Consumer Complaint: On the XXXX of XXXX, XXXX, via Certified Mail Receipt number XXXX, I dispatched a written correspondence to EQUIFAX, explicitly requesting the provision of an Affidavit of facts and documentary evidence. The communication sought clarification regarding the authenticity and verification of the disputed transactions and accounts. In the absence of a substantive response, indicating a failure on EQUIFAX 's part to take appropriate action, the requested measures to rectify the contested items were not implemented. At this time, I am exercising my rights. According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' EQUIFAX functions as a consumer reporting agency, and as the consumer, I retain the right to ensure the confidentiality of my private information. This right is substantiated by 15 USC 6801 which states " It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, and every company listed in the inquiries section of my consumer report by definition under the relevant title, are identified as financial institutions. According to 15 USC 1681 Section 604 ( a ) ( 2 ), a consumer reporting agency is authorized to furnish a consumer report only under specific circumstances, specifically when it aligns with the written instructions provided by the respective consumer. XXXX XXXX, XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX, and every company listed in the inquiries section of my consumer report, the financial institutions and the Consumer reporting agency EQUIFAX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to EQUIFAX, XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, and every company listed in the inquiries section of my consumer report whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, and every company listed in the inquiries section of my consumer report never apprised me of my entitlement to exercise the nondisclosure option. Additionally, 15 USC 1681C ( a ) ( 5 ) specifies that " Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' These accounts and inquiries ( XXXXXXXX XXXX XXXX XXXX XXXX XXXX, and all inquiries ) are adverse items, they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. EQUIFAX is not maintaining reasonable procedures. Also, 12 CFR 1016.7 states that " A consumer may exercise the right to opt-out at any time. '' I am opting out of your reporting services.

Consumer Complaint: To Whom It May Concern : I was in the process of applying for new employment and it was brought to my attention that there is some inaccurate information reporting on my credit report.I received a copy of my credit report and to my surprise I saw all these inaccurate items that are not correct. By the way I hope that this does not hinder my ability to obtain employment due to this inaccurate information showing. Consumer Complaint: Complaint Regarding Credit Report Inaccuracies Dear CFPB, I am writing to follow up on my complaint regarding inaccurate information on my credit report. I have been actively disputing these inaccuracies with the credit bureaus, but they have failed to adequately investigate my claims or remove the incorrect information. In accordance with the Fair Credit Reporting Act. I attached the PDF file below containing the list of items that have violated my federally protected consumer rights to privacy and confidentiality under 15 USC 1681. Credit Bureau stated everything was complete and accurate. But how is that possible if the open date, date of last activity and much more is incorrect. According to 15 USC 1681i ( 5 ), they are supposed to modify or delete accounts that aren't reporting correctly. 15 U.S.C. 1681s-2 ( A ) ( 1 ) A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. I also believe that the credit bureaus have violated the Fair Credit Reporting Act ( FCRA ) by failing to : 1. Investigate my disputes in a timely and reasonable manner : The credit bureaus have not provided a clear explanation for their decision not to remove the inaccurate information, and I believe their investigation was inadequate. 2. Furnish accurate information to creditors : The inaccurate information on my credit report is harming my ability to obtain credit and other financial services. 3. Follow the FCRA 's dispute resolution procedures : The credit bureaus have failed to comply with the timeframes and procedures outlined in the FCRA.
