Consumer Complaint: AUTOMATIC STAY LIFTED BY FRAUD They violated the " NOTE '' XXXX and committed a felony by perjury in the Bankruptcy Court in XXXX CA. XXXX - Contact with the mortgagor. XXXX Contact with the mortgagor. XXXX The mortgagee must have a face-to-face interview with the mortgagor, or make a reasonable effort to arrange such a meeting, before three full monthly installments due on the mortgage are unpaid. If default occurs in a repayment plan arranged other than during a personal interview, the mortgagee must have a face-to-face meeting with the mortgagor, or make a reasonable attempt to arrange such a meeting within 30 days after such default and at least 30 days before foreclosure is commenced. ( 2 ) The mortgagee must also : ( i ) Inform the mortgagor that HUD will make information regarding the status and payment history of the mortgagor 's loan available to local credit bureaus and prospective creditors ; ( ii ) Inform the mortgagor of other available assistance, if any ; ( iii ) Inform the mortgagor of the names and addresses of HUD officials to whom further communications may be addressed. WHEN I CHANGED MY BK CH XXXX TO A CH XXXX NATIONSTAR FILED A MOTION TO HAVE THE AUTOMATIC STAY LIFTED ON THE GROUNDS OF ME BEING 10 PAYMENTS BEHIND. I am looking to prosecute for the intentional, deliberate and misleading behavior. They should by no means get away with this. At the time of this violation I did everything required. They always claimed that I never submitted all required document. I have proof to show different. I have submitted complaints and not one time was directly answered.

Consumer Complaint: My main concern is that Nationstar Mortgage is not my creditor nor the holder of my mortgage. Nationstar Mortgage is filing forged documents with my Recorder of Deeds ( Mortgage Assignment ). The assignment has been proven fraud and to make more insult of this situation, they have charged my alleged mortgage account for the filing and completing of the charges to file the forged assignment. The entire mortgage from inception was a sham and we just recently received information from the XXXX settlement that state that there is no way that the loan was originated with XXXX XXXX XXXX XXXX. I have provided this proof to Nationstar Mortgage and yet they continue to send me billing statements claiming that I owe a mortgage to them by way of assignment from XXXX XXXX XXXX XXXX. They even threatened foreclosure on my home without any right to collect but the evidence that I provided the court made Nationstar Mortgage mark that case settled, discontinued and ended without prejudice, so that they can now go back and create more fraudulent documents to probably start again. This company is violating debt collection rights and other offenses. I asked this company to provide my original paperwork and they even forged that information ; on their forged original application it states that we are both white and I am XXXX and my husband is XXXX. I am submitting a copy of all forgeries for your review. This company has also offered me an illegal payment plan including a new mortgage agreement which they would not be entitled to payment for. I asked for a copy of their business records and even in the records are transactions that say advise to call XXXX to create a mortgage assignment. The records also include a line saying that they are aware that the title is corrupted and that the assignments are fraud. I asked them to provide an original copy of the note and mortgage and both were forged and the mortgage even shows a different return to address, different signatures and initials. They were even so sloppy that they put part of the notary seal on opposite sides ( compare the mortgage fake document to the mortgage recorded mortgage to see the forgery ).

Consumer Complaint: The issue evolves as follows, We obtained our mortgage through XXXX , XXXX XXXX XXXX XXXX XXXX in XX/XX/XXXX. The mortgage was fixed of 30 years of {$190000.00}. Later down the road, XXXX, XXXX XXXX XXXX XXXX XXXX passed on my loan or maybe it was bought by XXXX XXXX XXXX, XXXX. Well, in XX/XX/XXXX I lost my job and I was behind on payments from between 8-10 months. Then my house was in foreclosure because of my passed payments. I had in mind to file bankruptcy but I did n't. At that time in XX/XX/XXXX I decided to do a modification on my mortgage with XXXX. I requested to lower my interest from 7.25 % to 5.00 %. Also lower my payment from {$1700.00} a month to {$1100.00} a month. XXXX accepted my request instead of selling the house of course. I was happy because I was able to keep my house. Well, during the transaction they had told me that the overdue payments were just going to stack up on top of my debt. The problem was that they did not tell me how much that amount was. I just assumed that the monthly payments that I had missed were going to add up. XXXX had told me that if I made the monthly payments on time for a whole year they would just dismiss that extra amount. That was the deal when doing the modification. So I accepted because I thought it was a good deal. So I made all my payments on time. In about a year later, XXXX had passed my loan or the company was bought by Nation Star Mortgage. When that happened, Nation star sent me a statement of my mortgage saying that I owed a balance of {$63000.00} on top of my mortgage. I was shocked, I had no idea where that balance was coming from. When I put two and two together I came to the conclusion that it was that " past due amount '' that XXXX had told me that it was going to be forgiven if I made my payments on time for a full year. I never knew how much that amount was until I received that statement that Nation Star sent me. I called Nation Star and I talked to a representative and I explained the situation. The rep had told me that in about another year it was going to pretty much disappear ( the past due amount ). The year passed and I called again to see what was process looking like, and that time they had told me that no, that now that " past due amount '' was going to be forgiven in about five years. I was very upset because I was told one thing and now it was another. When I asked for the lady that had helped me initially, they said that that rep did not work there anymore. A couple of months later I called to see what I could do to figure this problem out. Well this time they told me that the " past amount '' was not going to go away. I was very angry at that point because I felt like they were just stalling me to tell me. They pretty much lied to me. They defrauded me completely. All I ever wanted was to have that " past due amount '' forgiven and removed because thats what they had told me initially. I never missed a payment after the modification. Ive been loyal and what makes me even more upset is that they are trying to charge me more that what the house is actually worth.

Well since then Nationstar has reported it FORECLOSURE paid, and reported a 120 day late payment in XXXX and another one this year XXXX!!! This account has been closed and paid since XXXX and they are affecting my new VA loan right now because they are reporting seriously inaccurate information. They are in violation of the FCRA. I have disputed it and they have not fixed it and they continue to do new updates.

Consumer Complaint: My name is XXXX XXXX, I am the widow of XXXX XXXX and the executor of his estate and legal heir to this property as ruled in the state court of Montana. I am embroiled in a conflict with my mortgage servicer Nationstar, who has obstructed my attempts at modification and resolution of my loan by continually questioning my rights as the legal heir and forcing me to provide the same documents over and over again. As a result of these games that Nationstar is playing, my home went up for a foreclosure sale. I am a widow living on fixed income and taking care of my XXXX year old son. This is not right!! My husband and I purchased this home 9 years ago. He was the breadwinner while I stayed home to take care of my XXXX son. My husband ( the listed borrower XXXX XXXX ) passed away in 2012. I was named the executor of the estate and the rightful heir and have all of the necessary court documentation to prove this. I assumed the mortgage and continued making the mortgage payment as agreed for nearly two more years. However, as a widowed mother on fixed income I did not have any type of safety net and when I had a major plumbing emergency due to the main water valve pipe breaking I was in big trouble. I had to take care of this and the out of pocket costs were nearly {$3500.00}. Due to this emergency I started sinking financially and eventually missed my mortgage payment and desperately tried to figure a way out of my financial hole. I contacted Nationstar but they were not helpful at all. I was not even aware that there were programs available to help homeowners until I saw a commercial on TV about the Obama HAMP program. After learning of this program I contacted Nationstar again, and NOW their agents admitted there were options for help. I sent all of my information in for review and tried repeatedly to follow up and get updates. However, at every step of the way Nationstar obstructed the process -- I was continually grilled about the ownership of the home, about the survivorship and executor of the estate paperwork etc. I sent these papers in at least 4 different times but Nationstar seemed to lose the papers every time. I was never able to get anywhere with Nationstar. Instead of working with me Nationstar tried to auction off the house.

Consumer Complaint: My original home loan was with XXXX made in 2006. XXXX did not charge me a fee for making my mortgage payments online. Several years back XXXX XXXX XXXX sold my loan to Nationstar Mortgage, who charges me a fee of {$9.00} each month for paying online. My loan was sold to Nationstar Mortgage unbeknownst to me and I never signed any paperwork agreeing that I would pay a fee to make payments online. I 've spoken to several representatives with Nationstar who will not waive the fee. I received a mortgage loan from one financial institution who did not charge me a fee for making payments online and through no fault of my own ended up with another financial institution that charges for paying online. It 's not fair to me the consumer.

Consumer Complaint: I received my statement from NationStar Mortgage. After applying my payments catching up my payments, even though none were late, NationStar charge me {$89.00} in late fees on my statement. On the statement stated late fee is {$36.00}. I have no idea what this figure is. I doubt they do either. I have no idea how many late fees they have tacked on to my account, but this is ridiculous. NationStar also applied extra interest on my account when they misapplied the Loan Modification by waiting until a full payment paid, putting funds in unapplied funds instead of payments or principle ( see adj. Forbearance suspense where they fianally applied {$140.00} - that used to be {$180.00} plus change to principal ). They have been ripping me off left and right, extending the mortgage as long as possible.

Consumer Complaint: In XXXX I got XXXX loans from Aurora which meant I did not have to make a down payment. The first loan was at the current rate, and the second loan was at 12 %. In XXXX when the crash hit my business, I got behind on my first and second loans. When Aurora said I could apply for a modification, I asked if that would be for the first and the second. They said, " Let 's get the first modified, and then we 'll work on the second. '' So after modifying the first, I called to ask about the second, and was told that the first had been sold to Nationstar, and that the second was being " serviced '' by XXXX XXXX XXXX, with whom I 've tried to modify since XXXX. I had to file bankruptcy, and after several years, was finally in a position this summer to offer the original amount of my balance ( XXXX ) to Aurora, which I did in XXXX. They responded that they will only settle for the original balance plus interest and penalties, amounting to another XXXX, ( so XXXX total ) ... or I can make interest-free payments for 3 years and then return to the 12 % interest rate. I have repeatedly tried to call the number they gave me ( XXXX ) at which I only get recordings and can not leave a message. So today I found another number and left a message. Surprisingly, someone named XXXX XXXX called me back! When he could n't answer any of my questions, I asked who I could talk to about the fact that Aurora promised me a modification on the second, and instead is penalizing me for believing them! He told me he ca n't talk to me other than to say I can submit another offer higher than my XXXX offer, which is impossible! I absolutely made the best offer I could. So I asked to speak to an Aurora investor, or XXXX 's supervisor. XXXX put me on a " brief '' hold ( which is code for " maybe she will hang up if I take long enough '' ) ... and I waited and waited, for over 10 minutes. Finally he returned to the line and said his supervisor is in a meeting ( that only takes 2 minutes to find out! ), so I asked when I could talk to the supervisor. He then started to explain what a meeting was, and why I could n't talk to the supervisor now!!! I told him I want to know how/when I can speak to someone else, and he told me he has to hang up. THIS IS HOW THEY TREAT THEIR CUSTOMERS! They make it impossible to reach them, and when I do, the person I talk to has no authority, nor even any business acumen, and was actually rude! ( With latest political revelations about how some people view women, I 'm now wondering if I was dismissed because I 'm a woman, and an old XXXX at that ). I thought the law had changed, and these mortgagors are REQUIRED to provide access in person with a decision-maker or at least someone who 's not a robot! My desired solution is to settle with Aurora for {$50000.00} ( since now I do n't have XXXX as I did when I made the offer earlier this summer ) or to receive a modification of my original loan of {$110000.00} at a reasonable interest rate, and not to be charged for penalties and interest for my delinquency while waiting to see how they were going to " help '' me resolve things. I also want an apology for being dismissed and hung up on.

This has happened 4 times in the last 6 months. This requires me to login into my account twice each month ( once to pay and once to verify the payment was applied correctly ). It is an enormous waste of my time to have to verify they are doing their job correctly.
