Consumer Complaint: In 2018, I was the XXXX of XXXX. My bank at that time, Key Bank, did not allow me to submit a written statement of the crime. The perpetrator, XXXX XXXX, of a bed and breakfast I visited briefly, submitted false evidence to key bank, made libelous, false claims to my bank. She also filed a false police report with the XXXX XXXX XXXX, CA, after submitting the libelous information in writing to my bank. She charged my debit card, without permission, demanded cash, which I refused. I also wrote her a check while the debit card dispute was pending, which she also deposited and collected. Key Bank, ruled against me in the dispute. I paid for the bed and breakfast more than twice what I owed. Key Bank participated in this fraud on my money and account, by allowing the perpetrator of the fraud to submit several pages of false information, and not allowing me to submit a statement to my own bank, of the details of the crime. I was never allowed to submit my written statement of events, at any point to Key Bank. This claim of me owing money is completely false, as I was the victim of fraud. Key bank actually owes me money!

Consumer Complaint: This is XXXX XXXX, we recently purchased a new home ( XXXX XXXX XXXX, XXXX XXXX, CA, XXXX ) and chose Keybank as our lender ( loan agent : XXXX XXXX ). Our loan was closed on XXXX/XXXX/2020, but we are really disappointed in the process, I will briefly introduce the problems here. 1. We initiated a loan process with you with the interest rate of 1.875 % and loan credit of {$2500.00} on XXXX XXXX ( see attachment 1 ). I was told I could only work with you because you didn't want to waste your time ( see attachment 2 ). And you said you could deliver the loan 100 % ( see attachment 2 ). I paid {$500.00} in front to start the loan process. 2. The first CD was out, I pointed out the loan credit is wrong, and you confirmed the loan credit was approved and would be applied later ( see email screenshot 1 ). 3. When we started the loan process, we put XX/XX/XXXX as the appraisal date. We said no rush for the appraisal because we were still in the negotiation with the seller about the fence encroachment. You said we could rush it if we need to ( see attachment 3 ). 4. On XXXX XXXX, my agent XXXX brought some concerns that it was hard to order the appraisal at holiday season ( see attachment 4 ), and wanted to rush order it, and you said you rushed ordered it, and later you said the appraisal was moved to XX/XX/XXXX ( see attachment 5 ). You informed all agents ( buyer/seller ) and me that we could close on XXXX XXXX. On XXXX, we signed an addendum with the seller after we reached an agreement with the seller. And put the new close date as XXXX XXXX. We emailed you the addendum the same day, and our agents informed you too, you were ok with that ( see email screenshot 2 and 3 ). 5. I asked if you have already ordered it after my agent said she hadn't heard back from the appraiser on XXXX XXXX and XXXX, I got no response ( see attachment 6 ). I called to confirm the appraisal was ordered because my agent didn't hear anything from the appraiser, and you said something went wrong that you need to check it out, you will call me back later that day. But no update on that day. 6. On XXXX XXXX, you told us that we couldn't move up the appraisal, which caused our delay penalty ( see email forwarded ). 7. On XXXX XXXX, you first brought up that the loan credit promised ( {$2500.00} ) may not happen. Key points : 1. Damages : We need to pay the sellers PITI as the delay penalty, which is {$140.00} per day for 6 days. XXXX informed buyer and seller agents of a wrong closing date. And despite many inquiries about the closing date from the agents and me, XXXX didn't mention the closing date was wrong until the last minute and thus the delay. 2. Loan fraud : We didn't get the promised loan credit of {$2500.00}, which was the dealbreaker that we chose keybank and turned down other applications, it violated " The benefit of the bargain rule '', ( Stout v. Tourney ( 1978 ) 22 Cal. 3d 718, 725-27 ). We were not informed the loan credit was uncertain until near closing date. I feel this may also violate the TILA ( truth in lending act ).

Consumer Complaint: On XX/XX/XXXX I made a phone payment in the amount of {$750.00} to my mortgage servicer, KeyBank. On XX/XX/XXXX, I saw that the payment overdrew my account at XXXX XXXX XXXX where my checking account exists ( my direct deposit from my job hit my account on XX/XX/XXXX which caused the overdraft for the payment ). I immediately called KeyBank and advised them of the insufficient funds and ASKED MORE THAN ONCE if they automatically try to RESUBMIT THE PAYMENT FOR THE {$750.00}. I was told " KeyBank WILL NOT GO BACK INTO THE ACCOUNT, RESUBMITTING THE PAYMENT. '' I was concerned if I made another payment and this was incorrect, my XXXX account would be overdrawn because I had other items scheduled to be taken out of my checking account that normally come out during the first week of every month. After the representative made clear that there would not be a second attempt to get the payment, and me not wanting to have an outstanding amount owing, I made another payment with my checking account with the representative at that very moment on XX/XX/XXXX. On the very next business day, XX/XX/XXXX, my account was negative for TWO PAYMENTS of {$750.00}. I left work early after making an appointment with XXXX XXXX to try to get the double payment reversed and at the same time called KeyBank to explain what happened to see if in fact my bank could not reverse the error IF THEY COULD AS A RESULT OF THEIR ERROR REFUND ME MY {$750.00}. While they apologized for the incorrect information I was told because they do and did make the 2nd attempt and collected a double payment, I was told they could keep the payment for XXXX OR SEND ME A CHECK AFTER THEY LOOKED INTO IT WHICH WOULD TAKE SOME TIME. This was not acceptable. My bank worked with me and said they could TRY to reverse the payment and refund A service fee, however, I had other items that were going to post which would cause more than one overdraft fee, which is what has happened since XX/XX/XXXX UP TO THE WRITING OF THIS COMPLAINT XX/XX/XXXX. I received more incorrect information after calling KEYBANK again to ask for a refund and was told THEY DO NOT REFUND OVERPAYMENTS. My account is SEVERELY OVERDRAWN and XXXX XXXX XXXX can not overturn " multiple reversal/return fees and overdrafts '' which are 100 % KeyBank 's responsibility for going into my account on multiple occasions. My checking account is ruins. I met with the General Manager of XXXX XXXX who tried very hard to help me, but a lot is out of his hand. There are notes on both accounts that outline this entire fiasco. PLEASE HELP ME!

In addition to this, KeyBank held my paycheck that was to be applied in XX/XX/XXXX until XX/XX/XXXX which cause overdraft. I confirmed with my employer that the payment date was XX/XX/XXXX due to the pay date falling on a holiday ( XX/XX/XXXX ). I contacted KeyBank several times and they stated it was dated the XXXX, which is not true. So in addition to the overdraft that is now being resolved as my paycheck was applied today ( XX/XX/XXXX ), I still do not have the stimulus applied. It is dated the XXXX and should be applied today. There are numerous people that have received theirs, but mine has not been applied.

KeyBank can not give their customers proper answers as to when their stimulus checks will post, despite telling myself and multiple other customers that they would post on XX/XX/XXXX at XXXX XXXX. Furthermore, the IRS indicates that my payment was sent to Keybank and KeyBank has refused to post that deposit, but they have been posting numerous debits that are also dated XX/XX/XXXX.
