Consumer Complaint: I wish to avoid foreclosure. I was not given proper notice so I could have opted for State of Nevada Mediation. My notice of default was recorded on XX/XX/XXXX. A foreclosure certificate was requested in XX/XX/XXXX and issued/recorded on XX/XX/XXXX over 23 months later. Several RESPA laws have changed since my Notice of Default was recorded on XX/XX/XXXX. I do not feel their XX/XX/XXXX ( 23 month old ) Notice of Default is still valid. I also do not think I was properly issued my required mediation paperwork before simply recording a Notice of Sale 24 months after the Notice of Default. I believe Nationstar should have to record a new Notice of Default and then have offered me again mediation before it expired or waited another 90 days before recording a notice of sale. I want to avoid foreclosure. Nationstar is now evading that request. I am in the process of trying to avoid foreclosure and do a short sale. My attorney submitted an offer last week and Nationstar could postpone my sale date and allow me to short sale my home and avoid foreclosure. However, they refuse and say they can not accept my request. I do not understand why they can not postpone my sale date and allow me to sell the home. It cost them more to foreclose and takes longer. I have a market value offer on the table now.

Consumer Complaint: In XX/XX/XXXX my father refinanced our home to pay off some remodeling debt. He signed this loan not knowing what a negative amortization loan is. Over the years He paid the mortgage on time never missing any payments but only making the minimum payment on the loan, without knowing that the balance of it was getting larger. So then the loan was sold 2 separate times. My father passed away in XX/XX/XXXX and I now have this loan which was automatically converted to an interest only loan with Nationstar Mortgage. I have been living in the house so I continued making the payments till suddenly the payment went from XXXX to XXXX. I do n't know what to do. I called the mortgage company and they told me that if they modify the loan it would only go to XXXX per month. I will soon be getting foreclosure notifications. I asked them if they would take partial payments and they said they would just sit in limbo. I know that Neg Am and Balloon loans are illegal but I do n't know what I can do about it.

I called immediately and explained to the XXXX representative on the phone that my property was not vacant/abandoned and to not trespass. Three days later there was an attempted break-in and my home was vandalized. The XXXX Ohio Police Department was called, report number XXXX was filed and XXXX XXXX was named as a suspect.

Consumer Complaint: I have applied for a loan modification. I am currently paying 6.5 % on a loan. The method to apply requires that you go on line and submit various appears. When I submitted them I had apparently not provided or incorrectly submitted some forms. There is no way to know this other than to check again online.No emails or phone calls from them.I have called the person who is supposed to be my " specialist but never actually spoke to him. He is very hard to understand. I get different people who give me different reasons why this has taken more than 4 weeks despite the site saying 7 days. I am about to be late with my monthly payment. The person I spoke to today said it was given to the underwriters on XXXX XXXX th and it could take up to 30 days. The person before said that it was out of their hands since the application has to go through my home state and they are waiting for the return from New Mexico. It seems to me that the longer they put off their decision the less it costs them. If they reduced my interest rate from 6.5 % to say 3 % ; by me continuing to pay the higher rate. according to the last person I spoke to, It so happens that the date I become late with my payment is the same date that the underwriters are supposed to " decide ''.

Consumer Complaint: I had applied for a HAMP Loan Modification with Nationstar Mortgage, during XX/XX/XXXX and submitted all the required docs from time to time. Initially they refused to consider me for a HAMP Loan Modification, because I did not default on my Mortgage Payments. However I sent the attached letter dated XX/XX/XXXX, through CFPB. They responded to this, through their letter dated XX/XX/XXXX ( copy attached ) expressing their regret that they did not evaluate me for a HAMP Loan Modification and assured me that they are going to do this. However, their attached letter ( dated XX/XX/XXXX ) of rejection came as a surprise to me. It simply says, '' Insufficient Payment Reduction '', as the reason for denial, without giving any specific calculations whatsoever. According to me, if the 4 Standard Waterfall Steps of HAMP are followed, there can be about 32 % reduction in my Monthly PITI Payments.

Consumer Complaint: i had trouble with nation star mortgage for over a whole year to resolve a simple issue to remove a litigation code from a file in their dept that was removed already and verified by another supervisor. they would n't give me any info on the file even though i did n't have any council assigned. now after a year i got to talk with them after the code was removed i saw that NATION STAR MORTGAGE filed a satisfaction of mortgage with niece. this doc was available in across. I downloaded the doc and sent it to them for verification, they 're still showing that i have a mortgage with them. it 's over 2 weeks now since i sent them the document and been calling them almost every day with no response as to why they have n't verified their own document. They sent it to a research team that ca n't be reached but only internally. I ca n't get no phone number or email for this research team. so I 'm just stuck with a satisfaction of mortgage saying the mortgage has been discharged, but nation star still has a mortgage with my name on it. I verified my credit reports and the mortgage has been removed. I need help, i ca n't wait for a year for them to verify in their dept a document their company filed

Consumer Complaint: I was approved for a standard modification of my mortgage in XX/XX/XXXX. The Trial Payment Plan ( TPP ) stipulated that payments of {$1600.00} would be due in XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX. I paid {$1600.00} on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX. ( This is my second complaint against Nationstar Mortgage related to my mortgage modification. I learned in XX/XX/XXXX [ last month ] that my modification had been terminated for not making a payment, even though I had. Nationstar ultimately responded and said they had made a error in applying my XX/XX/XXXX TPP payment. As of XX/XX/XXXX, my TPP had been reactivated by Nationstar. ) Nationstar told me in a letter dated XX/XX/XXXX : " Once the XX/XX/XXXX trial payment is made the final loan modification documents will be sent to be reviewed, signed, and returned. '' That 's not at all what 's happened though, and I ca n't believe mere weeks have passed and now no customer service representative at Nationstar can give me a straightforward and consistent explanation of why Nationstar is not sending me the final loan modification documents. Every time I call, I get a different story, including some that are blatantly untrue based on Nationstar 's letters to me last month. Nationstar 's website now tells me that I owe {$5200.00} due on XX/XX/XXXX, even though I my TPP payments in XX/XX/XXXX AND XX/XX/XXXX ; that I made a partial payment, which never happened ; that my account is overdue ; and that I paid {$4700.00} on XX/XX/XXXX, which is not true. I paid {$1600.00}, just as the TPP specified. I spoke to a Nationstar representative in the loan-modification department two days ago. He told me the system showed I had paid all XXXX of my TPP payments and my account was marked as forbearance ended, which he explained meant I had successfully completed the TPP and that the website 's information was incorrect because it had n't been updated. He told me to give the system two days to self-correct and call back Wednesday ( today ) to make sure my documents were on the way. When I called today, I spoke to someone else in the loan-modification department. He was completely unhelpful. He told me my TPP was terminated in XX/XX/XXXX because my payment was reversed. This never happened, and the error Nationstar made in applying my payment to the TPP was for XX/XX/XXXX payment anyway. I told him he had his facts wrong, and he said he was going by what the system told him. ( Odd his colleague saw completely different facts in the same system just two days ago. ) I read him one of the letters Nationstar sent me in XX/XX/XXXX in which they acknowledged their error and confirmed that I was once again active in my TPP, with only XX/XX/XXXX payment pending before receiving my modification contract. He said he had no record of Nationstar acknowledging such facts to me so I emailed one of the letters to him ( XXXX ). He received my email with the letter attached and told me he 'd be submitting it for " escalation. '' I asked how long that would take, and he said at least two weeks but probably longer because the number of accounts submitted for escalation had risen considerably lately. The problem -- besides the obvious errors -- is that XX/XX/XXXX is nearly half-way over. My TPP is over this month, during which I am supposed to sign a modified contract for my mortgage. I do n't have time to wait two or more weeks before Nationstar takes action on my case. I REALLY need this modification because I ca n't afford what my mortgage payment would be without the modification.

Consumer Complaint: This complaint is associated with case # XXXX The complaint must be corrected as to the location of the property address which is incorrect as shown. The property address is : XXXX, DELAWARE XXXX Nationstar 's response to this complaint is unacceptable. For the past 6 years, Nationstar has used the same response to all queries- " We will check for error ''. We want our questions answered and want them to stop stalling. They have no escrow department and after all this time, they are admitting they have no idea where each of our payments went? This is what we want answered as per our complaint : Payments have been posted late, even though we have tracking numbers ; who is receiving these payments? The transaction history reports have been manipulated- each one is different ; payments were applied to a bogus escrow account rather than interest and principle as per the law. XXXX checks were returned and refused by Nationstar in order to force a manufactured default and ultimately an illegal foreclosure. A Nationstar witness in Court testified to the non-existence of an escrow account, yet Nationstar needs 30- 60 more days to determine if their witness was reliable!?!? Twice, Nationstar paid our homeowners insurance when it had already been paid. Why is Nationstar the MORTGAGEE on our insurance? They refuse to answer this!! This is an unacceptable response from Nationstar and we demand answers!! Not 60 days from now, but now! Do you need this time to make up answers?
