Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Their investigation did not fix an error on your report

Consumer Complaint: For months this company has been reporting inaccurate, unverifiable erroneous things on my credit report and ruining my credit score and I am sick of it. This company has ruined my credit score so bad I got denied a loan for my house!! Now I can not provide for my family because of these derogatory marks. These medical bills and other derogatory collection accounts listed on my credit report, are incorrect and NOT mine. Simply verifying that someone used my name, social security number and/or address is insufficient to confirm that I am the person in question and owe this debt. The court has ruled that in Hinkle v. Midland Credit Management , Inc., that during a dispute and subsequent investigation with the original creditor, collector or a credit bureau, that the original creditor or collector, must provide account-level documentation that would hold up when presented to a jury. That means an original contract or similar proof. To this end, I am demanding an itemized bill to include but not limited to : The diagnosis and procedure performed that I am being billed for, Dates of said procedure, Cost of any medication you may have provided, Cost of any medical devices you may have provided, Office Visits, Consultations, Hospital Visits, Misc. As I am not the person who owes this bill, I am aware that providing the information requested may lead to third party disclosure : a HIPAA violation. That would be your problem and not mines, as a consumer. And per the FCRA and FCPA, I am not required to complete a police report since the burden to prove the debt is on you. In addition, a provision of the FACTA regulations is the Notice of Negative Information provision, covered in section 623 ( A ) ( 7 ). I have never received notification that this had been or was going to be listed with a credit reporting agency. FACTA ( Fair and Accurate Credit Transactions Act ) requires creditors, including doctors and hospitals, to give the consumer a warning notice, so the matter can be addressed before a negative item such as this is reported in error. I am also requesting a copy of your in-house procedures that enable you to avoid the problems that lead to improper identification of consumers and the subsequent misreporting to the credit bureaus. In lieu of supplying the information Im demanding, you can simply stop all collection activity, including but not limited to removing this item from all credit bureaus to which it has been reported. If this is not done within 30 days of receipt of this letter, I will proceed to exercise all my legal rights, including litigation, to protect my good name. A response with a bill is NOT evidence of proof that the debt is mine. Anyone can open an account under my name for which a bill is produced, but that doesn't mean it was actually me or that the debt is actually mine. I need real evidence. This evidence consists of a contract from the original creditor or some agreement bearing MY written signature agreeing to pay the debt. In the absence of this evidence I ask you to please remove this account from my credit report.

Issue: Incorrect information on your report

Subissue: Information belongs to someone else

Consumer Complaint: I called IC Systems collection agency at XXXX on XX/XX/2020 around XXXX EST in regards to a collection debt that just appeared on my XXXX report. I spoke with a rep name XXXX who provided a reference number XXXX by just looking up my name, which is a common name ; who then transferred me to another rep and advised her name was XXXX XXXX. Ms. XXXX proceeded to ask for my last four of my SSN which I was not comfortable providing her ; so I gave her my full name and date of birth and my current address. She stated she did not have the address I provided on the file she was looking at and I advised her per the FDCPA I have the right to receive validation of this fraudulent debt they are trying to collect on and to please send me a copy of the following : **An explanation of what this alleged account balance is for ; **A calculation of this balance, including the complete payment history on this account so I have proof of the amount ; **Documentation showing I agreed to pay this debt ; **The agreement that grants IC Systems authority to collect on this alleged debt and a copy of their state license, including license number. Ms. XXXX stated they are not providing me with any documentation. I advised her I was never notified of this collection and that this debt was not accurate and not mines. If they are unable to validate this debt they will need to remove this collection from my report. Today XX/XX/2020 IC Systems decides to report the same collection information on my XXXX report under : XXXX XXXX XXXX. Issue: Improper use of your report

Subissue: Reporting company used your report improperly

Consumer Complaint: On XX/XX/2020, I sent a third party debt validation letter to I.C. Systems, Inc. requesting any contractual agreement between me and their agency and to this date no proof of validation has been submitted to me as demanded. I have never done any business with this agency nor do I wish to do so. The alleged debt has a fraudulent charge amount associated with the account. By law pursuant to 15 U.S.C. section 1681 s-2 of the Fair Credit Reporting Act ( FCRA ), I.C. Systems, Inc., has failed to validate the this alleged debt in the allotted ( 30 ) day time frame pursuant to 15 U.S.C. 1681 ( g ) ( d ). They have NO signed contract with my signature stating that I gave them ANY permission to access my credit reports which is a violation pursuant to 15 U.S.C. section 1681b.

Issue: False statements or representation

Subissue: Attempted to collect wrong amount

Consumer Complaint: I received notification of settlement to resolve a debt from IC System. On XX/XX/2020 I went online, entered the reference # XXXX noted on the offer and paid the amount offered to resolve the debt. ( XXXX toward a principal of XXXX ) A few days later I followed up online and the debt did not reflect my payment. I called customer service and assured them the payment cleared my account and gave them the confirmation # I received upon payment. After a moment, the representative stated the payment was applied to a different account. An account to which I had no knowledge. The account to which the payment was applied had time-barred debt. I believe the company knowingly mis-applied the payment in order to reset the statute of limitations on the old debt I was not aware of, in order to hold me liable for set time-barred account.
