Consumer Complaint: I reviewed my consumer reports and noticed that i had one late payment on an account that i was never late for. The consumer reporting agencies have assumed a vital role and have a responsibility to report consumer information to the best of their ability with maximum accuracy. I have never been late on payments for the accounts that i have included screenshot inside this complaint in on dates of ( XXXX ). Please investigate and provide proof with statements showing that these payments were late. Consumer Complaint: I have disputed and reached out to this company on multiple occasions regarding this item that appears on my Experian/XXXX credit report. I have sent multiple debt validation letters requesting specific information listed as follow : CREDITOR/DEBT COLLECTOR DECLARATION Please provide the following : Agreement with your client that grants you the authority to collect on this alleged debt. Agreement that bears the original signature of the alleged debtor wherein he/she agreed to pay the creditor. Original contract with original signature of alleged debtor wherein he/she agreed to terms with creditor. Original contract with original signature wherein he/she agreed to enter into terms to pay debt collector. Any insurance claims been made by any creditor regarding this account. Any Judgments obtained by any creditor regarding this account. Name and address of the alleged creditor. Name on the file of the alleged debtor. Alleged account number. Address on file for the alleged debtor. Amount of alleged debt. Date this alleged debt became payable. Original documents related to repossession notification, notice of delinquency, notice to cure, notice of sale at auction, total amount vehicle sold for at auction, and notice of deficiency/surplus from sale of vehicle at auction. Date of original charge off or delinquency. Verification that this debt was assigned or sold to a collector. Complete accounting of alleged debt/ledger from original creditor. Commission for debt collector if collection efforts are successful. Copy of bond and license to do business in my state and state where alleged debt was acquired. ( This is the bond and license that your company filed with the Secretary of State where the alleged debtor resides. ) This company was also informed that this account with the original creditor was fraudulent and a part of a federally documented identity theft case in which a Federal Affidavit of Identity Theft was provided multiple times. Documentation as it relates to this account was also provided. This case was a part of a criminal case in which the person who stole my identity was prosecuted and sentence to a XXXX XXXX term for this account and several others. This collection agency refuses to remove this item and keeps updating this item on my credit report as to say that I owe this debt. At this point, I have reached out to a Consumer Finance Attorney to fully intend intend to exercise my right sue this collection agency under violating my rights as a consumer under the FCRA and FDCPA, defamation, mental and emotional distress caused by reporting this items falsely, failing to remove inaccurate account of this debt from multiple credit bureau after sufficient proof was given, failure to provide notice of account deletion via postal mail, and wrecking my credit score which resulted in denials for over XXXX from the date they added the account as a debt to all major credit bureaus. I fully intend to follow through with this federal lawsuit. I only asked that they remove the false and erroneous account from my credit report. There direct refusal to provide adequate proof that this debt belongs to me and refusal to remove this account have made it nearly impossible without taking full legal action. This creditor is continuing to report on an account that was fraudulently opened as a result of identity theft. They are violating several laws under the FCRA and FDCPA. My attorney and I will began filing all petitions to pursue a federal lawsuit against XXXX on XX/XX/XXXX in The United States District Court. The information attached shows that XXXX arrested the person who stole my identity. There are multiple police reports and multiple Federal Identity Theft Affidavits that list XXXX as a fraudulent account. You extended credit to someone who stole my identity without verifying or contacting me in person as my credit report identity theft statement listed. This statement has been a part of all 3 major credit bureaus since XXXX when my identity was originally stolen.

I write to express my extreme frustration and disappointment with your persistent failure to rectify blatant inaccuracies on my credit report.
