Consumer Complaint: To : Nation Star Mortgage Company Attn : Customer Relations XXXX XXXX XXXX XXXX, TX XXXX DA : XXXX XXXX, XXXX RE XXXX Request a Copy of My Full Mortgage Payment Account History/File from ( XXXX XXXX to XXXX, XXXX ) This letter comes to request a copy of my entire mortgage account payment history/file from the inception of my mortgage loan which was XXXX XXXX to XXXX, XXXX ( the present. ) As my present mortgage holder, I was informed that my present mortgage holder should have my entire mortgage history. You obtained or my loan was transferred to you from XXXX XXXXXXXX XXXX. All documents were transferred when you became the new mortgage holder of my loan. I must reiterate, that you ( NationStar ) sent a document entitled Full Account Payment History which included only my mortgage payment history from XXXX to XXXX. I must state that 2 or 3 years is not my entire mortgage history or file. Once again, Im kindly requesting my entire mortgage history/file, which should included signed documents and an explanation of how one obtained my present balance. Nevertheless, if you cant provide the requested information or documentation, it leads me to believe that my present balance could have been fictitiously created? I must inform you that I have never heard of anyone taking 60 years to paying a 30 year mortgage. This is simply ludicrous and unacceptable in my opinion. I must inform you that my mortgage loan did not start in the year of XXXX. However, it did start in XXXX XXXX, which includes a total of 27 years + 3 additional years of mortgage payment history. According to the last documents I received, one would believe that my mortgage loan was ignited in XXXX, which is definitely not true! My Resolution, Concerns and Request Are As Follow : *Please provide a copy and proof for the follow request below* My present mortgage balance is more than I paid for my house back in XXXX, after paying 27 years of payments. You have not sent me a copy of my entire mortgage history file, as I have requested on 2 different occasions. ( see attachments dated : XXXX XXXX, XXXX, XXXX XXXX, XXXX My mortgage loan was for 30 years and not 60years. According to my present balance, ( {$65000.00} as of XXXX ) it would take 30 more years to pay-off my loan, according to the present balance! I paid an additional 3 years in advance and above my premium monthly payment to pay my mortgage off I advance/prior to 30 years. My files may possibly have been mixed in or construed with someone else mortgage files or payment history etc. Please provide a written explanation of how my present mortgage balance is higher than what I purchase my house for in XXXX. I financed {$61000.00} in XXXX, Approximately 27 years later, I presently owe {$63000.00} +. Please explain and provide a written document within 15 days.. How much interest was paid toward my mortgage loan from ( XXXX XXXX, XXXX ). According to my records Ive paid a total of {$32000.00} in mortgage payments thus far.

Consumer Complaint: My home mortgage, serviced by XXXX , was sold to Nationstar i n XXXX . Yesterday I received a letter from Nationstar stat ing my home insurance coverage had expired and that they had started charging me for home insurance unless/until I provided them with proof of something else. In the past 21 years I have never had home insurance expire, have never had any coverage lapse for any reason. In fact, I verified with XXXX the policy that is in effect is reflected in their records and they told me this information was passed t o Nationstar. I believe Nationstar is engaging in fraudulent business activity by knowlingly mis-representing the status of insurance when it buys mortgage servicing rights from another institution. The reason they are doing this is they are then forcing an insurance policy on the borrower, and that insurance is fro m one of t heir subsidiaries and from which they realize financial gain. Although I have contacte d Nationstar, and also had my insurance agent send confirmation of coverage to them, I am awaiting my next statement to determine if I have been charged for any interim policy premiums. I believe the CFPB should take a look at the business practic es of Nationstar and I think it will find violations of current federal law and regulations.

Consumer Complaint: Nationstar Mortgage has failed repeatedly to cease contacting me via email, phone, and other methods, even though I have filled out their Do Not Contact Me At All form, THREE TIMES!!! Being Military, I pa y 1/2 my Mortgage on the XXXX , and the othe r 1/2 on the XXXX . SEVERAL times, Nationstar Mortgage has FAILED to apply the first payment to the second payment, instead, leaving it in the suspense account, XXXX hys I have to contact them to do their job, or incur a late fee. In between receiving the first 1/2 payment, and up until the second half is received, Nationstar w ill repeatedly call and email me, requesting full payment, EVEN THOUGH I AM NOT LATE! I am late on the XXXX ! I have yet to be late paying, yet they still contact me! They also attempted to force insurance on me, which I quickly quashedwith proof that I had adequate insurance and that, if needed, I wiuld contact Legal. I was part of the Wroght vs. Nationstar settlement ... seems they have n't learned a thing! Attached are emails I have received from Nationstar in just a span of a WEEK! Keep in mind, I have repeatedly filled out their No Contact form!

Consumer Complaint: My problem is with the lender who owns the mortgage loan for my house I have owned for almost 25 years, Nationstar Mortgage. They have made the loss mitigation process very difficult, they have not allowed me to work with a Spanish speaking processor, and the people they have assigned to work with in the past have been difficult to communicate with. My family is being pushed into foreclosure, even though with the addition of my wifes income and job we clearly can afford a fair monthly payment. The problem is getting an actual review of our information completed by Nationstar. We feel that they are blocking us from government and internal programs tha t may be a ble to help us with get back into good standing with our mortgage, which is what we want to do, but wanting to pay and get caught up is not enough if the lender is Nationstar w ho will not work with you the right way. I bought our home in XXXX . During the mortgage boom in the XXXX I refinanced a couple of times, and the last loan that was written was with XXXX XXXX in XXXX ( right before the crash ). The loan was with XXXX for a period and then went to Nationstar. I had some financial challenges in the past and at one time I was approved for a modification. My struggles arose again in XXXX as I was overwhelmed with expenses and a loss of overtime hours. At that same time my son was accepted to college which was a huge moment for him and we provided some help with this to get him enrolled. We were overwhelmed with expenses and struggled to keep up with our payment. We began trying to start the negotiation process at that time with a lady named XXXX but she was difficult to reach and we had requested a Spanish speaker. We continued to struggle financially, and then my wife got a job at the airport making a solid income. When put together with my income as a machinist ( been doing it for 32 year s ) w e had sufficient income to make a fair and reasonable mortgage payment. However, as I described Nationstar has not been easy to work with us and has not assigned us a Spanish s peaker and have not taken the time to review our file and case and income and expenses and determine which government or internal program works for our family. This is an avoidable foreclosure if only Nationstar would work with us. At this time they are trying to set a foreclosure sale date instead of working with us. Nationstar would make a lot more money if they would restructure this loan and modify it so that we can resume making payments than if they were to sell it at auction. We want Nationstar t o follow the federal guidelines and rules of the state of Illinois and consider us for all government and internal programs in order to give us the chance to fix this problem

Consumer Complaint: The enclosed Assignment of Mortgage that was recorded and filed on XXXX XXXX , XXXX , with the City Register of the City of XXXX XXXX to claim legal ownership was robo signed an is invalid. XXXX XXXX XXXX was not and never was a XXXX XXXX XXXX XXXX . XXXX trademarked the name ( XXXX . # XXXX ) but never incorporated XXXX XXXX XXXX as a corporation in XXXX XXXX . The now defunct lender also failed to file XXXX papers in XXXX . As a result, this also creates a huge liability for Mortgage XXXX XXXX XXXX XXXX XXXX ( XXXX ). XXXX had to know XXXX XXXX XXXX was NOT and NEVER was a XXXX member. XXXX and it signatories should have known that XXXX XXXX XXXX was NOT and NEVER was a XXXX XXXX corporation. The Note and Mortgage are void because the allege Lender, XXXX XXXX XXXX XXXX , stated to be a XXXX XXXX Corporation, was not in fact Incorporated in the year XXXX , or subsequently, at any time, by XXXX XXXX Loans or XXXX XXXX XXXX or any of their related corporate entities or agents. XXXX XXXX XXXX XXXX , was not licensed as a mortgage lender in the State of New York in XXXX , or thereafter, and the alleged mortgage loan is therefore, invalid and void. The alleged Assignment of Mortgage which purported to transfer interest in the mortgage to XXXX XXXX XXXX XXXX XXXX , XXXX XXXX XXXX XXXX XXXX XXXX , assignee, was invalid because ( XXXX ), as nominee for XXXX XXXX XXXX XXXX had no authority to assign the ownership interest of said mortgage, because XXXX was the not owner of the subject mortgage and was only a nominee for XXXX XXXX XXXX XXXX , an alleged XXXX XXXX Corporation which was non-existent Corporation. Said purported Assignment was without authority, and therefore invalid. Furthermore, Im also requesting to know to the status of my loss mitigation application for a loan modification which was submitted timely two times to Nationstar Mortgage. It appears Nationstar Mortgage is also engaging in the prohibited practice of dual tracking while having received timely all the required documents and hardship medicalinformation. The CFPB issued amendments on XXXX XXXX , The rule issued establishes new protections for consumers, including : Requiring servicers to notify borrowers when loss mitigation applications are complete : Whether a borrower is entitled to key foreclosure protections depends in part on the date a borrower completes a loss mitigation application. If consumers do not know the status of their application, they can not know the status of those foreclosure protections. The final rule requires servicers to notify borrowers promptly and in writing that the application is complete, so that borrowers know the status of the application and have more information about their protections. The CFPBs new rule clarifies that, if a servicer has already made the first foreclosure notice or filing and receives a timely complete application, servicers and their foreclosure counsel must not move for a foreclosure judgment or order of sale, or conduct a foreclosure sale, even if a third party conducts the sale proceedings, unless the borrowers loss mitigation application is properly denied, withdrawn, or the borrower fails to perform on a loss mitigation agreement.

Consumer Complaint: I have a mortgage with Nationstar Mortgages for a new condominium I purchased in XXXX of XXXX . This loan includes an escrow account for taxes. Nationstar acquired the loan in XXXX from XXXX XXXX XXXX . Neither of these XXXX companies have paid my town real estate taxes stating they will not due so because it is a new condominium and the tax bill is for XXXX of the XXXX units in the association. I have provided documentation from the town verifying the percentage of the taxes that my unit is responsible for. I have also asked that if they will not pay the taxes, that they refund me the escrow so that I can pay the taxes. Both companies have refused to do so. The town has said they are starting the process of placing a lean on the property. As well, there are over {$80.00} in late fees that neither company has been willing to pay. I have close to XXXX XXXX in my escrow account. I have tried many times to resolve this and have had a least six phone calls and have sent letters to them, have sent them all the requested documentation, but they have not resolved this. In my last phone call on Friday, XXXX XXXX , XXXX , Nationstar said they would not resolve this until the next fiscal year in XXXX , despite being aware the town plans to start the process of placing a lean on the property.

Consumer Complaint: I am an XXXX XXXX service member. I have answered the call to serve in the military back in XX/XX/XXXX . I o wn a home in XXXX , XXXX and prior to that year I have never defaulted on my mortgage. After being XXXX out to XXXX XXXX in XX/XX/XXXX I received orders to relocate to XXXX , XXXX with my family. I reached out to my mortgage company and informed them of my situation and provided them with a copy of my orders. The mortgage company at the time stated thanks for the information however offered no assistance, not even to lower my interest rate which at that time was higher than 6 %. After checking into my new command in XXXX , XXXX . ( 3 months ahead of my family which at the time was to pave the way for my wife and XXXX kids to follow later ), I got a hold of my legal department who informed me that my interest rate on my mortgage should be lowered to 6 % and they provided me with the necessary paperwork to make it happen. The Mortgage Company at that time, did not cooperate in reducing my interest rate right away. In fact, I had to get the legal department of the command involved again and this time they took over from there and helped me all the way through until the interest rate got reduced. After getting the interest rate reduced, I asked the mortgage company if there were any programs available I may be qualified for in terms of receiving assistance. The mortgage company said NO. I however, looked into it on my own and discovered that I may have been a candidate for the HAP ( Homeowners Assistance Program ). I applied for this program and got denied. The mortgage company stated that the reason was my home was no longer my primary residence, and for this they could not qualify me for the program. Six months later i n XX/XX/XXXX , my family and I were fully relocated to XXXX . After raking and scraping to pay the mortgage on an empty house in XXXX ( for those six months ) on an XXXX salary, I managed to get the house rented to a tenant. The tenant lived at the house for a year until I was forced to evict him for not paying the rent. I was forced to going back to paying the mortgage on an empty house yet again. In XX/XX/XXXX , I contacted the mortgage company and explained my current situation and I was informed to re-apply for the program which I did. The mortgage company gave me such a run-around ( as if to get me to not cooperate with their many demands for paperwork ) but with my back against the wall I kept up with their demands only to be denied again for the second time. This was devastating. Here it was an XXXX whose paycheck is already next to nothing is being forced to pay the mortgage for a house miles away and in another state that he 's not living in and still have to manage the bills for the house that him and his family resided in. I did it for as long as I could, but when I started falling behind in payments on everything else I decided I could no longer afford to pay the mortgage for the house in XXXX , so I stopped. I reached out to the mortgage company and begged for help, I even re-applied again for the program, saying to my wife weve got nothing to lose, and again I got denied. I was left to think these mortgage companies do n't care for the well-being of families. It seemed as though as long as their pockets are being laced with money every month they are ok, but when a situation occurs and families and are n't able to pay, the mortgage companies will ruin their credit immediately. My credit went from being excellent to poor really quickly, and in fact even caused me to being randomly selected by XXXX ( just my luck ) for screening. I received a letter from XXXX at my command and shortly after my security clearance ultimately got taken away from me from falling behind on payments. Luckily for me, I have a rate that does not require a security clearance, but that still does n't sit well with me. With the years passing by, I have managed to take care of everything that was on my credit as being delinquent and they all have been erased from my credit. All, except the house in XXXX To this day, the mortgage company still rides my credit every month as being late and delinquent. All I 've asked for was a little help, is that too much to ask for Nationstar?

Consumer Complaint: We are co-owners who refinanced the mortgage on our XXXX home in XXXX with Nationstar Mortgage. We were very specific in explaining that we wanted to pay closing costs in cash rather than have it financed. Over the course of discussions only the first draft of the closing documents indicated we would use cash to close. Despite our insistence, in the end we went to closing without being given the opportunity to pay cash for closing. Also, we paid our property taxes for the first quarter and the next installment was not due until XXXX XXXX but it too was added to closing costs ( {$1100.00} ). Since closin g, Nationstar has sent us a check in the amount of {$110.00} ( payoff overages ) and more recently a letter stating that we were overcharged for certain closing costs in connection with the closing of your loan and we are refunding this amount to you through a principal reduction. The amount is {$610.00}. The difference as per the letter is reflected in C ash to Close and Lender Credit via the new Disclosure. We are concerned about how our refinance was handled, the process by which the differences occurred and whether our property tax had to be made part of this closing. We request a full review of the closing documents/disclosure and would like to know if Nationstar was within their rights to refuse to allow us to pay closing costs up front. These charges were rolled into the loan creating the need for a gap note and mortage. We only had a certain period until the closing and if we didnt close by that date then a higher interest rate would be applied.

Consumer Complaint: I, XXXX XXXX file this complaint as my right under the Fair Debt Collection Practices Act have been violated pertaining to an offer to modify a mortgage. Under a stipulation of this act from XXXX XXXX , XXXX , I must be offered a modification package, and it does not matter if the property is owner-occupied or an income property. The fact that we discovered a modification package was mailed to me in XXXX of XXXX proves that the mortgage servicer known as Nationstar Mortgage offered this modification as a Tier II program proves that multi-income properties are part of all national bank modification programs. I never received this modification request as it was mailed to a post office box I dis-continued in XXXX . Nationstar Mortgage had to get the request back by mail if they indeed sent it. At all times Nationstar Mortgage knew my home address as XXXX XXXX XXXX , XXXX , New York XXXX . I have recently hired a law firm known as the XXXX XXXX XXXX to do my modifications on all my properties. I was able to procure a modification on my personal resident through this law center. Now my second home is scheduled for a foreclosure for XXXX XXXX , XXXX . I have no other remedy but to file for a personal bankruptcy to prevent this foreclosure from happening. Rules are now being enforced through the Consumer Financial Protection Bureau pertaining to the numerous vi olation of mortgage servicers on foreclosure protocol. I still have an open claim for principal reduction with the Office of Inspector General Federal Housing Finance Agency that could eventually structure my mortgage debt within reasonable properly value. However, my rights have been violated by Nationstar Mortgage in its entirety. Accordingly, I make this request for intervention by the Consumer Financial Protection Bureau to enforce the recent mandates by said agency with XXXX XXXX XXXX . I was never offered a modification, and the matter should be resolved through the XXXX XXXX XXXX . Accordingly, I demand that a modification offer be mailed to my home address or emailed to XXXX XXXX XXXX . I believe that I am well within my rights on this request.
