Potential Violations of Identity Fraud Protection : XXXX XXXX XXXX XXXX XXXX 's failure to adequately verify the legitimacy of the alleged debt may constitute negligent enablement of identity fraud, exposing consumers to potential harm. However, their continued non-compliance necessitates the involvement of the Consumer Financial Protection Bureau to ensure the protection of consumer rights. Consumer Complaint: XXXX XXXX XXXX is reporting inaccurate information in regards to debt I do not owe them and is in violation of the Privacy Act of 1974 and the Fair Credit Report Act. The FCRA states that consumer reporting agencies are responsible for respecting a consumer 's privacy in regards to non-public personal information. Additionally, any information reported must be with the consumers WRITTEN CONSENT per 15 USC 1681 section 604 ( a ) section 2 and the information MUST BE ACCURATE. I have NOT provided XXXXXXXX XXXX XXXXXXXX ANY written consent to publish my information. XXXX XXXX XXXX is in violation of 15 USC 1681 b and c because they are improperly using my consumer report and not meeting information requirement standards in regards to adverse information. In fact XXXX XXXX XXXX is committing identity theft as defined by 12 CFR 1022.3 because they are using my personal information without authority to do so or my consent. By using my personal information without my written consent they are in violation of 5 USC 552a. I have no contract with them and I have never done business with them. I did contact them requesting information to validate the accounts, and provide the original contracts and they have not done so. I have also received notices from 3rd parties which claim to have gotten my information from XXXX XXXX XXXX which is another violation of 15 USC 1681. XXXX XXXX XXXX reports information on accounts XXXX and XXXX I cant verify to Experian, XXXX, and XXXX because they have reported inconsistent data across all 3 of these reporting agencies. I have never paid them anything ( because I do not owe them ) yet they have reported I made a payment on XX/XX/XXXX and that my account is both open and closed. They have been reporting inaccurate information since XX/XX/XXXX and are in violation of 12 CFR 1016.1 as I have received NO OPT out notices. These discrepancies also show that Experian, XXXX, and XXXX are in violation of 15 USC 1681e compliance procedures which requires them to verify information and ensure information reported is accurate. Any and all consent to XXXX, Experian, and XXXX in regards to these accounts whether verbal, non-verbal, written, implied or otherwise is revoked. Lastly, XXXX XXXX XXXX is attempting to collect a debt I do not owe them and on accounts that have been charged off by the original creditor ( XXXX ) Per the IRS charge offs ( the debt associated with those accounts ) are defined as income and income does not get reported on a consumer report. XXXX XXXX XXXX, Experian, XXXX, and XXXX are 3rd parties reporting inaccurate information on my consumer credit report. This problem must be addressed immediately.
