Consumer Complaint: Our complaint XXXX to the CFPB illicited an answer to our lawyer XXXX XXXX from the attorney of Nationstar, XXXX XXXX XXXX. This answer brought an other claimant to our Note, this time XXXX. It is as usual the same circular rhetoric not answering the question who is the REAL OWNER of our Note. It answers only the part of the servicing and their rights. Calling the number of XXXX, which they gave in the letter XXXX does not answer. Ask the question about your loan, they answer and forward you to a number which does not respond. As the Grantor/Beneficiary of the DOT, our question has been, who is the Holder-In-Due-Course of this alleged Note they are trying to foreclose on. The Lender on the DOT, which we the Grantor/Beneficiaries executed, did not declare a default. First of all, where is the Authority that Nationstar Mortgage LLC is the Servicer for XXXX? After all Nationstar Mortgage LLC, became the servicer XXXX XXXX, FIVE MONTHS after the last payment was submitted, as well as the assignment to XXXX was recorded XXXX XXXX, TWO YEARS later and again recorded to XXXX XXXX XXXX, FOUR YEARS later and they are the servicer? The fact that Nationstar Mortgage became the " Servicer? '' 5 months after payment was submitted makes them under 15 U.S.C 1692 a debt collector. After 90 days the Insurance which we the grantor/beneficiary paid for, satisfied the loan. Nationstar bought the loan as debt collector and is trying to collect a debt due to others. There is no authority from XXXX. Facts which Nationstar has used in correspondence, court arguments and it the CFPB, why they have a right to collect : # 1- XXXX XXXX is the Note Holder # 2- Nationstar Mortgage LLC is the Note Holder, evidence a Corporate Assignment by XXXX for value granting Nationstar the Note # 3- XXXX is the Note Holder in the letter dated XXXX XXXX, XXXX. NATIONSTAR MORTGAGE LLC needs to be investigated for fraudulent practices, including their lawyers.

Consumer Complaint: Duplicate mortgage payments were sent into Nationstar this month, rcvd XX/XX/XXXX and XX/XX/XXXX. Called on XX/XX/XXXX while second transfer was showing as still processing, Nationstar advised unable to stop/reject, would flag account & once received would be returned with 1-2 days ( next Monday ). No refund received, called back & was advised I needed to submit bank statement to rep 's e-mail showing the XXXX debits even though they could see the credits on their end & they would send out via XXXX. No refund rcvd, called them, was told sent on XX/XX/XXXX but no tracking #, told them XXXX has tracking # & I needed before business close, placed on hold for XXXX, I hung-up need to get back to work. They call and left msg they needed statement faced to them before they could send out. No one there can get their story straight! Credit vs check, e-mail vs fax, sent / not sent. By the time I get my refund the next payment wil be due & all my other bills will be delinquent! Either a bunch of idiots or liars, take your pick!

Consumer Complaint: Filed Chapter XXXX Bankruptcy back in 2011. Since then NationStar mortgage and XXXX XXXX have both reported the accounts closed. Both the first and second mortgage are kept open even with the bankruptcy. I have contacted all XXXX credit reporting agencies. One month it will be reported as closed, one month it will be reported as open, another month it does n't even show on my credit report. Seeing as all other credit accounts are closed and monthly payments are made on time, our score should continually gradually be going up, not down! I 'm tired of playing games with this. its unfortunate we had to file for Bankruptcy, but our credit is worse than ever with these companies!

Consumer Complaint: My home was foreclosed on Monday XXXX/XXXX/2016 because a Nationstar Mortgage employee did not turn in the one document requested on time and left work to go home. I submitted the one doc they requested before the time he stated it had to be turned in ( XXXX CST ). Within a few hours of Nationstar 's request, I sent in the document and he never sent it in to be approved. I was already told it was an approved short sale. I have these facts in writing from the Equator system that my agent was kind enough to show me. I have printed the entire situation out. Because this representative left early or decided not to check my file, I lost my home the next day.

Consumer Complaint: My loan has been messed up since XX/XX/XXXX and I have tried to resolve with my new mortgage broker who has not only tried to foreclosed on me but also was aware that at the transfer of the loan the originating principal balance was not correct. There was an error in the transfer of documents per Nationstar but they corrected it. Wrong, they simply were able to get my monthly dollar amount correct but not the past due they still stated I owed from the previous lender. The loan was not even correct when it transferred from XXXX which I have shown Nationstar and who refuses to acknowledge any of it. This company also, entered my home without my consent or knowledge, listing my home as a rental with the county assessors office which increased my property taxes. They listed themselves as the owners and me as a renter in my own home. Nationstar reported me to the credit bureau as deliquent even though they were aware of the error their company had generated and caused when I was told this would not happen. I had conversations with the company where they were suppose to correct the interest and principal payments since the late payments I had made were not my error and was told would be waived by them. I do have this recorded as well via phone conversations but again Nationstar has refused to acknowledge any of this. I even had to file bankruptcy to keep my home from being foreclosed on with them because they refused to work with me in any way. They dragged out my request for a modification for over 5 months while all along still trying to foreclose on me. My loan transferred to Nationstar in XX/XX/XXXX and XX/XX/XXXX I had already recieved foreclosure prevention letters from them when I had never even been late nor missed a payment with my previous lender. My credit was ruined once they reported me 60-90 days past due and its has been all downhill from there. My lines of credit were halted, and all revolving lines of credit was cancelled leaving me with no options and no way to get refinanced. This company has been the ruin to my credit score and all my open lines of credit that I worked for my entire life. The previous lender springleaf also placed lender insurance on my account XX/XX/XXXX when I had already had insurance since XX/XX/XXXX the same insurance carrier since I bought the home and never notified me of this until right before the transfer of the loan which of course I was disputing because I had been arguing with this company about the credits they kept placing on the account instead of applying it towards principal as I had requested. So the lender placed insurance they put on my account basically used up all of my credit which was over a XXXX that should of been placed on principal only originally. But they could n't seem to do this for some reason once my mortgage had transferred to their corp office in Indiana so I was calling in to have it corrected monthly but still never resolved it with XXXX then the account was transferred now leaving me with over 3 years of payments showing no principal hardly because of the issues all stemming back to XX/XX/XXXX lender placed insurance by springleaf. It has been a chain reaction and was only compounded 100 times more by nationstar who has not even attempted to resolve or even help in the matter.

Consumer Complaint: We have been trying to resolve the issue of an incorrect escrow account amount which Nationstar has not properly adjusted probably since they Aurora transferred the account over to Nationstar. As a result our payment is consistently in flux because the property taxes have not been properly calculated or a larger amount is calculated so we are charged overages and then added to the payment. In addition, force placed policy was added which is much higher than the insurance we had in place so that also increased our payment.. It has been most frustrating as every time we call we are routed to the XXXX. We tried to reach the assigned dedicated specialist however he has not been available and are routed to the XXXX. That is part of the overwhelming issue. Unfortunately, we fell behind as we are going through a severe hardship due to my wife 's health. We have been in contact with Nationstar to correct these issues but it appears the issue continues to be unresolved and ongoing. Just recently, when we were going to make a payment to avoid being so far behind, we were advised that there was an amount in suspense for approx {$1600.00}, and were asked if we could make the difference by end of XXXX for {$2100.00}. We advised that we would certainly try as we were expecting a check by month 's. The check however was delayed and made the payment in early XXXX via wire. The total monthly amount was not applied and it continues to be in suspense. When we checked the status of payment online, it was not showing. Early this month, it showed that the {$2100.00} payment made in XXXX was being made towards Administration Fees!! We emailed XXXX XXXX and called to ask what happened to the balance of {$1600.00}, and were told that it was in suspense. It appears there is a contradiction when they offer assistance, yet instead of posting the full payment which is why we made that payment of {$2100.00}, they are posting it towards admin fees thus allowing the account to show more delinquency and a reason to foreclose. We communicate with Nationstar also through their online system, but they keep replying that they are researching, but the issue does not get fully resolved. The property taxes are still showing a shortage. As we have told them, when we have fallen behind, we pay more than the actual payments yet they are not applied accordingly, more admin fees are charged, and the payments are escrowed, so how do we keep falling behind on the property taxes?? If there was a shortage, which we feel there was not, then with the extra amounts we are being charged should go towards the XXXX first! We feel that they are taking advantage of the situation to set a sale and charge more money. We are in earnest trying to save our home, but would like to have them properly research the escrow accounts so that we finally have an accurate payment. Another egregious act occurred this week, when a representative identified from XXXX trespassed onto our property knocked on the door under the guise of looking for a " disaster '', our young children were here and it was a very frightening situation. She did not offer an identification and she left the house quickly as I questioned her and she left taking pictures up and down the driveway. This seemed very odd so we looked up the company, and appears it is a subsidiary of Nationstar. We called Nationstar and asked if they were aware of XXXX, we were told they were a Notary company! Upon pressing them, the senior representative in the XXXX advised that per our contract they could do inspections to find out if owners are still occupying the property. XXXX is more than a Notary company and told the Nationstar representative that this was very deceptive practice and a violation, to which she replied that she was sorry and would advise the company. This was not sincere! Pls Help

Consumer Complaint: Nationstar Mortgage used my escrow account to pay property taxes which were not to be escrowed. The mortgage states I am to pay the property taxes out of pocket. Now, Nationstar Mortgage is raising my monthly payment to increase the amount of the escrow account. This increase is to happen for the next two years or I can pay {$1000.00} up front costs. I believe Nationstar Mortgage should reimburse my escrow account for their error and take the loss. If this would happen, my escrow account would be in the postive.

Consumer Complaint: My mortgage was sold to Nation Star by XXXX Mortgage. I was in the process of paying my mortgage off as the sale of my loan took place. The payoff was received by Nation Star on XXXX XXXX. Since then I have been trying to finalize the paperwork with Nation Star. According to Nation Star my name is not correct in their system. My husband 's is. I have been told twice that I need to fax a copy of my Social Security card to them in order for them to correct my name. I have declined to fax my Social Security card to them. I have been advised by a consumer agency not to do that, but I am willing to send my Driver 's License, the copy of the Deed from the Courthouse, bills, etc to prove the spelling of my name. Today, XXXX XXXX, 2016, I asked them to look at the records that they have, including the Security Deed, to see if my name was correct on the paperwork associated with the loan, and use that as verification of the correct spelling. While on the phone with Nation Star representative today, she told me that is was Nation Star 's policy to hold onto a lien as long as possible, that she did not have a copy of the Security deed and that I would have to send a copy of my Social Security card to have my name corrected. XXXX Mortgage had my loan for several years before selling to Nation Star and I never had a problem with my name being spelled incorrectly. I want the deed to be sent to XXXX XXXX courthouse, with my name spelled correctly so I can be done with this institution once and for all. I am also concerned with the fact that their recordings and statements that they read off states that they are a " debt collector and that the information collected during the recorded phone call will be used to collect a debt. '' I thought XXXX Mortgage sold my loan to another mortgage company, not a debt collection agency. The sheer amount of complaints about Nation Star Mortgage 's less than ethical behavior concerns me and should be an indicator that there are major issues in their business practices. Thank you.

Consumer Complaint: To whom it may concern : I had a loan with Nationstar Mortgage since 2010 I was selling my home and I missed 2 payments and had set up a repayment plan and paid the first of 3 installments. I had an offer on the house as it was for sale and talked frequently with Nationstar as we got closer to closing and even though I missed payment 2 of the payment plan I told them the closing date was just 15 days after the payment was due. Then XXXX XXXX from XXXX called to get payoff and all documents needed for closing, the day after that happened Nationstar all of the sudden put {$4700.00} in legal fees 5 days before closing after I had been in constant contact with them. No one from Nationstar or the Attorney themselves can justify what was done for the {$4700.00} XXXX also looked up my home and there was nothing started or posted about a foreclosure on my home. I have paid off this loan and am disputing with Nationstar about the fees but they are giving me the run around and are not providing any documentation as to what the fees went to. I admit I was behind but i was very open and honest with Nationstar and told them this was a done deal with the sale of the house and the way they conducted themselves and put the fees on right before closing was very questionable.

Consumer Complaint: I have applied for a refinance of my current loan with Nationstar for my sole and primary residence, so that I could have a cash out to pay the second loan I have on the property, a HELOC that I want to pay off due to increasing high interests. In XXXX 2016 I started the process and is now SIX months of constant petition for more documentation and unjustifiable delays on their behalf. I have submitted every single document they have requested ( three times! ), they have done the appraisal ( twice! ), and always at the last minute there is some new item, some new regulation, some new thing that they get hang up on and stalls the process. Last time was an error in their system claiming I had been delayed on my payments- which I proved them wrong. This time they claim my Debt to Income ratio is to high because of some credit card debt I have. I told them that if I paid off this credit card debt, then it should not be a problem with that Ratio and the loan should go through, but apparently they want to close the file and do n't want to give me more explanations or a reasoning on how they are arriving to that ratio. This is after 6 months of trying to move this along. Meanwhile, the interest rate of my second loan keeps creeping up. Time is of the essence and they know it and they are wasting my time and efforts. Seems like a very arbitrary system is being laid over and an 'underwriter ' is always coming up with last minute requests.
