Consumer Complaint: Hello, on XX/XX/2021 approximately at XXXXXX/XX/XXXX eastern standard time. My daughter in law received a call from XXXX identifying themselves as : National Credit Systems. She spoke with a representative who only asked for her name, she went on to use my name. No information was verified, no social, birthdate, address or anything. He went on to provide information regarding my account including the balance information. She went on to speak with a manager and he did the same thing. No information was verified, the mrd mmdc was not said, this is a failed attempt to follow FDCPA protocol as well as giving out information regarding my personal account. I need a resolve immediately and I feel that I should be compensated for the trouble, embarrassment, and the lack of care for my personal information.

Consumer Complaint: My previous complaint ID is XXXX I previously filed a complaint about National Credit Systems in XX/XX/XXXX. I was never sent any kind of communication about the debt they claim I owed until I filed a complaint with you guys. This company took from XX/XX/XXXX of XXXX to validate a debt. They stated the debt I owed was for {$120.00}, but they have the debt listed on my credit for more than {$3000.00}. After my complaint was closed out they sent a letter ( this is the first correspondence I've ever received from them ) stating that I owed {$3400.00}. That letter is attached below. I already mailed the money order for {$120.00} to Attorney XXXX XXXX. As I mentioned in my previous claim Attorney XXXX XXXX was the name and contact information I was given when I first called them in XXXX of XXXX. I'm not sure how one company can be listed on your credit but the payments go to a totally different company. After receiving the letter and realizing that I wasn't going to get help from the CFPB or the FTC ( their website sends me back to the CFPB ) I decided to try to call them and settle the debt and have it removed. I was told by the CFPB when I called yesterday that the company can not misrepresent the debt. I'm not sure whats going on with this company. The lady I spoke to with National Credit Systems advised me to call XXXX XXXX, when I told her that it was violation of my rights to misrepresent this debt she transferred me to a manager 's voicemail. I am not sure what needs to be done to get this corrected. I do not want to be scammed. Please help me!

Consumer Complaint: I was contacted by a person named XXXX XXXX from National Credit Systems, stating that I had a debt in their office due to collections. I confirmed my name with her, and I asked what debts she was referring to. She never asked me to confirm any other information such as my date of birth before providing me with medical information. She then proceeded to tell me that I had a debt from Texas XXXX as well as 5 other debts from XX/XX/XXXX XXXX XXXX XXXX, gave me each debt amount, the date of service and the providers name. and the account number for all the accounts. I told her that I needed to see this information in writing and asked her for a letter of validation. she said she would notate the account and request for me to have a statement sent down showing the breakdown of all the charges. I gave her the address and she assured me that she would make sure that this was not going to be reported to my credit until I had a chance to see the letter and verify everything. on XX/XX/XXXX, I got notification that 5 new collections had been reported to XX/XX/XXXX A debt from XX/XX/2016 for XXXX to XXXX XXXX XXXX XXXXXX/XX/XXXX, a {$21.00} debt to XX/XX/XXXX XXXX XXXX XXXX, another debt of {$170.00} to XX/XX/XXXX XXXX XXXX XXXX, a {$25.00} debt to XX/XX/XXXXXXXX XXXX XXXX and a {$24.00} debt to XX/XX/XXXX XXXX XXXX XXXX. I never received any letter in the mail before the dumping this to my credit not even 2 weeks after contacting me. This is a violation of HIPAA regulations as well as the Fair Debt Collection Practices Act. also, National credit Systems continues collection activity on accounts they did not validate within 30 days as specified under Texas Finance Code. Under Texas Finance Code Section 392.202 a debt collection agency has thirty ( 30 ) calendar days to respond to a debt validation request. If they fail to respond to the validation request then they have essentially admitted, per Texas Finance Code 392.202 ( b ) ( 2 ), that the debt in question is inaccurate. As of XXXX XXXX they are still reporting the account on my credit. Which puts them in violation of various state collection laws.

You indicated that there was no balance owed and you took my mail forwarding address for any further correspondence. I did not receive any communication from you. I have kept all of my receipts, all of which are signed by your staff as paid. I have pictures after my move that show that there was no damage done to the apartment. So, I can not imagine why my account was sent to collections. I have repeated asked for someone to show me a balance sheet to see where these charges originated. However, I have yet to receive this information. My requests for information are being ignored and yet my credit is being negatively affected. Consumer Complaint: This is a debt against an old apartment lease. I left the apartment with the understanding all was paid. I recently started to monitor my credit and found this collection account that I was not aware of. I lived in XXXX XXXX XXXX apartments from XX/XX/XXXX to XX/XX/XXXX. I now have this negative collection for a debt that I have never been contacted or received any type of bill. I have had perfect rental history for over 10 years. If there was an issue with this complex, I would have reached out to resolve it. Unfortunately while I lived there, I had an issue with one of the office personnel who was on XXXX and she knew that my kids and I were aware of the situation. I would like to get this resolved as soon as possible. It is hurting my chances to try to rent a new apartment. I was in the same home for 3 years. They had plenty of time to reach out.

No one ever contacted me about this debt, they just slapped this on the report. I think it's probably fraud. I tried to call both of them but neither would pick up because it's a Saturday. Consumer Complaint: This is an attempt by a former landlord and its Debt Collection Agency to profit from the Covid-19 hardship. After successive phone calls in which I contested the debt, I demanded validation of this debt and the collector sent a letter demanding payment of a " late fee '' of {$3100.00}. The fee purportedly arose from my prior residential tenancy in Philadelphia. Commencing on XX/XX/XXXX, months before the XXXX expiration of my lease, I gave multiple written notices by certified mail, return receipt to my landlord stating that I would not be renewing my lease because I was fired due to Covid-19 layoffs. The landlord signed for my letters. It knew my financial condition. I was unemployed and couldn't afford a lease renewal. Simultaneously, on XX/XX/XXXX, the XXXX XXXX XXXX passed the Emergency Housing Protection Act ( " EHPA '' ) ( Sec 9-809 ) which barred landlords from charging late fees from tenants who experienced financial hardships due to Covid-19. The law covered fees imposed from XX/XX/XXXX to XX/XX/XXXX, overlapping the exact period of my lease. The EHPA rendered any lease provision charging such fees " void '' and " unenforceable ''. My lease expired in XX/XX/XXXX and on XX/XX/XXXX the Landlord demanded payment of the " late fee ''. The Landlord 's managing agent concealed my prior certified letters and unilaterally inserted her own dates to make my notice of termination appear late. The landlord then predicated its " Late Fee '' on the late date imposed by its own agent. I wrote the landlord regarding all of the issues and never heard back. On XX/XX/XXXX, I commenced a mediation before the XXXX. Attorney General. The landlord defaulted and never appeared to adjudicate its claim. Unfortunately, the mediation was voluntary and the landlord evaded a final determination. No further communications occurred over the last six months, until the current debt collector attempted to resurrect this claim. This debt was fraudulently manufactured by this landlord and was explicitly void under the Phila. EHPA, but this Debt Collector is acting oblivious to the underlying illegality and pressing a spurious claim.

Consumer Complaint: Legal Department, I am a victim of identity-theft. I am writing to request that you block all the following fraudulent accounts in my files with Transunion, Equifax, and Experian. This information does not relate to any transactions I made. I did not authorize anyone to use my personal information. I hereby exercise my legal rights enacted by Congress and The Federal Trade Commission, which explicitly states when a victim files an affidavit it shall be honored by all credit bureaus and all fraudulent information must be blocked within 4 days and proper notification shall be given to all furnishers pursuant to section 605b of The Federal Fair Credit Reporting Act. Failure to comply shall lead to complaints being filed with The Better Business Bureau, Consumer Financial Protection Bureau, and Attorney General with legal action of your companys unlawful collection practices, misrepresentation of reporting inaccurate debts, and noncompliance to adhere to laws enacted to help who are victims of identity-theft. I request that an extend fraud alert be placed in my file explaining that fraudulent applications may be submitted in my name. Do not extend credit without first contacting me personally and verifying all applications. Furthermore, as victim of identity-theft I received notification that my personal information was compromise in the several different data breaches. It has made it difficult to resolve this matter in a timely fashion. I have made several attempts to resolve this. If action is not taken to properly assist me with this matter within 15 days. I shall file a class action lawsuit for violating the FCRA and FDCPA violations are as follows not limited to reporting inaccurate information, reporting information that resulted from crime ( s ) and/or crime ( s ) of identity-theft, unlawfully collections of debt, calling after designated hours by law, defamation of character, and misrepresentation of true credit worthiness. I ask that all fraudulent information listed below be removed without question. I have fraudulent accounts, employers, misspellings of my name, and address that are associated with crimes that were committed against me. Once deleting all fraudulent information, you acknowledge that it is indeed fraudulent and resulted from crimes of identity-theft. By doing so you adhere to the FCRA that make it unlawful of any, some, or all information to be transferred, sold to another collection agency or reinserted one 's credit report once it is deemed as fraudulent. You also understand in order to reinsert information to a consumers credit report notification must be given 5 days prior to reinsertion. Failure to comply will also be a violation of the Federal Fair Credit Reporting Act and Fair Debt Collection Practice. The below-listed accounts by the Original Creditors, who have reported these accounts within my credit reports, were not opened by me. I also did not give my authorization for anyone else to open these accounts. Someone else of who did these that I did not know. Policy states. According to the Fair Credit Reporting Act FCRA 611 ( 15 U.S.C 1681 ), Procedure In Case of Disputed Accuracy. ( a ) Reinvestigation ( 1 ) Reinvestigation ( a ) In general. Subject to Subsection ( f ), if the completeness or accuracy of any item of information contained in a consumers file at a consumer agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of a such dispute, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( 5 ), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. Therefore, my position is being clearly stated, these accounts do not belong to me, meaning that you are reporting inaccurate account information within my credit file. The fact that these are inaccurate account information means that you, this credit-reporting agency, are reporting incorrect accounts. Finally, you are reporting the INQUIRIES that are the result of the same type of fraudulent activities. It must be noted that I did not apply for credit accounts with the below-listed companies and creditors, some of these are the result of attempts to open accounts, but the companies did not approve the accounts. Therefore, these inquiries must be deleted from within my credit file. You can not delete the fraudulently opened accounts without also deleting the fraudulent inquiries. It should be noted that an inquiry that was not made by me is not a factual record, just as a fraudulently opened account is not a factual record and not referred to the creditor to be disputed directly with them. The credit reporting agencies have attempted to address an inquiry as a factual record of file access, but if it was done through fraudulent means, it is not a factual record. As a consumer I should not be required to dispute each fraudulent inquiry directly with each company. These inquiries are the result of fraudulent activity and therefore, inaccurate in which the credit reporting agencies or the creditors can not verify, meaning that these inquiries are unverifiable information and must be deleted from out go my credit files. 1. NATIONAL CREDIT SYST bal. {$2500.00} I am well aware of my rights as a consumer. The Fair Credit Reporting Act requires that you, the credit-reporting agency report accurate and/or correct account information within my credit file. My credit issues are very specific, these accounts and/or items do not belong to me. This means that you are reporting incorrect account information within my credit report. It is this in mind that I request that these listed accounts and items be Blocked and Deleted. According to the Fair Credit Reporting Act FCRA, Section 1681c ( 2 ) Block of information resulting from identity-theft. 1.Block. Except as otherwise provided in this section, a consumer reporting shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity-theft, not later than four ( 4 ) business days after the date receipt by such agency of 1. Appropriate proof of identity of the consumer ; 2. A copy of an identity theft report 3. The identification of such information by the consumer ; and 4. A statement by the consumer that the information relating to the transaction by the consumer. I have provided all of the above listed four ( 4 ) items within this package. Therefore, I expect these listed accounts to be deleted and blocked within ( 4 ) business days. This is clearly an identity theft issue. I am also entitled to receive a free copy of my credit report, so I am requesting a free credit report and that all of these accounts, public records items, and inquiries be permanently blocked and deleted. I have sent them a Validation of Debt in XX/XX/XXXX they responded on XX/XX/XXXX with a letter stating they have yet to find sufficient evidence to validate this debt, the only thing they attached was a bill this could have been from any where my signature is no where on a print out, they have continue to report this debt to XXXX.I have also continued to write XXXX to let them know this company will not validate this debt to remove from credit.
