage payment assistance based on the eligibility requirements of XXXX XXXX XXXX XXXX XXXX XXXX, the owner/guarantor/trustee of your mortgage loan. '' I talked to XXXX from Nationstar this afternoon and ask him ask the banking situation and he said he really did n't know anything about it, and this is a man that works in the lost prevention section. Also during the two times we tried to get a modification I would get e-mails saying that we needed to send in this or that document, some of which we sent in no less that four times. After sending in the documentation they requested we would get a letter stating that it would take them from15 to 30 days to add those documents to our application and that they would get back in touch with us within 30 days -- -which goes back to what I was saying about making payments. It ended up looking like a catch 22 situation, one of which I wish we could get out of. I just want to start making my payments again and be able to stay in my house.

Consumer Complaint: I have applied for XXXX modifications on my loan and I have not received a response back in writing for either request. I have spoken with a manger who could not understand how my payments have been applied to my account. He also spoke of a {$5.00} a day penalty late charge that I have never heard of. XXXX was to research my payment history as well as the type of loan that has been enforce since Nationstar Mortgage took over and call me on XXXX/XXXX/16. I have not heard anything back from the manger XXXX as of today XXXX/XXXX/16. I called this morning and was told by customer service that XXXX was not available. The representative asked me if she could give me his extension and transfer me to his line and I asked for XXXX last name. At that time she asked me to hold and proceeded to transfer me to XXXX XXXX who is my account repersentive. I have sent {$1000.00} for the past two months and ready to send another {$1000.00} without any satisfaction from this company. My balance has not moved since they bought my account from XXXX XXXX XXXX. They are the worst company I have ever dealt with.

Consumer Complaint: On XXXX. XXXX, XXXX, I emailed a letter, dated XXXX, XXXX, copy attached as Exh. XXXX, to XXXX XXXX XXXX, Dedicated Loan Specialist, Nationstar Mortgage , LLC ( " Nationstar '' ) ( XXXX, Ext. XXXX. Nationstar is the servicer for XXXX, which is the secured creditor whose loan is secured by a deed of trust lien on my rental property known as XXXX XXXX XXXX, XXXX, MD XXXX ( the " Property '' ). On XXXX XXXX, XXXX, the Bankruptcy Court issued an Order Granting me a Chapter XXXX Discharge of my debts ( Docket No. XXXX ) in Case No. XXXX, XXXX Bankruptcy Court for the District of XXXX, XXXX Division. Accordingly, I do not owe any amount to Nationstar. As stated in my XXXX XXXX, XXXX letter to Nationstar, although XXXX granted me a streamline modification, " it is clear that the terms of the streamline modification are unworkable and unrealistic. '' The monthly mortgage payment amount of {$3300.00}, which was computed by Nationstar based on a principal amount of {$600000.00} and amortized over a forty year term, clearly is unreasonably high. The {$600000.00} principal amount, in light of the {$260000.00} fair market value of the property which was agreed to by Fannie Mae in XXXX XXXX in my prior Chapter XXXX bankruptcy case, is completely unreasonable. Based on the property 's age of XXXX years and the conditions of the Property stated in the attached copy of XXXX XXXX XXXX XXXX 's Report, there is significant costly work which is needed to be performed to correct the serious issues with the conditions of the Property. Since my XXXX XXXX letter offer, I have decided that my XXXX XXXX XXXX property is pivotal to the financial health of my residential rental property business. If I were to be unable to reach a reasonable modification agreement with Fannie Mae, Nationstar 's client, I will have no choice but to file a Chapter XXXX proceeding. Accordingly, in an effort to preclude the need to go into a Chapter XXXX proceeding, I have decided to raise certain of the proposed terms of my XXXX XXXX loan modification proposal. The terms of my new loan modification proposal, which are set forth in the attached XXXX. XXXX, XXXX letter, are as follows : 1. The new current principal balance would be {$350000.00}, instead of {$260000.00}, as stated in my XXXX XXXX letter. 2. The term of the loan would remain at 30 years. 3. The annual interest rate would remain fixed at.4.5 %. 4. The monthly principal and interest payment would be {$1700.00} with the first monthly payment to be made on XXXX XXXX, XXXX. 5. The new monthly mortgage loan payment shall be comprised of the new monthly mortgage principal and interest payment of {$1700.00} and the appropriate monthly escrow amounts for real property taxes and for insurance. Consumer Complaint: Original Owner ( OO ) bought townhome in XXXX, naming XXXX as XXXX mortgagee. Loan was taken over by XXXX in XXXX. Owner of XXXX mortgage since XXXX XXXX = Bank of NY Mellon ( BANK ), Trustee under a XXXX XXXX XXXX. BANK first filed notice to foreclose on home ( on which no mortgage payments had been made since XXXX ) in XXXX XXXX. OO ( who also became delinquent on her association dues in XXXX XXXX ) vacated home in XXXX XXXX. BANK filed a second notice to foreclose in XXXX XXXX, but again it never completed its foreclosure on this zombie home, delaying the sale date 8 times into XXXX. Our Homeowners Association ( HOA ) has records of notifying the bank at least ten times that this home had been vacated, and later that OO had won personal bankruptcy protection in XXXX. XXXX begged BANK many times to winterize home, but it refused, since squatters had moved into home in XXXX XXXX. Because of BANK 's failure to act, HOA foreclosed on this home in XXXX XXXX and paid to have squatters evicted later that year. HOA then fixed up the home that had become literally a " bunny '' sty. In XXXX XXXX agents of BANK broke into the home that HOA then owned without any warning to HOA. Severe damage was done to locks and doors by BANK 's agents. HOA then leased this home in XXXX XXXX for 18 months. BANK finally decided to foreclose on HOA 's home in XXXX XXXX. BANK sent notice to only HOA 's lessees, but never to HOA, despite the fact that HOA had been clearly recorded as the home 's owner. Throughout XXXX BANK ( through its third XXXX ' attorney ) willfully and in utmost bad faith ignored multiple requests from HOA 's attorney to negotiate a settlement with HOA. Without advising HOA, BANK auctioned off this home online in Fall XXXX. Successful bidder was a Flipping Company ( FC ). FC refused to pay HOA all that the BANK had cost HOA. Attorney for HOA tried again to negotiate with attorney for BANK ; but BANK refused to acknowledge any responsibility, claiming that the FC should be responsible. HOA 's attorney asked to see purchase agreement between BANK and FC, but BANK refused. In XXXX of XXXX, HOA reached modest settlement with FC, and later in the quarter released its association lien on the home. FC now owns the home, but HOA never reached any agreement with BANK. Since the BANK first refused to foreclose on this home in XXXX, the total NET losses ( after deducting lease income and amounts recovered under settlement agreement with FC ) that have been incurred by the members of our tiny, XXXX, townhouse community, solely because of the negligence of the BANK = {$21000.00}. These are only the special damages ; they include no general damages ( pain & suffering of volunteer HOA directors... who devoted more than XXXX unpaid hours to this problem ), nor any punitive damages, for the egregious and willful negligence of the BANK since XXXX.

Consumer Complaint: My income was drastically reduced. I have been trying to short sell the property. The bank has placed an unattainable value on the property of now {$110000.00}. Home has been on the market for 543 days. I can not get an offer at the banks appraised value due to repairs needed. I have had offers in the XXXX range. Since most borrowers in this area are seeking VA, FHA financing, there are no offers being forwarded because the buyers can not make the necessary repairs to secure a mortgage and the mortgage brokers can not obtain a loan due to the necessary repairs. Therefore only cash investors are available to bid on the property. Obviously they will not pay the banks approved price. The bank incidated that they will not take the property back due to the open sewage permit with the county. Since no offer has been forthcoming, the bank has set a sale date of XXXX/XXXX/2016. Please ask them to reconsider their valuation. as no offer can be otained at the current bank approved price. They are forcing foreclosure on the property where this could be avoided.
