Since Im a stickler for research, I found that under section 605b of the FCRA you are required by law to remove & block any items which is found to be fraud due to identity theft. Consumer Complaint: I am writing to formally dispute the accuracy of information within my consumer report, as provided by your agency. Upon careful examination, I have discovered that undisclosed personal information about me has been shared with a non-affiliated third party without my explicit written consent, potentially violating the regulations outlined in 15 U.S. Code 6802 - Obligations with Respect to Disclosures of Personal Information. As per my understanding of the Fair Credit Reporting Act ( FCRA ), I am entitled to be informed about and control the disclosure of my personal information. The disclosure of such information to a non-affiliated third party raises concerns regarding my privacy rights, as I was not provided the opportunity to opt-out, as mandated by law. After thorough review of the report, I observed that specific accounts are being reported without my written consent. It is important to clarify that my dispute lies not with the creditor but with your reporting agency for disseminating and reporting information without proper authorization. I refer to 15 USC 1681b - Permissible Purpose, which mandates a consumer 's written consent for the reporting of personal information. Currently, I have not provided such written consent, and I kindly request documentation to validate my consent, demonstrating compliance with this legal requirement. Failure to furnish evidence of my consent could be interpreted as a violation of my rights under the FCRA. Additionally, I have lodged a complaint with the Federal Trade Commission ( FTC ) regarding this matter, and the reference number for my complaint is XXXX. I am concerned that the unauthorized disclosure and reporting of my personal information may constitute a violation under 18 USC 1028a, potentially amounting to identity theft. Consumer Complaint: It is disheartening that the Credit Bureaus, namely Experian, XXXX, and XXXX, have failed to remove the persisting fraudulent items from my credit reports over the past three months. The absence of any deletions during this period is particularly concerning as I anticipate another update to my credit report within the next 15 days. Regrettably, there is a sense of apprehension that I might encounter yet another instance of failure to delete these items from my file. I would like to reiterate that, in accordance with FCRA Section 605B ( a ), Credit Reporting Agencies are obligated to remove any items in the file of a consumer identified as information resulting from an alleged identity theft within four business days of receipt.
