Issue: Attempts to collect debt not owed

Subissue: Debt is not yours

Consumer Complaint: XXXX Physically signed a letter with the apartment complex itemizing what I was paying for which included a garage. This was for a short-term lease ( 9 months ) XXXX Apartment sold and under new management XXXX XXXX Moved out of an apartment after paying for the full month back in XXXX XXXX Email response to the new management to their claim that I owed an additional {$380.00} XXXX Notified by National Credit Systems that the alleged debt is now under collections XXXX Letter to NCS regarding their information appears fraudulent and I disputed its accuracy. That agreement showed no garage was being rented. XXXX Notified by XXXX that they are reporting this ( disputed ) collection in my credit report. XXXX Talked to XXXX about this disputed issue being reported. I was told they blindly accept any agency 's claim as being truthful and accurate. They bare no responsibility to even ask if claim is disputed. My attempts to talk to NCS about results in the same way, they ask if I am going to pay or not. I told them " no it is a disputed claim '' and they immediately hang up. They refuse to listen as to why. In my opinion NCS is using the credit reporting agency as leverage to force payment ( bullying ). And XXXX has no idea what records the agency is withholding from them such as the consumer is disputing this claim. They blindly trust the agencies as the claim is both accurate and not contested. ALL Credit Reporting Agency 's must take a simple step to ensure the claim being reported to them is not being contested by the consumer by simply asking that very question. Truth and Accuracy matter.

Issue: Communication tactics

Subissue: You told them to stop contacting you, but they keep trying

Consumer Complaint: Good Evening, I am complaining against NATIONAL CREDIT SYSTEM for using depictive tactics to collect a doubt that I was never notified of until more than a year and a half later on an apartment. Back ground : I resided at XXXX XXXX XXXX for 4 months in XXXX XXXX for an internship. I moved out on XX/XX/XXXX. I turned my keys in then. Electricity was turned off as well. I forwarded the mail in case there was any bills. I never received a notice of any past due items from the apartment, as required by the Tax law ( XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX page 20 ). I since then moved to XXXX to work at the XXXX, and during telework I received a call ( on XXXX ) saying that I was in collections from National Credit system using a Florida number ( XXXX ) XXXX for an XXXX company. On the XX/XX/XXXX call after being told that they did not have to prove that the date was correct ( XXXX ) for the move out, I told the collections company to only contact me through the mail. They have since contacted me from the Florida As stated on the phone with XXXX XXXX on XX/XX/XXXX, I contest these charges. I gave notification on XXXX that I was moving out in 30 days. I actually turned in my keys on XX/XX/XXXX, before I had a job interview at XXXX. I paid rent completely through XX/XX/XXXX ( attachment 1 ). At that point all fees associated with normal day to day living ( for all previous months ) had been covered. The fees that are being charges are padded and I told XXXX XXXX on XXXX that. Case in point, On XX/XX/XXXX I received an email ( from XXXX XXXX ) saying I owed until XX/XX/XXXX, in which I responded back that I only owe 30 days since I was not under a lease. I also asked for a prorated cost of the 5 days and never received a response ( attachment XXXX ). I will not pay a late fee associated with this since the request for a prorated bill was requested beforehand. I dispute all charges, including charges such as a VCR. XX/XX/XXXX does coincide with the date I stopped electrical service. With the charge from XXXX stopping the Monday after I moved out, this does give evidence that the Landlord knew I was no longer residing at the residence and notice the electricity was in their name. Which they did not legally This bill has been padded and is not correct. As I told them on the call. I also submitted my contestation of the debt to the email account that they used. Besides the business trying to collect a debt they are not legally able to, I believe they are using deceptive practices ( numbers from outside of their state ), not allowing email communication even thought they verified the debt through email, and

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: Since XXXX XXXX I have file 4 disputes with XXXX and 2 CFPB disputes with National Credit systems no no avail. XXXX AND NCS despite legal court documentation ( court dismissal with no money owed to XXXX XXXX XXXX ) and attached providing rental history directly from the original creditor stating there is no money owed since XX/XX/XXXX to XX/XX/XXXX ( move out dates ) and a surety bond paid out to the original creditor, they decided to record to all credit bureaus since XXXX that I still owe money to XXXX XXXX XXXX. After multiple disputes to XXXX the continue to close and delete disputes as NCS is providing valid information. This is my final attempt to both XXXX and NCS to remove incorrect account information from my credit profiles. I have yet to receive any response from NCS and XXXX refuses to acknowledge all legal documentation that goes against FCRA regulations.

Issue: Incorrect information on your report

Subissue: Public record information inaccurate

Consumer Complaint: I applied for an apartment at XXXX XXXX. I paid the required application fee. A few weeks later I was notified that my bank frauded the amount out because they assumed it was fraud. I immediately had them to reverse the charges and send that payment back to XXXX XXXX. I received a credit alert stating they had sent this information over to collections and it now on my credit under National Credit Systems pending payment. This is inaccurate reporting information since I paid them. I have even reached out to the collection department and also sent them a copy of the documents. Please see attachment below.

Issue: False statements or representation

Subissue: Attempted to collect wrong amount

Consumer Complaint: My wife and I resided at XXXX XXXX XXXX between XXXX & XXXX. Shortly after moving in we started getting charged with all these hidden fees like paying a monthly charge for a garage that we didn't have and didn't exsit. We were being evicted and we went to court. We had already found a place and was scheduled to move in XX/XX/XXXX. Before hearing our case the Judge had us talk to XXXX XXXX lawyer to see if we could reach an agreement. We agreed to pay the last two months rent we old and court cost. After we moved XXXX XXXX sent us this rediculous itamized bill for well over {$9000.00} and turned it over to collections National Credit Systems. I disputed the charges with XXXX credit bureau and won the dispute. Now National Credit System has been sending me threating letters saying they're authorized to settle for half the {$9000.00} or they gon na send it back to the credit bureau

Issue: Written notification about debt

Subissue: Didn't receive notice of right to dispute

Consumer Complaint: Not only do I not know what debt they are referring to, or what it is for, they have violated my rights as a consumer. Pursuant to the FDCPA, specifically 15 USC 1692g, it states : Within 5 days after the initial communication with a consumer in connection with a collection of any debt, a debt collector SHALL, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer written notice containing the - ( 1 ) the amount of the debt ; ( 2 ) the name of the creditor to whom the debt is owed ; ( 3 ) a statement that unless the consumer, within 30 days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed valid by the debt collector ; ( 4 ) a statement that if the consumer notifies the debt collector in writing within the thirty_day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt and ( 5 ) a statement that, upon the consumers request with the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor. This company has not provided 3-5 and therefore, is in violation of the law. Not only did they not include it on the initial communication, they failed to send it within the 5 days. This is a clear violation of the law and is not equitable or fair to me, the consumer, in which they are claiming the deb is owed.

Issue: False statements or representation

Subissue: Attempted to collect wrong amount

Consumer Complaint: On XX/XX/30, I attempted to resolve a debt, {$7400.00}, with National Credit System. When I called, they stated that the calls were recorded, quite clearly. I spoke to a gentleman who said his name was XXXX XXXX. He stated that my debt was {$7400.00}. I then asked if we could compromise for an amount of {$6500.00} and make payments. He refused. He said it would have to be a lump sum payment. I told him that we do not have that type of money. This is a refusal. He then offered {$4500.00} if it were a lump sum. I again, because he is so special, told him that we do not have that kind of money laying around. Then Mr. XXXX stated that even if I make payments to them that it does not get reported to the credit beaureaus at all unless its paid in full. Then Mr. XXXX stated that my " Rental Bureau '' report would not show anything of payments unless its paid in full. This is false statements and economic terrorism. XXXX shows payment history on their site for this particular debt, as does the other bureaus- XXXX , XXXX . This company shows no payments being made for each and every single month since the debt was placed with this company. Economic destruction threats. Statements made by Mr. XXXX. This company is allowing their employees to coerce and make false and misleading statements to consumers. According to their own intake call messages, all calls are recorded. I attempted to negotiate in good faith. I explained that I could file bankruptcy instead of making an offer. He was not swayed and refused to work with me in any tangible way. The complaint against this company is that the person, I believe used a false name as it was, made false statements and representations in a bad faith attempt at collecting a debt. I made a {$20.00} payment to see if I even get a receipt to prove payment. Still have not gotten a receipt, at all, to which Mr. XXXX stated would be received. Then this company first shows a {$11.00} fee, a " convenience '' fee, to pay by debit card. Then when you run the card, it charges you {$4.00}. Why am I being charged for running a card even? In closing, this company and its representatives are fraudulent in their statements and can not be trusted to follow the laws as outlined.
