Issue: Incorrect information on your report
Subissue: Account status incorrect
Consumer Complaint: XXXX is reporting two late payments. I have never been late. I have disputed this with Experian and they have done nothing!!! not been able to resolve it. A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose, unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement including the information required by section 1637 ( b ) of this title is mailed or delivered to the consumer not later than 21 days before the payment due date. In accordance with fair credit reporting this creditor has violated my rights under 15 USC 1681 section 602 states I have the right to privacy 15 USC section 1681 section 604 it also states a consumer reporting agency can not furnish an account without my written instructions. Again this discover card has been reported late multiple times please delete!!! Also I requested debt validation letters from XXXX XXXX XXXX and credit services. They just appeared as collections and have no clue of them I have been a victim of identity theft I have my credit file flagged and with a statement. They have not been able to provide the validation letter to me in writing with my signature and any agreement between me and them. I have disputed this with Experian and all they do is say its validated however they dont provide the documentation that I have requested.

Consumer Complaint: Despite numerous deletions addressing the improper use of my credit report through dispute resolutions and other measures spanning from XXXX to the present, the persisting issue raises concerns under 12 CFR 1022.3 Definitions, where " Identity theft '' is defined as a fraud committed or attempted using someone else 's identifying information without authority. Any addition to my report without written consent could be deemed a form of Identity theft. This not only poses a threat to my consumer identity but also detrimentally impacts my creditworthiness, causing adverse consequences that extend to various aspects of my life. In accordance with the Fair Credit Reporting Act 15 USC 1681 section 602 a, it is emphasized that consumer reporting agencies must carry out their significant responsibilities with equity, impartiality, and a regard for the consumer 's privacy rights. The entities in question, namely XXXX, XXXX, and Experian, function as consumer reporting agencies, with me being the concerned Consumer. I hold the right to ensure the confidentiality of my personal information, as supported by 15 USC 6801, which articulates Congress 's stance on financial institutions ' obligation to uphold customer privacy. Under 15 USC 1681 section 604 a section 2, it is specified that a consumer reporting agency may only furnish a consumer report based on the explicit written instructions of the related consumer. I wish to assert that neither the financial institution ( Furnisher of information to credit agencies ) nor the Consumer reporting agencies XXXX, XXXX, and Experian possess my consent for such information sharing, verbal, non-verbal, written, implied, or otherwise. All forms of consent to XXXX, XXXX, Experian, and ( Furnisher of information to credit agencies ) are hereby revoked. Referring to 15 USC 6802 ( b ) ( c ), a financial institution is prohibited from disclosing nonpublic personal information to a nonaffiliated third party unless the consumer is informed of the nondisclosure option. Regrettably, ( Furnisher of information to credit agencies ) failed to apprise me of my right to exercise this nondisclosure option. Moreover, 15 USC 1681C ( a ) ( 5 ) explicitly prohibits consumer reporting agencies from including adverse information in a report without the consumer 's permission. The inclusion of such adverse information without my consent violates the law. According to 15 U.S. Code 1681s2 ( A ) ( 1 ) A, furnishing inaccurate information to a consumer reporting agency is strictly prohibited. Additionally, 15 U.S. Code 1681e mandates consumer reporting agencies like XXXX, XXXX, and Experian to maintain reasonable procedures to avoid violations. It is evident that these agencies are not adhering to reasonable procedures. Finally, in accordance with 12 CFR 1016.7, I assert my right to opt out of your reporting services at any time.

Consumer Complaint: I realized in XXXX that my information had been stolen so I called Experian to place a freeze on my credit report. Later on XX/XX/ when logging into my Experian XXXX XXXX account I went to dispute a fraudulent inquiry and realized someone had created a fraudulent Experian membership account with all of my information. I reported this immediately and faxed all of the verification requested on XXXX XXXX XXXX ( license, social and insurance bill with home address ). Experian confirmed as received and cancelled the fraudulent membership. I also requested that Membership services flag the fraudulent e-mail address and telephone number be and flagged. After the first fraudulent account was canceled, I enrolled with valid contact information to create a new Experian account. However, when I went to log in to the Experian account on XX/XX/ I was locked out. Someone had yet again bypassed Experian 's weak security with the same fraudulent email and telephone number that they had used to create the initial fraudulent account. I called Experian immediately and again requested that account be deleted and asked to flag the fraudulent email address and telephone number again and also asked that a 2 factor identification be required outside of my DOB/SS/Full Name because it was clear that my information had been compromised. In addition to the disregard for my multiple requests to delete the fraudulent account I discovered Experian had also allowed someone to open a fraudulent money market account with my information using that same fraudulent email and telephone number which I had requested at that point multiple times to be deleted and flagged. As one of top 3 credit bureaus cyber security measures should be top priority. The measures in place are close to nonexistent and showcases the total lack of concern for the welfare or safety of customers. Although I requested my account be flagged, I continue to receive offers from Experian to open new credit card accounts and loans with my good credit. A credit bureau that peddles credit accounts to customers with good credit rather than doing whatever they can to protect that good credit is not only unethical but also a conflict of interest. The back-and-forth phone calls to Experian call centers around the world is extremely time consuming, unnecessary, and frustrating. It is simple, delete the fraudulent account, flag the fraudulent email address and require 2 factor identification on the account. I have every phone call with Experian documented and a log of everyone I spoke, including how much time I have wasted with needless transfers back and forth to and from the same departments. With all of the time I have spent on the phone I am in exactly the same position as I was 3 months ago having to fax my verification information once again. Experian has no regard for the security of their customers whatsoever. I can probably attribute the identity theft to one of Experian 's security breaches.
