Consumer Complaint: Since XX/XX/XXXX I have been going back and forth with XXXX XXXX and experian about a missing account that was affecting my account and hindering my life. There is inaccurate and missing information on my credit report but ONLY with experian. I have a XXXX XXXX credit card with a limit of {$6700.00} since XXXX and it is not being accounted for on my account which is affecting my score and my credit utilization percent drastically. I have notified both of them and both companies have been telling me different things and putting the blame on one another. They told me they are reporting my information to every credit bureau and it is not a fraud account. I was told to write a letter and provide information to proof I was who I was multiple times and even when disputed they have stated that my issue has been resolved but the issue is still not resolved. I was then told today, XX/XX/XXXX by experian that there is nothing that they can do that this is a XXXX XXXXXXXX issue even though I have a written letter from XXXX XXXX stating they are reporting to all three credit bureaus.

Consumer Complaint: According to the FCRA 15 USC 1681 section 602 says that consumer reporting agencies have a responsibility to report fair and accurate information with respect to the consumers RIGHT TO PRIVACY. My nonpublic personal information is written all over a public report. XXXX is a financial institution per 15 UCS 1681 section 604 which says that any consumer reporting agency may furnish a consumer report under the following circumstances and no other : " in accordance with written instructions of the consumer to whom it relates. '' XXXX does not have my consent to furnish this information and they absolutely do not have my written consent. The fact that XXXX is ignoring me saying I have a right to privacy that they do not have a right to ignore that and they they continue to violate my rights. XXXX need my consent to furnish information on a consumer report with a likeness to my name any and all consent XXXX in any form ( written, verbal or implied ) is revoked. 15 USC 6802 ( b ) ( c ) states " a financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless -- the consumer i given an explanation of how the consumer can exercise that non disclosure option. '' XXXX never informed me that i had a right to exercise my nondisclosure option. I do not consent to my personal nonpublic information being shared on a public consumer report that anyone with XXXX can obtain. In addition to that 15 USC 1681C says Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information : ( 5 ) Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. This account is clearly in adverse action and they are reporting without my permission which is against the law. Now 15 USC 1681s -- 2 ( A ) ( 1 ) states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 USC 1681e says that " Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. '' XXXX is not maintaining reasonable procedures. They are not removing items while they investigate. Oh yeah, 12 CFR 1016.7 states that i can opt out of reporting services at anytime, and i am opting out of any and all debt collectors reporting to my consumer report.

No proof. Under policy U.S.C 1861i ( B ) Requirements relating to reinsertion of previously deleted material ( i ) Certification of accuracy of information If any information is deleted from a consumers file pursuant to subparagraph ( A ), the information may not be reinserted in the file by the consumer reporting agency unless the person who furnishes the information certifies that the information is complete and accurate. ( ii ) Notice to consumer If any information that has been deleted from a consumers file pursuant to subparagraph ( A ) is reinserted in the file, the consumer reporting agency shall notify the consumer of the reinsertion in writing not later than 5 business days after the reinsertion or, if authorized by the consumer for that purpose, by any other means available to the agency. In compliance with the Fair Credit Reporting Act and as a gesture of respect to the Federal Trade Commission Committee on accuracy and completeness of credit information I am formally writing in today to dispute negative information appearing on my credit. This incorrect information is greatly hindering me from getting the credit score I deserve and hopefully, this letter will resolve all the issues on my credit. I demand to see Verifiable Proof ( an original Consumer Contract with my Signature on it ) of the accounts listed below. Your failure to positively verify these accounts has hurt my ability to obtain credit.
