Issue: Attempts to collect debt not owed

Subissue: Debt is not yours

Consumer Complaint: Hi, National Credit Systems, they published and are sharing false information, about my credit history with FALSE documents, its causing a lot of damage with these collections that doest exists. I've been trying to apply for personal credit and for my business and even though I have great credit the banks weren't approving anything. I then did some research and discovered that since XXXX I have Collections that don't belong to me on my credit, and I am being harmed by this. My credit was from XXXX to XXXX. Now, because of National Credit Systems actions, I am paying more for insurance, car loan, and my application for a new job position was denied because of my credit. I need to be a General Contractor, but the license requirements needs a higher them XXXX credit. The collection refers to an apartment rental contract, but my name was removed from that contract more than a year ago, I have nothing to do with the open account with the company anymore, I have all the evidence, all the evidence that my name was removed from the contract, and this was reported in my name. The worse part, Nacional Credit System has my Collection and its sharing with others agencys of credit but its all false information. NCS is the worse place for debit collection because it hurts a lot my personal credit. I had a lot of damage because all this companys did not follow the law, they use false documents, made false affirmations, created false collections, now i have a lot of problems because they did all this.

Consumer Complaint: National Credit System is trying to illegally collect a debt from me due to fraud. I have never done business with them, nor do I know who they are. I have tried several times with proof to the credit agencies to prove this is not me and is indeed fraud. They are ruining my good name.

Issue: Written notification about debt

Subissue: Didn't receive enough information to verify debt

Consumer Complaint: In XX/XX/2020 my son, XXXX XXXX, was living in an apartment at XXXX XXXX apartments in XXXX Florida. He had a lease along with XXXXwo other college students for the unit and each was responsible for their own portion. During the pandemic his two roommates parents lost their employment and were unable to make their share of the rent payments. The landlord was not willing to accept our 1/3 of the rent as we had been paying and instead insisted that the whole rent be paid. That put me in a position where I could not pay the rent in its entirety. I made offers to pay my son 's third of what was remaining on the rent at that time and was told that I could not. Fast forward approximately one year and I started getting collections calls from National credit systems located in Georgia. The total balance owed for the debt they are attempting to collect in {$7700.00}. My argument is that I'm only responsible for 1/3 of that debt as there were two other individuals on the lease that are each required to pay 1/3 of that debt until the total amount is paid. I have sent a registered return receipt letter to national credit systems offering to pay my 1/3 of the debt in order to remove this collection notice from my credit report. Prior to this incident my credit was at roughly XXXX as a XXXX XXXX and plummeted down into the XXXX hundreds as a result. I have always stood steadfast that I would pay my sons and my obligation of XXXX of the debt which would be roughly {$2600.00}. They will not accept that and tell me I have to pay the full thing and go after the other two tenants myself. This sounds ridiculous and as a result I am filing this complaint.

Issue: Attempts to collect debt not owed

Subissue: Debt was result of identity theft

Consumer Complaint: My name is XXXX XXXX, a federally protected consumer, and I am making this complaint against National Credit System, for committing identity theft. I have never given National Credit System, any permission to use any of my identifying information to commit mail fraud by contacting me about an alleged debt they claim I owe. I am aware that in accordance with Article 9, the assignment of a defaulted note is illegal. Both the assignee and the assigned are both liable for violations under 15 U.S. Code 1692e ( 12 ). I have not validated any alleged debt with National Credit System and my failure to dispute the validity of these alleged debts shall not be construed as an admission of liability. As of XX/XX/23, I have not received any documentary evidence, such as a trilateral contract, giving National Credit System any right to collect on this alleged debt. I have never received any documentation requesting validation from National Credit System, before they committed multiple violations under the FCRA and the FDCPA by furnishing this alleged debt to my consumer report, including but not limited to 15 U.S. Code 1692d ( 4 ) which the FTC defines as debt parking. If National Credit System, can not provide me with proof such as a tracking number that they attempted to lawfully validate this alleged debt with me, the consumer, prior to furnishing it on my consumer report, this has been a fraudulently furnished account with forethought and malice as an attempt to bring harm to me and my financial reputation. I am legally refusing to pay this debt pursuant to 15 U.S. Code 1692c ( c ). I am demanding a cease and desist of all illegal activity, any communication and collection activity, of this and any alleged debts until National Credit System, can provide me with sufficient documentary evidence that I have any legal obligation to pay them. If this documentary evidence can not be produced and National Credit System, continues its collection efforts, I will file for litigation for actual damages caused and National Credit System, will be held criminally liable for aggravated identity theft pursuant to 18 USC 1028A, extortion, theft by deception, securities fraud, and mail fraud. Upon the receipt of the documents herein and of this notice, you are hereby notified Pursuant UCC 1-202f. Your prompt attention and response are both requested and required.

Issue: Written notification about debt

Subissue: Didn't receive enough information to verify debt

Consumer Complaint: During later XXXX of XXXX, I viewed my credit report to see what I could do to improve my score. I saw an account in collections for National Credit Systems and searched for contact information, as I was unaware of this account being in collections. National Credit Systems state that the account is from XXXX, but have made no efforts in contacting me ( phone call, email, mail, etc. ) to inform me of the debt. When I spoke to the company in XXXX, they refused to send me any debt verification as well as offer as form of options for dispute/mitigation. I called the company again today XX/XX/XXXX and received the same answer : they do not provide any documentation regarding the debt. The company informed me that they offered me a settlement of the debt, but they have not contacted me about it. I had no idea an account was reported and that there has been a settlement offer. They've had my phone number and address on file yet I have been denied verification of the debt.

Issue: Communication tactics

Subissue: Used obscene, profane, or other abusive language

Consumer Complaint: I have been getting calls multiple times a week about collecting a debt owed to an old apartment complex ( that is an off-lease out-of-the-blue charge ) and they have also contacted my parents who have nothing do do with this. I also have an old roommate who has been being harassed about the same exact amount owed to the apartment complex but neither of us have received communication about how to split our payments. There is no way we will both be paying the full amount separately when it is one bill. When I called and asked about a payment plan or any help I could receive as I do not have the means to currently pay this, the collector repeated the same phrase You need to find this money in full and would not say anything to me/ offer me any assistance. Refused to discuss anything with me and repeated one sentence to me over and over.

Issue: Incorrect information on your report

Subissue: Information belongs to someone else

Consumer Complaint: XX/XX/2023 I was alerted by credit reporting agencies that there was a change to my credit report. I logged on to find that there was an added collection account for the amount of {$7000.00} from a XXXX At XXXXXXXX XXXX XXXX I was immediately concerned because I have never rented an apartment. I looked further into my credit report to find that there was a false address as well. Whoever did this was able to acquire an apartment fraudulently, using my information. They did not have my I.D . as my I.D . has been on my person, and has not been lost.

Issue: Written notification about debt

Subissue: Didn't receive enough information to verify debt

Consumer Complaint: On XX/XX/XXXX, received credit report notification via XXXX that a new collection account was on my credit from NCS ( National Credit Systems ) in the amount of {$120.00}. I contacted them and was advised that an apartment complex that I moved out of in 2021 had sent the debt to them for collection. I asked for verification of the debt, and NCS sent me ( via email ) a charge for prorated rent and miscellaneous utility fees. I explained to them that I had worked this out in 2021 with the apartment complex - they had sent me the breakdown of move-out charges back in 2021 which included fraudulent move out fees, fraudulent damage fees, and non-itemized charges as well as a fee for a date when I did not live at the complex. NCS told me it was best not to dispute the debt with the credit bureaus and allow them 30 days to get the Original Creditor to validate the debt. I contacted them in XXXX and was told the XXXX did not respond and since they only had 30 days, the debt would be removed and I would get a letter advising the same. Since I did not receive a letter and the debt is still on my credit, I disputed it with the credit bureaus and contacted NCS again. Today, NCS advised they got validation yesterday and the debt would stay on my credit unless I mailed them the information I had ( which I offered to provide in XXXX, but NCS told me to wait until the XXXX responded ). This company has had this debt since 2021 and parked it on my credit in XXXX. They did not send me ANY letters ( they have my forwarding address ) and only communicate with me if I contact THEM.
