Issue: Improper use of your report

Subissue: Credit inquiries on your report that you don't recognize

Consumer Complaint: After pulling my XXXX credit report back in XXXX, I noticed that Key Bank pulled my credit for some unknown reason on XX/XX/2022. Outraged, I called Key Bank to voice my concern. That call was placed to Key Bank on XX/XX/2022. The associate I talked to at that time, XXXX, assured me that the inquiry would be removed by Key Bank. Over two months later, it still remains. It must be removed immediately as it is causing me undue hardship.I had no interest in Key Bank credit products then, and will not have interest moving forward.

Issue: Managing an account

Subissue: Problem using a debit or ATM card

Consumer Complaint: On XX/XX/XXXX I had my card stolen and my information stolen through phishing. I was on a trip ( on a cruise ) without communication so I couldnt reach the bank. I dont tend to use my Key Bank account much because its not my primary account. I thought everything was okay since I wasnt receiving any type of texts about my account ( someone turned it off ). On XX/XX/XXXX I got an email from key bank and a text of the fraud department saying that someone was trying to buy something and they sent a text to confirm if it was me because the purchase I was suspicious. I said no and I called to see what was happening. As soon as I got home I called them and I saw that my account has been used for a LOT OF THINGS without my permission and that my debit card had a lot of unauthorized purchases. I tried to dispute and I asked for a replacement card and it happened again with the new card ( with some XXXX XXXX purchases online ). The agent told me that XXXX has something called updated payment and even if you use your old card and even if its closed and canceled, XXXX updates your new information ( the new card ) to the older one, and someone was able to use it again online, so the representative had to make a HARD CLOSE and cancel my card completely and sent a NEW ONE. Its a complete headache. Then, I had my case DENIED, after explaining that I had my card stolen, and someone stole my information online and used my card multiple times. Keybank took more than XXXX dollars out of my account without CONSENT ; they didnt call, they didnt send me an email, they didnt communicate with me. Thats illegal. If you report the loss of a credit card before its used, you can not be held responsible for any unauthorized charges. If a thief uses your card before you report it missing, the most youll owe for unauthorized charges is {$50.00} per card. Thats what the law says. So Ill gladly sue them if they dont fix this because I was the victim.

Issue: Trouble during payment process

Subissue:

Consumer Complaint: We had our day in court today concerning the filed CFPB case.with Keybank XXXX this information is associated with that filed claim. I think this can build support for our original complaint concerning the KeyBank representing lawyer, deception and Potential corruption. I do Hope for help from Keybank ASAP because we now have a three day eviction notice. We also hope for help from the CFPB or any other federal entities to avoid the 3 day court ordered eviction. Here is what occurred with the Keybank representing lawyer.. First, we pointed out in our conversation with keybank and the prior filing the conflict of interest in having a lawyer for the bank also represent the builder. They approached a fix to this conflict by hiring a different lawyer and using the Keybank Lawyer as a witness. This was beneficial to providing support for the scam/fraud/corruption claim. The testimony provided by the Keybank lawyer showed contradiction and deception under oaths This hearing was recorded. It was explained in detail the effort to post a notice of sale via affidavit. They keybank Lawyer explained that as well as having no recollection of a XXXX Notice being placed and the XXXX notice was the one that mattered anyways that would indicate only one notice. We had received two notices not one. One placed in XXXX, signed but dated XXXX. The other was posted in XXXX, both were dated XX/XX/2022. Copies provided. Why would a lawyer with XXXX foreclosures and XXXX reversals do this? The one from XXXX was extremely suspicious to us because it was the day after we made our first trial payment with XXXX. We then immediately contacted the number on the Notice, the KeyBank Lawyer. We were told the Foreclosure and Sell had been canceled. Looking at the evidence pack provided by the Keybank team, there was one notice with the appropriate accompanied XXXX affidavit. But we had received two both dated the same date, ( copies provided ). Looking further in the near Chronolgically ordered evidence pack. There was another one, with no affidavit and it is dated XX/XX/2022. The same date. Why would it not be placed by the other document? It had to be included in case we had both of ours, they would not want to withhold evidence but again distance it from the other that had an affidavit. Two by each other with only one affidavit would draw attention as well as two near each other dated the same. The two originals were stuck on our door at two different times ( attached ). One in XXXX, signed, No afidavit. The other in XXXX, signed with affidavit. Why would you sign one that had an XXXX date on it and put it on the door of someone in XXXX with no affidavit? We have both originals that were stuck to our door. One in XXXX that was not remembered by the Keybank Lawyer but dated XXXX it had with no affidavit and then the one in XXXX with an affidavit. How many times had this trick and deception been applied to homeowners to force them into bankruptcy to avoid it or to give them their home under deceptive pretense. The Keybank lawyer made specific note as to most petiole file bankruptcy right before. If this is the case does this type of confusion and deception not press people into undue situations that they may have avoided or handled differently?

Issue: Improper use of your report

Subissue: Credit inquiries on your report that you don't recognize

Consumer Complaint: I applied for a mortgage for a purchase of a home with XXXX XXXX XXXX Mortgage Loan Officer NMLS # XXXX at XXXX. 3 Months after my loans was closed I received an email from my credit monitoring app that my credit was pulled again by XXXX XXXX in XXXX. I contacted XXXX right away ( XX/XX/XXXX ) and was informed that there was a system glitch and that company pull a credit on already closed loans and mine was one of the. Not only my credit was pulled with no authorization but all my info was sold to mortgage companies and I have been getting telemarketing calls every day. He insured me that they are in process of fixing it and I should see that reflected in my credit shortly. Since then, I followed up with XXXX on XXXX, XXXX and XX/XX/XXXX with no response. I also called mortgage servicing line with no resolution, since they asked me to go back to my loan officer. Apparently Key Bank that owns the XXXX XXXX Mortgage firm can just pull a credit on any closed files, with no authorization and not follow up with their clients to fix the issue.

Subissue: Cashing a check

Consumer Complaint: On XX/XX/XXXX Key Bank NA processed a check that was dated XXXX XXXX XXXX which was then sent through our Bank XXXX XXXX XXXX. I spent XXXX years in the banking industry and realize that XXXX processes what they receive on the Fed file and the issue is with Key Bank XXXX I contacted XXXX Bank customer service and they transferred me to a local branch in XXXX XXXX The branch rep I talked to could not ( would not ) tell me which branch processed the check or what their policies were on stale dated checks. My wife has a XXXX person interior design business, XXXX XXXX XXXXXXXX, and the records do not go back to XXXX. My banking experience tells me that most organizations will not process checks over 180 days old. My other concern is for expiring stop payment orders... do I need to close my checking account for fear other stale dated checks may be processed without warning? Thank you for reviewing this matter.

Issue: Problem with a lender or other company charging your account

Subissue: Transaction was not authorized

Consumer Complaint: Revoked my ach authorization from the company sezzle in mid XXXX. XXXX weeks later my wallet was stolen and I ordered a new debit card from my bank with a different card number because of the theft. Wake up this morning, XX/XX/XXXX, to several XXXX dollars drained from my account by XXXX Contacted the bank and the bank told me, without my permission, gave XXXX my new debit card number and XXXX used it to overcharge my bank account by hundreds. Contacted key and was told they gave XXXX my new debit card number because I have had buisness with XXXX in the past. Both companies are breaking federal law by not acknowledging my XXXX authorization letter and key is breaking privacy laws by giving my debit card information to whomever calls and asks for it.

Subissue: Didn't receive terms that were advertised

Consumer Complaint: On or about XXXX XXXX XXXX I was provided with a reward code from KeyBank for opening checking account ( reward code XXXX in the amount of {$200.00} dollars ). I also received a second reward code XXXX, in the month of XXXX XXXX XXXX, for opening a savings account in the amount of {$50.00} dollars. KeyBank had failed to comply with their advertising ads upon opening the accounts which I complied with their requirements to receive the rewards. However, due to KeyBank 's failure to process the reward code. I had to close the first checking account and request that the reward code be applied to the second opening of the checking account. Upon requiring about KeyBank, failure to process the reward code to the first opening of the checking account nor the reopening of the second checking account refused to comply with their advertising requirements nor complied to reward me for opening the saving account which had no issues. I stated that all requirements were met with checking account and saving account upon opening.

Issue: Charged fees or interest you didn't expect

Subissue:

Consumer Complaint: On XX/XX/XXXX I wrote a check for {$2000.00} to a business from my KeyBank Personal Line of Credit. On XX/XX/XXXX, this check was erroneously drawn against my line of credit by KeyBank for {$3000.00}. I received my periodic statement reflecting this error from KeyBank on XX/XX/XXXX ( statement attached ), but only noticed this error while reviewing my financial statements on XX/XX/XXXX. I called KeyBank on XX/XX/XXXX and spoke to a representative regarding this error. They pulled up a scanned image of the check and confirmed that a clerical error had been made and promised that this would be corrected within 3 business days. Adding an additional day to account for the XXXX XXXX XXXX, they promised that this error would be corrected and the funds returned to my credit line by Thursday, XX/XX/XXXX. I did not see any correction or refund and hence called KeyBank again on XX/XX/XXXX. The representative apologized for the delay, said the error correction was still in progress, and I should see the funds returned ( at least provisionally ) by the following business day, Friday XX/XX/XXXX, and that I would receive a call back confirming this. Neither of these things happened neither the funds being returned ( even provisionally ) nor receiving a call back. I called KeyBank again on XX/XX/XXXX and informed the representative that they were in violation of CFPB regulation 1005.11 ( c ) ( 1 ) concerning the relevant time limits on confirmed error corrections ( 10-days ). The regulations do allow for 45-days in exceptional circumstances but nevertheless the bank must provisionally correct the error once acknowledged within the original 10-day period. KeyBank has not even provisionally corrected the error and the additional {$1000.00} erroneous charge continues to accrue interest.
