Consumer Complaint: It was never disclosed to me upon our agreement that I had the right to opt in or opt out of my personal information being shared with a third party. In pursuant to title 15 U.S.C. 1681b ( a ) ( 2 ) any information placed on my Consumer report should be based in accordance with the written instructions of the consumer to whom it relates. I the natural person have been suffering for years by being denied open-ended credit, and car loans for the enjoyment of my family. Per the FCRA as a federally protected consumer I XXXX XXXX XXXX am OPTING OUT of any and all authorizations I the consumer may have given you written, non written verbal and non verbal PER 15 USC 6802, EFFECTIVE IMMEDIATELY INDEFINITELY. The law also states it's illegal to report transaction history. Title 12 Also states anything dealing with a securities is an automatic Federal Court Case. 12 CFR 1016.4 Initial privacy notice to consumers required. ( a ) Initial notice requirement. You must provide a clear and conspicuous notice that accurately reflects your privacy policies and practices to : ( 1 ) Customer. An individual who becomes your customer, not later than when you establish a customer relationship, except as provided in paragraph ( e ) of this section; and ( 2 ) Consumer. A consumer, before you disclose any nonpublic personal information about the consumer to any nonaffiliated third party, 12 CFR 1016.7 Form of opt out notice to consumers ; opt out methods. Section ( a ) ( 1 ) Form of opt out notice. If you are required to provide an opt out notice under 1016.10 ( a ), you must provide a clear and conspicuous notice to each of your consumers that accurately explains the right to opt out under that section. Consumer Complaint: Heres a letter Ive used in the past : Subject : Complaint against XXXX Dear Consumer Financial Protection Bureau, I am writing this formal complaint against XXXX in hopes of seeking resolution regarding the reporting of negative claims on my consumer credit profile. I believe that certain claims have been inadequately or un-demonstratedly asserted, and I am deeply concerned about the accuracy and integrity of their reporting practices. My primary complaints are as follows : XXXX. Failure to Ensure Accurate Reporting : I firmly believe that XXXX has not taken adequate measures to ensure that my consumer credit report profile is reported factually, ethically, and in compliance with federally-defined timeliness. The reporting should also be physically verifiable and validated, adhering to the mandatorily utilized Metro2 Data-filled Field Formatted Reporting Standards without any omissions or deviations. Deviation from Established Reporting Standards : Based on my understanding of CDIA 's CRRG manual ( see CRRG 3-4 ), any deviation from the Metro2 standards jeopardizes the integrity of the data. '' ( XXXX XXXX XXXX ) the financial institution and the Consumer reporting agencies XXXX, Experian, and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, Experian, and XXXX, ( XXXX XXXX XXXX ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( XXXX XXXX XXXX ) Never informed me of my right to exercise my nondisclosure option.15 U.S.C 6805 states ( a ) In general Subject to subtitle B of the Consumer Protection Act of 2010 [ 12 U.S.C 5511 et seq. ], this subchapter and the regulations prescribed thereunder shall be enforced by the Bureau of Consumer Financial Protection, the Federal functional regulators, the State insurance authorities, and the Federal Trade Commission with respect to financial institutions and other persons subject to their jurisdiction under applicable law, as follows : ( 8 ) Under subtitle E of the Consumer Financial Protection Act of 2010 [ 12 U.S.C. 5561 et seq. ], by the Bureau of Consumer Financial Protection, in the case of any financial institution and other covered person or service provider that is subject to the jurisdiction of the Bureau and any person subject to this subchapter, but not with respect to the standards under section 6801 of this title. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. Consumer Complaint: I was looking at my report and notice that were some things that was not correct. I sent a letter to Experian on XX/XX/2024 here is my tracking number XXXX. It has been more than 30 days since the credit bureaus have not responded. That is a violation 15 USC 1681i ( a ) ( 1 ) ( A ). According to 15USC 1681e ( b ) it states this ( b ) accuracy of report. Whenever a consumer reporting agency prepares a consumer report it shall follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates. So then I ask them to provide a description of the investigation according to 15 USC 1681 i ( 7 ) ; ( 7 ) description of reinvestigation procedure. A consumer reporting agency shall provide a description referred to as paragraph ( 6 ) ( B ) ( iii ) no later than 15 days after receiving a request from the consumer regarding the description But they did not do that as well. According to 15 USC 1681s-2 it states that A. ) Reporting information with actual knowledge of errors. A person shall not furnish any information relating to a consumer. Any reporting information agency must have reasonable cause. B ) Reporting information after a notice and confirmation of errors. If the person has been notified by the consumers, that specific information is inaccurate. This is unfair and if they are doing this to me can you imagine who else they are doing this to? Can you fix
