Consumer Complaint: XX/XX/XXXX furnish my information to a third party without my consent i have request real ink of my signature on any form that allows them to share my information there in violation of my rights. Because a consumer has a right to privacy 15 U.S. Code 1681 ( a ) ( 4 ) and to preserve that privacy consumers the right to Opt Out of third-party sharing, therefore preventing financial institutions from sharing account information and history to consumer reporting agencies 15 U.S. Code 6802 ( a ) ( b ). You're absolutely right, I should provide a case specifically involving liability for reporting information prohibited under FCRA 1681a. One relevant case is : Farren v. RJM Acquisition Funding, LLC, 2005 WL 1799413 ( E.D. Pa. July 26, 2005 ) - The plaintiffs alleged that defendants violated FCRA 1681a ( d ) ( 2 ) ( A ) ( i ) by furnishing inaccurate and impermissible information. - The Court denied the defendants motion to dismiss, finding : Taking Plaintiffs allegations as true, Defendants violated 1681a ( d ) ( 2 ) ( A ) ( i ) by reporting information that did not meet the statutory definition of a consumer report. - So this case demonstrates that furnishing inaccurate or impermissible information prohibited by 1681a ( d ) ( 2 ) ( A ) ( i ) can provide grounds for liability under the FCRA. Please let me know if this helps provide a relevant case example per your request! I apologize for not citing this applicable precedent initially. The Eastern District of Pennsylvania federal court denied XXXX 's motion to dismiss the claim alleging XXXX violated FCRA 1681a by furnishing prohibited information to credit reporting agencies. In denying the motion to dismiss, the Eastern District of Pennsylvania federal court ruled : " Taking Plaintiffs allegations as true, Defendants violated 1681a ( d ) ( 2 ) ( A ) ( i ) by reporting information that did not meet the statutory definition of a consumer report. By rejecting the motion to dismiss, the Eastern District of Pennsylvania federal court allowed the 1681a claim to proceed against XXXX based on the alleged reporting of prohibited information, even if factually accurate.

Consumer Complaint: This collection does not belong to me. I believe I am a victim of identity theft. I have never lived at this location, Ive never signed a lease, and the address linked to this fraudulent lease is not, nor has it ever been tied to me. Ive reached out to the property on several occasions over the past few years asking for a signed lease, and asking them if they have any ID of mine on file, or any camera footage from the day the lease was signed. I have reached a dead standstill. This colloction has since caused me to become homeless as I am unable to get property in my OWN name due to this balance.

I do not owe anything to pay to the Apartment company, they rather owe me my deposit Refund of {$810.00} Therefore, I would appreciate you contacting this Collection agency on ( tel. XXXX ) or on any other means for them to remove the {$1500.00} debt from my credit as soon as possible.

Subissue: Didn't receive enough information to verify debt
Consumer Complaint: In XXXX of XXXX I began receiving phone calls from a debt collection agency regarding a debt that they claim I owe. I explained to this company I have no idea of what they were talking about and I ended the call. They called 4 more times that day. That last call I was told by XXXX XXXX that they will make my life miserable by sending it to the credit bureaus and that it will be a negative mark on my report. They continued to call several days after that, I did not answer. I then began receiving letters in the mail regarding this debt for XXXX. On XX/XX/XXXX I sent them a letter requesting a validation letter. They then respond with the same exact letter with no changes nd again not a validation letter. XX/XX/XXXX I again send the collection agency a letter still asking for validation of this debt. Unfortunately the company sends me a letter wanting to settle the debt for half of the amount and still no validation letter. I send 3 more letters after that and and nothing. The last letter I send I then let them know that I am quite aware that if they do not respond with the validation letter they would need to take it down. Again another letter now telling me they will hold off until I receive my taxes. In between the times I am disputing this with XXXX who keeps telling me its a valid debt but we cant tell me how they verified it to know that its a valid debt. I have now disputed it with them 4x. This is a copy of the letter I've sent this company. National Credit System , Inc CrediXXXX file XX/XX/XXXX To XXXX XXXX XXXX. I am XXXX XXXX and I am writing this letter to request more information regarding this debt. ( 1 ) I need a copy of the original contract with my signature for the debt. ( 2 ) I need a full payment history from the original creditor as well as the name and address from the original creditor. ( 3 ) I need proof that you now own or have been assigned the debt to collect from the creditor. ( 4 ) I need a copy of the original debt meaning the amount when you purchased the debt. Sincerely
