Consumer Complaint: ATTN : CFPB RE : Inaccurate Reporting XXXX XXXX XXXXXX/XX/XXXXXXXX I XXXX XXXX am filing this complaint against XXXX XXXX for reporting information inaccurately on my credit report. According to15 U.S. Code 1681- Congressional findings and statement of purpose : The banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. According to 15 U.S. Code 6801 - Protection of nonpublic personal information ( a ) Privacy obligation policy It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. According to 15 U.S. Code 6802 - Obligations with respect to disclosures of personal information ( a ) Notice requirements Except as otherwise provided in this subchapter, a financial institution may not, directly or through any affiliate, disclose to a nonaffiliated third party any nonpublic personal information, unless such financial institution provides or has provided to the consumer a notice that complies with section 6803 of this title. According to 15 U.S. Code 1692e - False or misleading representations, A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section : ( 1 ) The false representation or implication that the debt collector is vouched for, bonded by, or affiliated with the United States or any State, including the use of any badge, uniform, or facsimile thereof. This is in reference to an account with XXXX XXXX beginning with # XXXX. I have provided proof of the inaccuracy attached to this claim. I have contacted XXXX XXXX XXXX numerous times, and they refuse to remove this inaccurate account from my credit report. This also is a violation of my Privacy under the Privacy Act of 1974. Experian, XXXX, and XXXX are non-affiliated which violates 15 U.S. Code 6802. XXXX XXXX hasn't furnished a copy of my wet signature giving them permission to share my information with any non-affiliates. XXXX XXXX also hasn't provided a contract between us. This debt is a certificate of indebtedness and has been discharged. Income isn't supposed to be listed on a credit report. XXXX XXXX filed a 1099 to discharge the debt and failed to send me my 1099B copy from the IRS. This is security fraud and I request compensation.

Frankly, I am extremely distressed by the presence of this information, and it appears that the bureau has failed to maintain reasonable procedures to ensure maximum possible accuracy in the credit reports published. Credit reporting laws mandate that bureaus report only 100 % accurate credit information, and every effort must be made to ensure the accuracy and correctness of the reported information. I am requesting that you thoroughly reinvestigate the following information that requires proof of the alleged items, specifically the contract, note, or other instruments bearing my signature. The other bureaus have followed suit. I am very confused why this one seems to ignore my requests. Also, I caution you that should you persist in reporting this false information without a rigorous verification process, I will not hesitate to seek a legal remedy. I have already consulted with my attorney on this matter, and he is prepared to initiate a federal case within 30 days of the date of this letter should the inaccuracies persist.
