Consumer Complaint: This is a formal complaint against XXXX XXXX XXXX XXXX ( XXXX ), pursuant to Consumer Financial Protection Bureau judgement against XXXX ( Case No. XXXX ) and in relation to the difficulties I experienced during the XXXX pandemic which have had a significant impact on my financial situation and credit standing. During this challenging period, I held a lease agreement with XXXX. As an employee of a non-profit in the education sector facing financial hardship, I sought to explore options for mitigating my financial burden, including the possibility of amending my lease terms by removing services or paying off the lease prematurely. Regrettably, my attempts to communicate with XXXX were met with insurmountable challenges. The customer service infrastructure, notably the phone tree system, proved to be ineffective and unresponsive, often leading to disconnections or cyclical routing without resolution. Despite repeated attempts over an extended period, my efforts to engage with XXXX to address this matter were unsuccessful. Ultimately, resigned to the situation, I prepared for the inevitable repossession of the vehicle. The repossession process was conducted without any prior communication or attempt by XXXX to resolve the issue. This incident, which was avoidable, remains the sole blemish on my otherwise unblemished credit record, and is indicative of an anomaly in XXXX 's business practices at the time. Furthermore, I have taken steps to rectify the impact of this incident on my credit reports. This includes submitting requests for the removal of this record to Experian and XXXX, specifically citing the CFPB 's XX/XX/2023 judgement against XXXX for related lending misconduct. Despite these bureaus acknowledgment of my requests, no changes have been made to my credit history or scores, and I have not received any substantive explanation for this inaction. This unresolved matter has adversely affected my ability to secure a car loan, despite maintaining a credit score in the XXXX. It is my contention that the conduct of XXXX in this case, is not only inconsistent with the expected standards of customer service but also reflective of the practices for which they were recently sanctioned by the CFPB, and should, therefore, be removed.

Consumer Complaint: As per the Fair Credit Reporting Act ( FCRA ) 15 USC 1681 section 602 ( a ), it is emphasized that consumer reporting agencies, including XXXX and Experian, must carry out their significant responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. As a consumer, I assert my right to ensure the non-disclosure of my private information, supported by 15 USC 6801, which declares the Congress 's policy that each financial institution has a continuous obligation to respect customer privacy and safeguard the security and confidentiality of nonpublic personal information. The term " ( Furnisher of information to credit agencies ) '' qualifies as a financial institution by definition under this title. According to 15 USC 1681 section 604 ( a ) ( 2 ), any consumer reporting agency may furnish a consumer report only under specific circumstances, such as in accordance with the written instructions of the respective consumer. Both the financial institution ( Furnisher of information to credit agencies ) and the consumer reporting agencies, XXXX and Experian, lack my consent to furnish this information, and they do not have my written consent. I hereby revoke any and all consent to XXXX, Experian, and the Furnisher of information to credit agencies, whether it be verbal, non-verbal, written, implied, or otherwise. Referring to 15 USC 6802 ( b ) ( c ), a financial institution is prohibited from disclosing nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how to exercise the nondisclosure option. The Furnisher of information to credit agencies never informed me of my right to exercise this option. Additionally, 15 USC 1681C ( a ) ( 5 ) specifies that no consumer reporting agency may include any adverse item of information in a consumer report without authorization, except for records of convictions of crimes that predate the report by more than seven years. Reporting this account as an adverse item without my permission is a violation of the law. According to 15 U.S. Code 1681s2 ( a ) ( 1 ) ( A ), a person is prohibited from furnishing any information to a consumer reporting agency if they know or have reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e mandates every consumer reporting agency to maintain reasonable procedures to prevent violations and limit the furnishing of consumer reports to specific purposes listed under section 1681b of this title. XXXX and Experian are not upholding reasonable procedures. Furthermore, as stated in 12 CFR 1016.7, a consumer has the right to opt out at any time. Accordingly, I am opting out of your reporting services.
