Issue: Problem with a company's investigation into an existing problem
Subissue: Investigation took more than 30 days
Consumer Complaint: I am listing accounts below that have been reported inaccurately on my credit report. In compliance with the Fair Credit Reporting Act and as a gesture of respect to the Federal Trade Commission Committee on accuracy and completeness of credit information I am formally writing in today to dispute negative information appearing on my credit. This incorrect information is greatly hindering me from getting the credit score I deserve and hopefully, this letter will resolve all the issues on my credit. I demand to see Verifiable Proof ( an original Consumer Contract with my Signature on it ) of the accounts listed below. Your failure to positively verify these accounts has hurt my ability to obtain credit.

The company did not provide any solutions or escalations of action in regard to reporting this to the credit agencies nor did they provide proof of investigation or proof of current account standing.

Consumer Complaint: XXXX refuses to update my credit history and continues to report me as XXXX days late on a loan since paid-off. The issue is, according to XXXX, I should not have received a Payment Deferral Agreement Offer. Instead they say underwriters or some other internal investigative team discovered my loan was restricted by my investor and should have never been granted the forbearance in question. Therefore, XXXX corrected their error, which immediately put me in arrears and multiple month 's late. The multiple payments I sent based on my executed Payment Deferral Agreement Offer were then put into suspense and/or applied to previous balance, resulting in additional months of missed payments according to them. XXXX also consistently showed differing, erroneous account status and amounts due both on their website and during calls with multiple agents and management spanning many months. Below is an initial overview of the issue and my first of many attempts to resolve the issue. However, there is plenty more including detailed notes from multiple calls with XXXX representatives over several months. XXXX. On XX/XX/2022 XXXX XXXX received a Forbearance Plan Offer ( attachment A ) issued due to XXXX XXXX indication that his ability to make payments on his loan was negatively impacted by the XXXX pandemic. In the letter, XXXX confirmed monthly payments were paused effective XX/XX/2022 with an expiration date of XX/XX/2022. The communication further noted that while payments were not forgiven, XXXX XXXX could engage with XXXX at the end of the forbearance term for a payment solution, should he continue to need assistance after XX/XX/2022. Solutions included, but were not limited to, repayment plan, payment deferral, among others. XXXX. On XX/XX/2022 XXXX XXXX received a Payment Deferral Agreement Offer ( Attachment B ) from XXXX indicating he was approved for a payment deferral which would : a. Adjust the due date of the following scheduled monthly payments, making the mortgage current ; b. Defer the scheduled repayment of the total XXXX past-due amounts to the maturity date of the mortgage or upon sale or transfer of the property, refinance or payoff ; c. Waive any late charges. According to the offer instructions, XXXX XXXX returned the signed offer to the indicated address within the acceptance period and waited for further communication from the XXXX team indicating the following scheduled monthly payments, as indicated in the notice. XXXX. On XX/XX/2022, XXXX XXXX received a Notice of Default for failure to pay amounts due ( Attachment C ). The monthly payments included in the notice ranged from XX/XX/2022, to XX/XX/2022. XXXX XXXX was required to make full payment on the amount of {$9700.00} by XX/XX/2022, to cure the default. Given XXXX XXXX entered a Forbearance Plan from XXXX to XX/XX/2022 and then accepted Loancares Payment Deferral Agreement Offer, my clients dispute the Notice XXXX XXXX from XX/XX/2022. They further request XXXX immediately halt any foreclosure procedures against them and issues them with the new scheduled monthly payments, as indicated by the XX/XX/2022 notice.

Consumer Complaint: 15USC 1681 a ( d ) ( 2 ) ( A ) ( i ) clearly states that transactions between the consumer and the Person/Corporation making the report is NOT included on the consumer reports. Yet Experian is reporting this information.. The reporting of excluded information pursuant to 15USC 1681 a ( d ) ( 2 ) ( A ) ( i ) on a consumer report is a clear violation of Metro2 compliance. Provide me with the Metro2 compliance disclosure on reporting transactions to a consumer reporting agency. I need the transactions reporting as late, collection/charge-off status and any other derogatory information deleted from my consumer reports effective immediately. Before you think to reply that this account has been " validated ', let 's be clear that I am not asking you to validate or verify anything. So please do not respond by telling me that as a tactic to waste my valuable time. Some of the negative accounts have been placed in Collection/Charge-Off Status WITHOUT mailing me a copy of IRS form 1099-C Cancellation of Debt. Experian and the creditors reporting collections/Charge-Offs, late payments/other derogatory information in my consumer reports are in violation of 26 USC ss 6050P Returns Relating to the Cancellation of Indebtedness By Certain Entities. If this derogatory account information is not deleted from my consumer reports within 30 days, I will be forced to officially file IRS form 3949A : Information Referral AND IRS form 211 : Application For Award For Original Information Overview with the Internal Revenue Service against ALL entities involved.

Issue: Incorrect information on your report

Consumer Complaint: On the evening of XX/XX/23, I received an email notice that a new line of credit was opened on my credit report in the amount of ~ {$16000.00} through XXXX XXXX XXXX. I did not open a new line of credit. Being a Saturday night, I was not able to contact customer service, though I tried, and information was given on their website that some customer service lines were open over the weekend, but none actually were. I believed my passport had been stolen a few months earlier ( XX/XX/23 ), like I said. Fearing that identity theft had occurred, I tried contacting every Experian number I could find, but none were open. I feared that another loan would be taken out in my name. I cancelled my passport on XX/XX/23, believing that that's how the identity theft occurred. On Monday, I called Experian 's customer service, who directed me to speak with the XXXX XXXX XXXX. I called them and explained that I believed identity theft had occurred. They could not find my information in their system. XXXX XXXX XXXX told me to contact Experian and explain that a " XXXX Account '' had occurred, which is an error in data management. When I contacted Experian in the evening about this merged account, they were able to resolve it, though they did not work thoroughly when I contacted them that morning. The merged account was an oversight until I told them that there were merged accounts. Due to Experian 's data management error, I reasonably and responsibly canceled my passport on XX/XX/23. After resolving the merged accounts, I found my passport around XX/XX/23. I requested to many different divisions of Experian that I be compensated for the out-of-pocket cost associated with replacing a passport. I would not have canceled it if it were not for their data management error. They connected me with an insurance representative who told me that they were unable to help me since no identity theft had occurred. I then contacted Experian again and requested to speak with a supervisor about possible restitution. He explained that he is unable to provide any kind of restitution. He advised that he had filed a formal complaint, and he told me where I could as well.
