Consumer Complaint: My wife and I recently relocated from XXXX XXXX XXXX. The first indication of a problem was when trying to establish an account for internet service with XXXX XXXX XXXX. They said there was something wrong with how my name appears on a credit report. Since we just secured a mortgage and other utility accounts in my name with no issue, we assumed XXXX XXXX XXXX was mistaken and set up the account in my wife 's name. When I received a call back from XXXX for our electric service to verify information I knew something must be off. I accessed my Equifax account online and updated some address information. The only way their website provides to update an address is to dispute what is reporting as the current address. I disputed and it was processed, but this erased my address where I owned a home for 14 years @ XXXX XXXX XXXX XXXX, XXXX, Oh XXXX. I called Equifax to discuss and try to find a resolution and this is when I discovered they have my first name spelled incorrectly as XXXX '' instead of 'XXXX ' XXXX The representative I spoke with, XXXX, kept blaming this on my " lender '', but would not provide the name of a lender who's fault this allegedly was. I pointed out that XXXX and XXXX have my name spelled correctly. After much back and forth and frustration, XXXX stated she had corrected this issue and to check my report again in an hour. XXXX provided a reference number XXXX. I believe this interaction took place on XXXX. Today, XXXX, I logged into Equifax and pulled another report which still shows my name spelled incorrectly as " XXXX '' instead of " XXXX ''. I called and spoke with 'XXXX XXXX who again blames this on my " lender '' but will not tell me the name of the lender providing this information. XXXX now wants me to physically mail copes of my driver license and social security card to Equifax. As a long time victim of identity theft, I'm not comfortable sending these items in the mail and frankly, shouldn't have to. As a large organization responsible for handling hundreds of millions of American 's personal identifiable information, there has to be a more secure and accurate way of them verifying and correct their mistake. Clearly Equifax has outsourced their customer service somewhere outside the U.S. and dealing with whomever just reads a script in their call centers is infuriating.

Consumer Complaint: I've sent multiple letters to the credit reporting agencies and financial institutions regarding my right to opt-out of reporting according to 15 USC 1681b , a ) In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 2 ) In accordance with the written instructions of the consumer to whom it relates. Privacy Act 1974 he Privacy Act prohibits the disclosure of a record about an individual from a system of records absent the written consen t of the individual, unless the disclosure is pursuant to one of twelve statutory exceptions. The Act also provides individuals with a means by which to seek access to and amendment of their records, and sets forth various agency record-keeping requirements. 15 USC 6802 and 6805 ( b ) Opt out ( 1 ) In general A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless ( A ) such financial institution clearly and conspicuously discloses to the consumer, in writing or in electronic form or other form permitted by the regulations prescribed under section 6804 of this title, that such information may be disclosed to such third party ; ( B ) the consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and ( C ) the consumer is given an explanation of how the consumer can exercise that nondisclosure option.a ) Privacy obligation policy It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. 16 CFR 313.7 Form of opt out notice to consumers ; opt out methods. ( a ) ( 1 ) Form of opt out notice. If you are required to provide an opt out notice under 313.10 ( a ), you must provide a clear and conspicuous notice to each of your consumers that accurately explains the right to opt out under that section. The notice must state : ( i ) That you disclose or reserve the right to disclose nonpublic personal information about your consumer to a nonaffiliated third party ; ( ii ) That the consumer has the right to opt out of that disclosure; and ( iii ) A reasonable means by which the consumer may exercise the opt out right. However XXXX, XXXX, Equifax, XXXX XXXX XXXX, and XXXX XXXX have continuously reported my information from financial institutions and should be held accountable because I exercised my right to opt-out XX/XX/XXXX. I also noticed that multiple accounts have been reported as " charged off '' which is considered a certificate of indebtedness, meaning it is considered as income and should NOT be reported according to 15 USC 1681c ( a ) Information excluded from consumer reports Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information : ( 3 ) Paid tax liens which, from date of payment, antedate the report by more than seven years. ( 4 ) Accounts placed for collection or CHARGED to profit and loss which antedate the report by more than seven years. ( 5 ) Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. The unverifiable and incomplete items listed below remain on my credit report in violation of Federal Law. You are required under the FCRA to have a copy of the original creditors documentation on file to verify that this information is mine and is correct. In the results of your first investigation, you stated in writing that you verified that these items are being reported correctly? Who verified these accounts? You have NOT provided me a copy of ANY original documentation required under Section 609 ( a ) ( 1 ) ( A ) & Section 611 ( a ) ( 1 ) ( A ) ( a consumer contract with my signature on it ) and under Section 611 ( 5 ) ( A ) of the FCRA you are required to promptly DELETE all information which can not be verified. Please be advised that your company continues to report these unverifiable and incomplete items. These accounts can be considered falsified revenue and illegal by the IRS due to the fact these said accounts have been written off as a tax deduction. How can a payment be collected on an unverifiable and incomplete account, that has already been recorded as a tax deduction.
