In accordance with 15 U.S.C. 1681e ( b ) ( b ) Accuracy of report, When preparing a consumer report, a consumer reporting agency must take reasonable measures to ensure the utmost possible accuracy of the information about the individual to whom the report pertains. I am aware that under 15 U.S. Code 1681i ( 5 ) Treatment of inaccurate or unverifiable information ( A ), in general, inaccurate or unreliable information must be treated as such. Given your previous irrelevant responses and the fact that the above account keeps coming back to me as Verified, you must have proof that it is, in fact, reporting lawfully. So therefore, please provide such proof, as defined by law, in which you must have on file that would assert to the lawful reporting of the above account and that this item does not violate the Fair Credit Reporting Act as detailed above. As advised by my counsel, an itemized report detailing that the reporting of this item is not violating my constitutional rights is hereby requested. The continued reporting of this item in its negative state is causing me severe financial and emotional distress. This is a formal complaint against XXXX XXXX Bank for their violation of my rights under 15 USC 6802, 15 USC 1681, 12 CFR 1016.7, and the Privacy Act of 1974. I believe that the bank has unlawfully shared my personal information without my explicit consent, and this action is a clear breach of the aforementioned statutes. Details of the Violation : Unauthorized Sharing of Information : I recently discovered that XXXX XXXX Bank has shared my personal information without my explicit consent. This sharing of information has serious implications for my privacy and may have repercussions on my financial well-being. Violation of 15 USC 6802 : The bank 's actions are in direct violation of 15 USC 6802, which prohibits the unauthorized disclosure of nonpublic personal information by financial institutions. Consumer Complaint: I had CFPB reach out to XXXX XXXX on my behalf to resolve this issue ( See case number XXXX ) but it was not resolved. I Have never agreed to do business with XXXX XXXX personally and I have Never agreed to personally guarantee any loans for anyone or any company. XXXX XXXX provided me with a copy of a contract through the CFPB platform and after reviewing it, I can see that the contract is with XXXX XXXX XXXX XXXX XXXX XXXX and not with me personally. They have not provided a signature of mine by any means. I can see at the bottom of the contract, there are lines where my name is preprinted to sign, however those lines bares the signature of XXXX XXXX XXXX XXXX XXXX XXXX I never agreed to guarantee any loans. The loan officer approving the contract which shows on the left at the bottom of the contract, bares the responsibilities of inspecting this and making corrections before issuing any funds to the company. The fact that this was not done, can not force the responsibilities on to me. Based on this, I request this account be removed from my credit report immediately. If I have to hire a consumer lawyer and litigate this, I will do so and Sue for a lot of damages. I have been saving all of my credit denials which are caused by this reporting. I hope this can be resolved immediately! I have attached the contract XXXX produced and their response for your review.
