Issue: Incorrect information on your report
Subissue: Account information incorrect
Consumer Complaint: I am writing to inform you of the inaccurate information that Experian has been reporting on my credit report Upon reviewing my credit report, I discovered that Experian is reporting erroneous information that has severely damaged my credibility and caused significant financial and emotional distress. This inaccurate reporting is in direct violation of the regulations set forth in the 15 U.S. Code 1681s2, which prohibits the furnishing of inaccurate information to consumer reporting agencies. Specifically, Experian has reported a debt as part of my credit history, which is entirely inaccurate. According to the guidelines of the Internal Revenue Service ( IRS ), canceled debts should be reported as gross income on tax returns, not as debts on consumer reports. Thus, the reporting of this account as a debt is not only incorrect but also contradicts the established regulations. The IRS clearly defines a charge off as gross or ordinary income, which should not be reported on the consumer report. Therefore, the reporting of this account as a debt is unequivocally inaccurate. Furthermore, I have not received a Form 1099-C from any data furnisher, despite the fact that it is required if the canceled debt exceeds {$600.00}, as stated in the IRS guidelines XXXX This form is crucial for accurately reporting taxable income, and its absence further corroborates the inaccuracies present in Experian 's reporting. This incident has deeply disturbed me, as it has had a profound impact on my financial well-being. I am taking proactive steps to rectify this situation and ensure that my credit report reflects accurate information.
