'' ~**** 923. 18 U.S.C. 371Conspiracy to Defraud the United States The general conspiracy statute, 18 U.S.C. 371, creates an offense " [ i ] f two or more persons conspire either to commit any offense against the United States, or to defraud the United States, or any agency thereof in any manner or for any purpose. My loan was modified under HAMP in XX/XX/XXXX. I did not miss any payment. On XX/XX/XXXX, XXXX XXXX XXXX., now XXXX XXXX. , has removed XXXX dollars from the XXXX dollars PMI and still collecting even after XX/XX/XXXXwhere my LTV was 71 %. Now I am at 66 % LTV. Consumer Complaint: Again Mr. Cooper has scheduled a foreclosure sale on my house for XX/XX/XXXX. Mr. Cooper is a registered mark service for Nationstar Mortgage still operating it's business as Nationstar Mortgage. Severally in the past Mr. Cooper asked me to submit same documents over and over again which were immediately submitted but were not utillised for the purpose intended that is to modify my HAMP Loan modification I applied for in XXXX. Instead Mr. Cooper engaged in telling lies, made false statements, gave deceptive information and bogus figures that could not be substantiated. Also, Mr. Cooper tried very hard to steer me away from the HAMP Loan Modification I applied for in XXXX. Mr. Cooper never conscientiously try to help me modify my loan so that I could stay in my house. Instead Mr. cooper engaged in looking for any rabbit hole it could find all in an effort to justify itself why it could not modify my loan. Is even more so now not giving me any justifiable reason or reasons why my house is scheduled for foreclosure sale on XX/XX/XXXX. It is obvious that Mr. Cooper 's goal is to sweep my HAMP Loan modification I applied for XXXX under the rug. Mr. cooper can not unilaterally resolve my HAMP Loan Modification because The HAMP Modification Program guidelines specifically stated to resolve a loan under the Program it has to be bilaterally resolved and not unilaterally resolve. To do so is a violation of the HAMP Loan Modification Program guidelines. Also, Mr Cooper again is violating the Virginia Bankruptcy Law by repeatedly touting me with a voluntary payment in the amount of {$460000.00} which is illegal. I filed for bankruptcy in XXXX and my wife filed for bankruptcy in XXXX and both were discharged. XXXX XXXX XXXX XXXX in it's letters six of them, context the same that I received on XX/XX/XXXX said please find enclosed advertisement as published in XXXX XXXX XXXX. In all six foreclosure sale letters I received I could not find any advertisement as claimed by the Trustees, a false claim.

Consumer Complaint: Dear Sir or Madam, I paid in full my first deed of trust loan with Mr. Cooper ( Nationstar Mortgage ) on or about XX/XX/2018 via wire transfer. The Mr. Cooper loan number was XXXX. This deed of trust was recorded against my property located at XXXX XXXX XXXX, XXXX. XXXX, XXXX XXXX XXXX, CA XXXX. Even though ( 1 ) Mr. Cooper unilaterally required me to wire transfer the final pay-off funds at an additional cost to me of {$40.00} as charged by XXXX XXXX XXXX, XXXX, and ( 2 ) pursuant to the terms of my promissory note and deed of trust, there was no requirement obligating me to wire the final payment, Mr. Cooper has failed to provide me with the original of my promissory note as required by law and as formally requested by me via telephone calls on no less than four separate occasions including a conversation with Ms. XXXX of Mr. Cooper on XX/XX/2018 at XXXX XXXX PST. Each time I have expressly requested the return of my original promissory note and I have been assured by the Mr. Cooper customer service representative that the " promissory note is in the mail ''. As Mr. Cooper continues to deceive me by telling me that the promissory note has been sent, it is clear that they have no intention of returning the promissory note to me as required by law and I am quite concerned that they may attempt to sell the note or to claim that it has not been paid off. As a result, I am requesting the assistance of the CFPB to require Mr. Cooper to return the original of my promissory note as required by law since Mr. Cooper continues to deceive and abuse its borrowers.

Mr. and or Ms . I hold two in my hand from Nations Star! You people attempt to cover your errors like small children. A previous CSR read to me the notes on the account that the representative did not try and force us to except the modification, then stated we did not and the modification was closed. Consumer Complaint: In XXXX, XXXX, a conference call was arranged and made including the North Carolina Office of the Commissioner of Banks, Nationstar Mortgage Company ( d/b/a Mr. Cooper ) and myself. This call was to resolve the issue of removing all fees and charges to my mortgage account from XXXX thru XXXX, which I had been repeatedly told would all be removed by various Nationstar personnel during hundreds of documented calls with Nationstar during that time period due to the fact that Nationstar had received and cashed a payment every month. During the call, it was requested that all fees and charges be removed from my account, that monies refunded to me in previous years would be allowed to be returned to Nationstar, that Nationstar would apply such monies to principal, escrow and interest and that Nationstar would have the account brought to current and good standing with only a current payment of {$610.00} being owed monthly. At the time of the call, the mortgage loan statement dated XX/XX/XXXX showed the principal balance as {$52000.00} and listed the total amount due as of XX/XX/XXXX {$2100.00}. The breakdown of the total amount due was : Regular monthly payment {$610.00} Total fees & charges {$330.00} Overdue payment ( s ) {$1200.00} Partial payment ( unapplied ) ( {$43.00} ) Total amount due {$2100.00} During this conference call, it was agreed upon that the Nationstar customer relations rep would get approval to remove the fees and charges, in which she stated totaled {$330.00}, from her supervisors and inform the representative from the NC Office of the Commissioner of Banks. The NC Office of the Commissioner of Banks would then contact me if the agreement was to be honored by Nationstar Mortgage and I was to mail in the agreed upon monies consisting of returning the monies previously refunded to me by Nationstar of {$990.00}, the current monthly payment of {$610.00} and the agreed upon amount of {$170.00} to bring the accounts principal to {$51000.00} and the account to good and current standing with no past due amounts. Immediately after receiving an email from the NC Office of the Commissioner of Banks that Nationstar had agreed to our agreement, I then mailed the agreed upon monies. This was done by in three checks dated XX/XX/XXXX and cashed by Nationstar Mortgage on XX/XX/XXXX. The mortgage loan statement dated XX/XX/XXXX showed the principal balance as {$51000.00} ( which agrees with the original loan amortization ) and listed the total amount due as of XX/XX/XXXX as {$610.00}, a current monthly payment with no other fees, charges, or past due amounts listed in the total amount due. I then chose to mail with the current monthly payment additional principal in the amount of {$170.00}, making the total check dated XX/XX/XXXX {$790.00}. This check was cashed by Nationstar on XX/XX/XXXX. Nationstar then blatantly, knowingly and dishonestly defied our agreement. Instead of applying the additional principal as paid, Nationstar added charges to the accounts activity that was not previously added to the total amount due in the exact amount of {$170.00}. I called the Nationstar rep and she informed me these charges were not specially asked to be included in the agreement. I questioned why they were not included in the total fees and charges and was informed that they had been disclosed at some point in a letter. These additional fees and charges total {$460.00} and I was informed by Nationstar that they will not waive these per our agreement with the NC Office of the Commissioner of Banks because it was not specially requested during the call. However, during the time of the call, the Nationstar rep knew that all charges and fees were being requested to be removed and knew that these additional amounts were not included in the total amounts listed on the statement. This is why she was conniving and used deceptive and dishonest practices when she stated the actual amount of {$330.00} that she would ask her supervisors to be waived, which was the amount listed in the total amount due on the statement. Nationstar therefore knowingly deceived me and the NC Office of the Commissioner of Banks. These additional fees and charges, which still have a balance of {$280.00} from the total of {$460.00}, have not been added to the accounts total amount due on the monthly loan statement dated XX/XX/XXXX which shows the principal balance as {$51000.00} and lists the total amount due as of XX/XX/XXXX as {$610.00}, a current monthly payment with no other fees, charges, or past due amounts listed in the total amount due.

Issue: Problem with a credit reporting company's investigation into an existing problem

Consumer Complaint: I have been dealing with errors that intentionally continue being falsely reported by Nationstar/XXXX regarding my VA mortgage loan that has stated over 18 months ago. Yet, more intentional discrepancies continue with even Nationstar stating that FEMA has filed incorrect information with regards to A Natural Distaster being reported, FICO points once again being taken from my credit reporting scores. This has been going on for over 18 months, has caused serious stress for not just myself, but as well my wife. As of this past week. I am once again finding myself dealing with more intentional malicious reporting by Nationstar/XXXX, now using FEMA as the excuse per taped phone calls by Nationstar when I called into their customer service number. I have attempted to resolve this issue with the lastest manager, XXXX via email, phone, taped conversations between Mr. XXXX, myself and XXXX on a three way conference call. Mr. XXXX stated that XXXX is not being honest because they are going off of limited information, yet XXXX shows the same intentionally reporting incorrect information with regards to my VA mortgage loan over the past month. I have no other choice but to take my complaints further to resolve this serious matter and overwhelming stress this is causing me and my wife. Nationstar/XXXX also stated every time I have to seek a third party assistance with regards of serious attempts to have issues that have been going on over the past 18 months finally resolved with my VA mortgage loan ... A freeze is then put on my account. Retailation. That is also incorrect information as XXXX Credit Report file that is from XXXX over the past month-week shows that Nationstar/XXXX has someone once again intentionally going into their computer, making more intentional discrepancies with regards to my VA mortgage loan. I have attempted, now going on another week to have more issues resolved, working with Nationstar/XXXX on the phone, but told that XXXX is not accurate with their information. Yet Nationstar/XXXX are the only ones who can make changes within my credit reporting. Not FEMA as they blame for their errors I was also told on a taped phone call last week with Nationstar that FEMA made changes with my credit report by reporting a Natural Disaster that occurred within the past week. I am now going to bring in all parties so this can finally be resolved in a serious matter with regards to now additional intentional discrepancies made by Nationstar/XXXX. XXXX does stick by their word with regards to the changes are being made by Nationstar/XXXX and soley, Nationstar/XXXX per taped phone conversation. They are as well sending me my file, copy of my full report via mail. I have, once again, attempted to work with Nationstar/XXXX with regards of the errors and as well the tremendous amount of stress this is causing me and my wife, a XXXX fighter. Our email will be as well filed along with the credit reporting bureau reports. I am once again, asking that my VA mortgage loan be corrected with all three credit bureaus. I am once again asking that now my FICO score be reinstated due to intentional discrepancies being reported by Nationstar/XXXX. I will not stop until this finally gets resolved. If this is happening to myself, with Nationstar/XXXX. It is most definitely happening to many other consumers that have a loan with XXXX/Nationstar. I have made a complaint this afternoon with the Federal Trade Commission, the state of Indiana Attorney General 's Office and FEMA. ****Per the latest Nationstar representative, Manager, Mr. XXXX , I was told that Nationstar has not reported anything with any of the three credit bureaus since XX/XX/2018. How then can XXXX, XXXX and XXXX show otherwise with the Natural Disaster, FICO points being taken away and more intentional reporting? It shows last reporting by XXXX from Nationstar, incorrect information, FICO score points being taken falsely taken away as of XX/XX/2018? ****

Issue: Struggling to pay mortgage

Consumer Complaint: I am a United States XXXX XXXX veteran who is facing a foreclosure sale date on my home on XX/XX/XXXX. I bought my house with a VA loan backed by the government and I know that there are programs and plans put in place to help homeowners in my situation ( lost my job ) but my lender Nationstar has not engaged in a fair negotiation and has not given me access to these programs. I have put myself into a better financial situation and have tried to get Nationstar to take another look at review for these programs but they are telling me it is too late and they are foreclosing on my home. I wanted to contact your agency to file a formal complaint. At the time of the purchase I had a good paying job working for the railroad, and moved into the home with my wife XXXX and our XXXX daughters. I had been moonlighting as a XXXX XXXX to supplement my income but was completely shocked when I lost my job and main source of income from the XXXX. I immediately ramped up the XXXX business and reached out to Nationstar to try and resolve this matter. After months of back and forth with paperwork, I was approved for a repayment plan with a monthly obligation of {$2700.00}. My original mortgage payment was approximately {$1300.00}, so this was more than double. In my situation I simply could not afford a double payment. I tried to apply again for a modification ( since I was not reviewed for that the first time ) and was told I was denied due to lack of income. This confused me -- how could I be approved for a repayment plan with a payment of {$2700.00} which would require substantial income and then be denied when applying for a modification which would hopefully put my payment closer to where it was before ( {$1300.00} ). Obviously some type of error has been made on the Nationstar side. I have tried to resurrect my case with their agents but have run into brick walls and am now facing a foreclosure sale date. At this time my wife is working and I have slowly grown my XXXX XXXX business. I am also receiving a monthly VA retirement check and have a new job as well. Between all of these sources, we have the financial means to afford a fair and reasonable mortgage payment. However, Nationstar has refused to give me the opportunity for a new review.

Issue: Trouble during payment process

Consumer Complaint: This is a tale about Mr. Cooper, a mortgage company, and XXXX XXXX ( " XXXX '' ), an insurance company, and my investment property in CO that I have held since the XX/XX/XXXXs. It is an unbelievable story off corporate hubris, ridiculousness and a corporate attitude that says I can just kiss their ring. The house is worth maybe $ 300K. My mortgage is about $ 28K. There are no other liens on the property. The roof suffered hail damage last month, which is causing it to leak, and needs a new roof which is covered by my insurance policy from XXXX, which has been my insurer since the eighties. The current loan was acquired by me from XXXX XXXX a few years ago. Last year, it sold the loan to Mr. Cooper, a transaction I had no say about whatsoever. If I could fire Mr. Cooper, a terrible mortgage company, I would. I might change my insurer because they are complicit in this unnecessary ridiculousness. After filing a claim for the hail damage with XXXX, they inspected the property, issued an assessment report and sent me a check for {$6100.00} so I could hire a contractor to get the property repaired. I deposited the check in my checking account at XXXX XXXX at its ATM, as I do with all checks I receive. It issued me a deposit slip and then, apparently, a little while later debited the same amount back out of my account. I discovered this 2 days later when I examined my account statement online. The bank threw up its hands, told me my endorsed check was invalid because as issued, there was a co-endorsee on the check, Mr. Cooper. I would have to get the check re-issued by XXXX in CO, sent to me in VA, send it to OH to get it endorsed by Mr. Cooper, a corporate entity with a minuscule " vested interest '' in my property ( $ XXXX vested interest concerning a $ XXXX claim on property worth $ XXXX ), have it returned to me by them after this ridiculous and useless gratuitous act, and then I could endorse my check and deposit it so I could thereupon pay a contractor in CO to get the leaking roof repaired. XXXX confirmed this ridiculous rigamarole on the phone, which will take at least a week if not a month to complete by mail, as did Mr. Cooper after I spent a long time on their phone menu listening to canned music and recorded statements about how they were engaged in debt collection and any information I tendered to them could be used against me for this purpose unless I was in bankruptcy in which case, never mind. Their agent had the temerity to state that this byzantine procedure was necessary because of " fraud. '' I have no idea how Mr. Cooper thinks this is the process I should use to get my insurance money from a claim I filed with XXXX, or why XXXX should issue such a useless, time-consuming check unless this is a giant check-kiting scheme so XXXX can can collect interest on the {$6100.00} for an extra three or four weeks and maybe, I imagine, kick some of that " profit '' back to Mr. Cooper, while I jump through these hoops. Multiply my month-long delay in getting my money by 100,000 or a million claims and you're talking some serious money. Mr. Cooper and XXXX are engaged in unfair practices. ( I am going on vacation for 3 weeks, or maybe I should cancel my long-planned trip so I can receive a check, send it to Mr. Cooper in OH, wait for up to ten business days, they said, for them to " endorse '' it and send it back to me and then I can deposit it. This is totally unnecessary and unfair. )
