Consumer Complaint: In XX/XX/XXXX my mortgage from XXXX was sold to Nationstar Mortgage. In XX/XX/XXXX Nationstar Mortgage took an unauthorized payment from my escrow account for {$170.00}. Nationstar Mortgage was notified of the error that they made in XX/XX/XXXX, only to discover that they took another payment for {$170.00}. I was informed the payments were for Mortgage Insurance Premiums. I never paid this with XXXX. They have since stopped the payments. I have requested the money get refunded to my escrow account on numerous occasions, along with the lost interest, and a corrected form XXXX. As of today none of my requests have been done. Now I have received a notice from Nationstar Mortgage that my escrow will have a shortage of {$100.00}. I feel that this is wrong considering that if they never took the money out of my escrow, it would not be short. I have been on the phone for over 10 hours with many different departments and several supervisors. Is there any legal recourse for the money " stolen '' from my account, along with the stress of this whole situation?

Consumer Complaint: NATIONSTAR IS NOT FOLLOWING THE RESPA Uniform Settlement Statement ( HUD-1 OR HUD-1A ) - 12 CFR 1024.8 " Inadvertent or technical errors on the settlement statement are not deemed to be a violation of Section 4 of RESPA if a revised HUD-1/1A is provided to the borrower within 30 calendar days after settlement. '' Loan # XXXX was never given a corrected HUD statement and Nationstar knew this was never a legal loan long, long ago and used extortion in a racketeering scam. THE CONSUMER NEVER WOULD HAVE SIGNED THIS LOAN IF IT WAS DISCLOSED HONESTLY ... EVER!!! I got a rep and a supervisor at the Nationstar Corporate Office to confirmXXXX XXXX, XXXX, XXXX and XXXX all lied to intentionally mislead the CFPB and consumer. These reps confirmed, on a recorded line, thatloan origination fraud is illegal and they also confirmed that ALL documents need to be accurate and, if not, they need to bere-generated and re-signed. If this is not done, the loan is not valid. THE CONSUMER NEVER WOULD HAVE SIGNED THIS LOAN IF IT WAS DISCLOSED HONESTLY ... EVER!!! Yes ... Nationstar is claiming that The Federal Government is forcing them to commit these crimes. This is not a joke, this was stated by XXXX @ Nationstar last week, it 's on a recorded line just prior to him hanging up on me. That 's why they foreclose on homes they do n't own, lie to the consumer, andgenerate false statements ... it 's because you, the Federal Government, has ordered them to commit these crimes and terrorize consumers. They are the victims, XXXX Loan origination fraud is illegal, consumer fraud is illegal, mail fraud is illegal ... and Nationstar commits all of these acts daily. I have only found 3 honest people out of several dozen, but 2 were today, so voluntary compliance may have started. That would save all of us a lot of time and effort. Consumer Complaint: I am a new home owner. My mortgage is {$830.00}, I Paid my mortgage through XX/XX/2017 in by XX/XX/2017. I signed into my mortgage account online and made a payment for XX/XX/2017 mortgage on XX/XX/2017, it cleared XX/XX/2017 through my bank. I thought that I was good for XX/XX/2017. After the XX/XX/XXXX mortagege cleared, they configured XX/XX/2017 payment which is {$910.00} and pulled it on XX/XX/XXXX instead of XX/XX/XXXX. They justified it by saying that I gave them autopay permission. So They will take that XX/XX/2017 payment 30 days early. They cleaned out my checking account and stated that if the check doesnt clear they will be resubmitting for the {$910.00}. Are you kidding me? I am not a time traveler, I havent lived in XX/XX/2017 yet so the bill is not due. I asked them why dont they take XX/XX/XXXX through XX/XX/XXXX in XX/XX/XXXX too? I dont owe them any money but they insist that they will present XX/XX/2017 mortgage again for payment if the funds dont clear. These people are vampires! They are monsters and they dont have any respect for the american consumer. I am a new home owner and I have been thinking ahead to stay current. I have never been late. I am a normal person and they took {$910.00} from my account on XX/XX/XXXX that was not due for 4 weeks a week after I paid them {$830.00} that they were due. They insist that they are correct for taking that XX/XX/XXXX payment 4 weeks early because I gave them autopay rights. {$1700.00} in one week. My budget is destroyed. The mortgage sale will be complete on XX/XX/XXXX. It is now XX/XX/XXXX. Nationstar Mortgage LLC has NOT provided a service transferring notice as required by law. They are well known for making a disaster of people 's transfer paperwork, not paying insurance and property taxes out of escrow, and have horrible online reviews : unless you go to a site where they pay money to be 'verified ' ( i.e. - the site allows them to remove negative reviews ).

Consumer Complaint: I have an adjustable Rate Mortgage with Nationstar Mortgage , Inc. ( Loan # XXXX ) that will be changing in XX/XX/2017. I received a letter from Nationstar Mortgage, INC. telling me that my new rate would be 4.125 percent. Per our contract, 4 ( C ). Before each Change Date, the Note Holder will calculate my new interest rate by adding TWO & ONE-QUARTER percentage points ( 2.25 ) to the Current index. the Note Holder will then round the result of this addition to the nearest one-eighth of one percentage point ( 0.125 ). Subject to the limits stated in section 4 ( D ) below, this rounded amount will be my new interest rate until the next Change Date. I was told by three different customer reps that the Current Index that Nationstar used was 1.80. If my math is correct than 2.25 + 1.80 = 4.05. If 4.05 - 4.00 = .05 and 4.125 - 4.05 = .075, than 4.00 percent would have to be my new interest rate. I received a call from XXXX in there Research Department. I have called her back twice and emailed her and have received no response. This is a simple equation that a small child could figure out and they are just stalling. I 've never had a problem with them before when it came to a change.

Consumer Complaint: I applied for a refinance with my existing mortgage company. I asked for a loan of {$250000.00}. The representative XXXX reviewed information I provided and said he could do a loan for {$220000.00}. I said I did n't want a loan for that amount but the {$250000.00} so I could pay off debts and have a small cushion for home repairs. I told him I was planning to get a job and hoped to be starting soon. He said that we should start the process and when I started working he could re-evaluate the loan amount. Soon after I was transferred to another representative XXXX. I reiterated to her that I was seeking a loan for {$250000.00}. I have emails supporting these exchanges. I sent her more documents and when I started working I sent her evidence of the same. Finally I was told we were ready to do the final signing but she wanted to know how I would be paying my property taxes. I said she should just take them out of the new mortgage settlement. That 's when I discovered they approved a mortgage for {$220000.00} only. I was so angry. Nowhere along the way did they bring this up. None of the documents they sent me to initial or sign included the loan amount. They had plenty of opportunities to clarify this. They even misled me about employment. They now said they could n't consider my employment income until I had worked six months! They were playing me all along thinking I would just accept the final loan approval. I declined the loan after wasting so much of my time and money in sending faxes to them. This is deception in lending.

Consumer Complaint: My mortgage hit a 10 year anniversary that applied principle to a $ XXXX dollar loan that jumped my payments an additional {$3500.00} a month, now $ XXXX per month. In an effort to refi, my home has lost XXXX in value making impossible to refinance. I turned to Nationstar for a loan modification and was told that I was rejected not for be accepted to do the loan modification, they said the new loan would have a higher monthly payment. They will not disclose what the new loan would be or why they would not reduce the loan. If the original loan was re-applied, i could make the payments. We are doing everything in our power not to miss a payment, even draining our saving account. We are out of time. Nationstar will not work with me, the person that they assigned is just a document fetcher, no help at all. The call center just says, you where rejected and there is nothing they can do.

Consumer Complaint: Client has been repeatedly mistreated during efforts to modify loan, most recently was denied based upon his being divorced and a " successor in interest '' to the original party to the note, his ex-wife. Specifically, modification was denied on basis that property was not " owner occupied '' despite client 's ownership and occupancy, demonstrated to servicer countless times. Second, denial of application based on this " occupancy '' issue is in direct violation of the XX/XX/XXXX amendment to the XX/XX/XXXX mortgage rules under RESPA ( Regulation X ) and TILA ( Regulation Z ) found at 12 CFR 1024 and 1026, which rules were implemented to protect " successors in interest '' to mortgage and property ownership by virtue of divorce decree. Despite this status and the explicit provisions of the rules, client 's modification was denied based on his status as " non-borrower '' ( the so called " brick wall '' ), the repeated request for unnecessary and nonexistent documentation of home ownership and occupancy ( the " treadmill '' ), and have otherwise made the application for modification unnecessarily difficult. The same documentation was requested countless times. When the servicer 's employees would finally acknowledge receipt of a particular document, they would invent inadequacies and demand additional information which bore no relation to the client 's ability to pay the loan or any other relevant factor in evaluating this request. By way of example and not limitation, client is XXXX and submitted personal financial statement. Servicer then requested further documentation to explain the financial statement in detail which was simply designed to make client produce more paperwork, and did not provide any additional information. These requests for " clarification '' were repeated and abusive, and the ultimate denial of the modification was not based upon any of the information repeatedly provided and painstakingly supplemented, but upon the " borrower 's '' non-occupancy of the property in question. Servicer also claimed investor did not offer modification under the circumstances in question, a claim that was never validated or documented. In short, client was completely " run around '' in the process of attempting to modify his loan, and his application was improperly denied.

XXXX XXXX Consumer Complaint Refinanced with XXXX and when the signing docs arrived, the numbers were all different ... much higher fees and a 1/2 percentage point higher interest rate. called XXXX, was told the guy working my loan was fired and he made mistakes on my loan.
