However, if they fail to do so, they are obliged to remove or update the items which are erroneous and unverified. Consumer Complaint: As per the Fair Credit Reporting Act ( 15 USC 1681, section 602a ), it is emphasized that consumer reporting agencies must carry out their significant responsibilities with fairness, impartiality, and a commitment to respecting the consumer 's right to privacy. XXXX, XXXX and Experian function as consumer reporting agencies, and I, as the consumer, possess the right to ensure that my private information remains undisclosed, as supported by 15 USC 6801. This statute declares the Congress 's policy that financial institutions have an ongoing obligation to safeguard the privacy and confidentiality of their customers ' nonpublic personal information. The entity providing information to credit agencies, considered a financial institution under this title, is governed by 15 USC 1681, section 604a ( 2 ). This section specifies that consumer reporting agencies may furnish a consumer report only in accordance with the written instructions of the respective consumer. To emphasize, the financial institution and the consumer reporting agencies, XXXX, XXXX and Experian, lack my consent and written authorization to disclose this information. Referencing 15 USC 6802 ( b ) ( c ), it is stated that a financial institution can not disclose nonpublic personal information to a nonaffiliated third party without providing the consumer with an explanation of how to exercise the nondisclosure option. Unfortunately, the entity providing information to credit agencies failed to inform me of my right to exercise this option. Furthermore these institutions have been given notice of me exercising said option of nondisclosure. Furthermore, 15 USC 1681C ( a ) ( 5 ) expressly prohibits consumer reporting agencies from including certain adverse information in a consumer report without proper authorization. The adverse item being reported without my consent violates this law, as does 15 U.S. Code 1681s2 ( A ) ( 1 ) ( A ), which prohibits furnishing inaccurate information to consumer reporting agencies. Moreover, 15 U.S. Code 1681e mandates that consumer reporting agencies maintain reasonable procedures to prevent violations and limit the furnishing of consumer reports to specific purposes. XXXX, XXXX and Experian appear to be falling short in maintaining these reasonable procedures as these accounts have been disputed with each of them multiple times. Also, 15 U.S. Code 1681c states that Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information : Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years.

Consumer Complaint: I recently received a copy of my credit report. I was shocked to learn I ave been a victim of identity theft. I found numerous accounts on my credit report they were not open by me. This has been hurting me as I am in the process of buying a home for my family. The debt collectors engaged in abusive, deceptive, and unfair practices of the FDCPA which it prohibits. They furnished this account that we didn't agree upon and I didn't sign an agreement on. A legal contract is signed by XXXX parties and I didn't participate in any of it. More so they didn't follow the proper 5 step validation procedure which make this unfair practices.

Consumer Complaint: XXXX sent me a promotional offer for a credit card. I have applied because the promotional offerred said it was going to be a soft inquiry when I was applying. My credit score is great close to XXXX and they still denied me for any credit limit. Now I noticed a hard inquiry on my credit that it is going to stay until XXXX and this is not right. Why would you send a credit offer to me if the company can not approve my credit and why would the company lie about the inquiry they are going to put in my shoulders.
