Consumer Complaint: Nationstar purchased our mortgage from XXXX in XX/XX/XXXX or XX/XX/XXXX. The terms of the mortgage state that monthly payments will include the mortgage, home owner 's insurance and taxes. As per the terms of the mortgage, the mortgage company was responsible to pay taxes from our escrow account. In early XX/XX/XXXX, we became aware that our town tax ( The Town of XXXX XXXX ) was not paid by Nationstar. We contacted Nationstar to remedy this situation. On XX/XX/XXXX we received correspondence from Nationstar that they paid the town tax on our behalf. However, as of XX/XX/XXXX, no tax payment has been received by the town, despite many phone calls to Nationstar and many assurances that said taxes have been paid. XX/XX/XXXX marks the third late deadline and, as a result, the third round of penalties imposed by the town. My first request is that these taxes get paid. My second request is that my escrow account is reviewed by a third party to assess for any mishandling. Third, I want to be remedied for Nationstar 's failure to follow the terms of the mortgage they purchased by ensuring that the town penalties are absorbed by Nationstar and not us.

Consumer Complaint: Dear Consumer Relations : In Re : loan # XXXX I am writing to file a complaint with your agency in regard to my mortgage company ( Nationstar Mortgage ) proceeding to a scheduled sale of my property XX/XX/XXXX. I also like to state, I am at the end of the process of completing a Deed-in-Lieu ; and for Nationstar Mortgage to use this tactic to force foreclosure sale of my home would be detrimental. Furthermore, I have contacted Nationstar Mortgage several times to urge them to please cease the sale until they received the necessary Lien release/paid in full documents from HUD County. The mortgage company has release a payment of {$6000.00} to HUD county XX/XX/XXXX. XXXX ( HUD county ) stated it will take 30 to 60 days to forward the information over to XXXX ( Nationstar Mortgage ). I am at the very end of completion and to simply do n't allowed the time to received the documents is just ridiculous, this due process is called dual tracking and refers to the practice of a mortgage company running the foreclosure process at the same time of running the loan under Deed-in-Lieu process and this is a violation of the National Mortgage Settlement. Lastly, I have submitted my Hardship Affidavit XX/XX/XXXX, and the application to XXXX ( Collateral Liquidation Specialist ) who is working delinquently on my file. Consumer Complaint: I have been trying to sell my property as a short sale however the investor for my loan which Nationstar services insists can only be sold through a short sale auction. We have now done 3 short sale auctions. If rehabbed the home is worth about {$870000.00}. The home needs about {$150000.00} in major work per contractors who 've submitted offers previously. The 1st auction starting bid was {$860000.00} no bids. The 2nd auction the opening bid was {$610000.00} and the winning bidder won at {$750000.00} however they never inspected the property and once they did they cancelled. There were back up offers at {$610000.00} but per Nationstar the offer was too low for the investor. This most recent auction I thought we had a chance because the bidder was going to live in the home and seemed very interested. Their final bid was {$790000.00} but had not inspected the home. After inspecting it they also cancelled. I accepted an offer from an investor for {$650000.00} but it was denied from Nationstar. No investor will offer more and here 's why. {$650000.00} plus {$150000.00} = {$800000.00} plus {$50000.00} for closing costs and commissions means they 'd spend {$850000.00} to possible make $ XXXX-XXXX. I want to short sale the home and avoid foreclosure. But the process simply wo n't allow it. I know the balance is over $ XXXX but I did n't cause the problem. In XX/XX/2008 I had entered into a modification with XXXX bank and they accidentally foreclosed. When they rescinded the foreclosure they sold the loan to XXXX XXXX XXXX on the same day. XXXX XXXX XXXX would not honor the modification agreement and for years indicated that there was no loan record and therefore could not accept any payments. The loan sold shortly after they finally put together what was my balance and the same problem occurred with the next servicer. It finally transferred to Nationstar and if this loan was serviced by any other lender the short sale would 've already occurred and we could move on. But the conditions set forth by Nationstar and the investor are making the short sale an impossibility. I 'd like to buy a home again in the near future but a foreclosure or deed in lieu are simply poor options. Like I said any other servicer would simply go with the best and highest offer. The existing offer of {$65000.00} is more than generous especially considering the risk is high and the return is limited to non existing. I 'm going to seek legal advice and possible have to file a civil complaint against the investor and Nationstar simply because they are not considering real viable offers for a short sale. I should n't have to sue the bank simply to allow me to shortsale the property. I know that Nationstar will say we are doing what the investor is allowing but that simply means that I am not able to property sell the property due to the auction process and what the expectation from the investor in what will be a realistic price. Like I said every single bank and investor out there with the exception of these two are making a simply process impossible. I am the victim of fraud from XXXX and not being able to keep the home was due to errors on their part. By the time Nationstar offered me a modification of $ XXXX monthly payments I accepted and made those payments until I could n't afford that amount. I do n't know many people who can afford a {$4700.00} mortgage. The previous modification with XXXX was only {$3200.00} and even that was difficult but through the years the balance grew and I could n't do anything about it. The timing of this is horrible. I just want to sell the property and move on. Please help me convince them to be realistic about the short sale offers that are viable. Filing a law suit just to eventually mediate a short sale is a horrible way to resolve this.

XXXX ran our credit report and siad since our credit score was XXXX we didnt qualify for the " better '' loan which would bring our payment to $ XXXX.Since we had a credit score below XXXX best they could do was about $ XXXX.Current mortgage is {$1800.00} going to XXXX for the remaining 20 years of the term.He suggested we call the loan mod dept.Called loan mod on XX/XX/XXXX@XXXX .Spoke with XXXX who emailed me info needed for loan mod.Sent over the info back to XXXX on the XX/XX/2017 and he responded two days later saying he would be forwarding the info to the loan prosessors.we received a letter dated XX/XX/2017 on XX/XX/2017 asking us to Call XXXX letting us know he is our dedicated Loan specialist. The sooner you call, '' the SOONER YOU MIGHT FIND A SOLUTION TO YOUR MORTGAGE NEEDS '' Called left him a msg on Monday XX/XX/2017. He called home and then on my cell on the morning of XX/XX/2017. Could not talk too much because I was at work.Asked him to call after XXXX EST. He called the next morning and spoke to my wife. He informed her that we did not qualify for the loan mod because he did not see any hardship!!! No death, XXXX or loss of job .That is why we did not qualify. Mind you I had been out of work from mid XX/XX/XXXX till mid XX/XX/XXXX. Just got on a full shift two weeks ago ( still XXXX ). We had a similar problem when applying for a loan mod from the bank this company bought the loan from. Loan mod took over 1.5 years and finally fell through after all the running around. Same loan #. Consumer Complaint: Nationstar Mortgage LLC. is still attempting to foreclose on my home using falsified documents and refuses to respond to my complaints. I have filed complaints with CFPB, to which Nationstar Mortgage refuses to respond directly. I have disputed the fact that they have failed to respond directly to these complaints, but they have refused to respond to the disputes. I have daily called Nationstar Mortgage to discuss the fraudulent foreclosure they are attempting to complete. In the recorded phone conversations, Nationstar associates have promised they will return my calls and escalate my case. They have promised they will forward my concerns to the proper management for review, but I have not received a return call from anyone in their office. I have sent numerous emails, and letters, but my emails are never answered. Today I spoke with a Nationstar associate, XXXX. She assured me that because of the urgency of the situation, she would forward my concerns to a department which was " higher than a manager ''. She also assured me that she would call me later today after this process was complete. Because Nationstar employees have had such poor track records regarding returning calls, I asked for her office extension number. It was at this time that she hung up, and did not call back. Unfortunately, my experience today is the same type of experience I have had nearly every time I have spoken with Nationstar associates for the previous nearly three years. I have never been able to speak with the same associate more than once. I do not have a direct contact person with Nationstar. In addition, I will be attaching two Assignment of Mortgage documents which show fraud in the form of conflicting dates and locations of these assignments. The first Assignment of Mortgage to XXXX, took place on XX/XX/XXXX in the state of Texas. This Assignment of Mortgage was never filed at my local courthouse. The second assignment of Mortgage took place on XX/XX/XXXX in the state of New York. These conflicting Assignments substantiate the complaints which I have filed with CFPB previously, proving that XXXX did not follow the proper chain of title when the Assignment of Mortgage took place. My questions are the following : 1. Why are there two ( 2 ) Assignment of Mortgages which transfer the mortgage to " apparently '' the same entity? 2. Why was the first Assignment of Mortgage never recorded at my local Courthouse? 3. Because I was not notified of these transfers, who received my loan payments which were sent in? XXXX or the new owner/owners of my mortgage? In addition, I was never notified by the new owner/owners of my mortgage when these " supposed '' transfers took place. The Helping Families Save Their Homes Act of XX/XX/XXXX also added a new provision in TILA which requires that whenever ownership of a mortgage loan securing a consumer 's principal dwelling is transferred, the creditor that is the new owner or assignee must notify the borrower in writing, within 30 days after the loan is sold or assigned, of the following information : the new creditor 's identity, address, and telephone number ; the date of transfer ; location where the transfer is recorded ; how the borrower may reach an agent or party with authority to act on behalf of the new creditor ; and any other relevant information regarding the new owner. ****I never received correspondence from the new owner of my mortgage.

Consumer Complaint: In XXXX I noticed my payment increased by roughly {$100.00}. When I enquired with Nation-star, they advised I had an escrow shortage on my account for the XX/XX/XXXX taxes. Furthermore they anticipated taxes to increase in XX/XX/XXXX, thus they needed to build up the escrow balance. I 've made all of my payments since origination and there is no reason that there should have been a shortage on my Escrow account. During the year of XX/XX/XXXX my loan was being serviced by XXXX financial services. XXXX was purchased by Nation-star thus my loan transferred under their servicing umbrella. I informed Nation-star should have provided me a notice informing me my payment was going to increase. They advised they sent a letter informing me. I requested they send again so I could have for my records and I still have not received the notice. I also requested a full escrow analysis to be completed on my account. My understanding is they have 30 days to send this information. As of today, I am yet to receive any information. I requested this information in early XX/XX/XXXX. Nation-star has been unable to provide sufficient documentation supporting why their was an escrow shortage. I believe there was a miscommunication between XXXX and Nation-star and now I 'm paying extra due to their lack of detail during the service transfer. I 'm helping the CFPB can help me gain a full understanding as to why their was an escrow shortage and why i 'm being asked to pay an additional monthly fee to compensate. I would also like to understand why I have not heard anything regarding my dispute since XXXX. Sincerely, XXXX
