The primary borrower has proven to be incompetent in managing this account thereby damaging my credit! ALL information that I have acquired in regard to this account is through disputes! Apparently the monthly payment has increased. I learned this via my Equifax credit report through a dispute this month! The primary borrower was duly notified. I WAS NOT! Also, XXXX continues to request a complete, unabridged copy of MY credit report! Please refrain from asking again for this information as any further requests will be considered harassment. Consumer Complaint: Notice of Violations of Fair Credit Reporting Act 15 USC 1681s-2 ( b ), 1681i ( a ) ( 1 ) ( A ), and 1681i ( a ) ( 5 ) ( A ) Final Notice Before Litigation I am writing to you about the inaccurate and unverifiable information contained in my credit reports, specifically regarding the accounts below. According to the Fair Credit Reporting Act ( FCRA ) and associated provisions, I, as a consumer, have taken appropriate steps to rectify this matter. Regrettably, to date, I have not received any rebuttal or validation or verification concerning this debt, as mandated by relevant statutes and judicial precedents such as Spears v. Brennan. Under 15 U.S. Code 1692k ( a ) ( 2 ) ( A ), failure to provide requested validation and verification of the debt incurs civil liability. Moreover, the absence of point-for-point responses or documentation has rendered the aforementioned accounts inaccurate and unverifiable, thus contravening the mandate outlined in 15 U.S. Code 1681e ( b ) regarding the accuracy of consumer reports. The FCRA imposes an obligation on consumer reporting agencies, such as yourselves, under 15 U.S. Code 1681i ( a ) ( 1 ) ( A ) and 15 U.S. Code 1681i ( a ) ( 5 ) ( A ), to conduct a reasonable reinvestigation upon receipt of a consumer dispute and to promptly delete or modify inaccurate or unverifiable information resulting from such disputes. As per my rights under the law, I hereby demand the deletion of the inaccurate and unverifiable information associated with the referenced accounts from my credit reports. Enclosed is a fee schedule delineating the costs associated with potential litigation and arbitration, which shall be pursued if this matter remains unresolved. In the event of litigation and subsequent arbitration, the total cost to your agency, should you lose, would amount to {$14000.00}. Consumer Complaint: I am asking for my concerns to be addressed and the company has clearly taken advantage of me. from my complaint no one could provide results in reference to what I requested and the CFPB even extended the response time frame to 60 days. To get a response that you guys needed identity verification when this has been drawn out long enough. I am complaining once more and providing what was requested through the CFPB. Now you have 15 days to give me the results of my dispute. I am demanding this be completed or I will turn to legal action providing this new information along with prior letters that will indicate that you all have not let me exercise my right to have fair and accurate information reporting to my credit report. I provided the proof of identity as well so that I am no longer stalled. This credit bureau clearly did not open a proper investigation on concerns that I have made them aware of dealing with what I have found on my credit report and I am looking for your help to resolve this issue. According to U.S Code 15 U.S.C 1681i ( 5 ) ( A ) ( i ) Treatment of inaccurate or unverifiable information In general If, after any reinvestigation under paragraph ( 1 ) of any information disputed by a consumer, an item of the information is found to be inaccurate or incomplete or can not be verified, the consumer reporting agency shall promptly delete that item of information from the file of the consumer, or modify that item of information, as appropriate, based on the results of the reinvestigation. I sent in a dispute voicing my concerns about accounts that were clearly inaccurately reporting and also about a bankruptcy that has shown up on my credit report in error that I am stating doesn't belong to my credit report. I contacted the federal bankruptcy court in which this agency has listed as the credit furnisher under contacts on my credit report in order to verify the bankruptcy. The federal court could not provide verification stating that they do not verify bankruptcies with the credit reporting agencies and I should request it be removed as to they do not communicate with the credit bureaus at all. Furthermore the court explained that the credit agencies find this information themselves and report it without their knowledge or authorization as well as without my authorization as the consumer. This is also a violation of my right to privacy according to The Privacy Act of 1974 ( 5 U.S.C. 552a ) which protects personal information held by the federal government by preventing unauthorized disclosures of such ( private ) information. I have also attached my disputes that were previously sent in which I have requested 15 U.S Code 1681i ( 6 ) ( B ) ( III ) a notice that, if requested by the consumer, a description of the procedure used to determine the accuracy and completeness of the information shall be provided to the consumer by the agency, including the business name and address of any furnisher of information contacted in connection with such information and the telephone number of such furnisher. None of the information was ever given in order to properly verify and validate this information as accurate, complete, and timely. I am questioning the validity of these accounts and I have called out errors on my report that are adversely affecting me from getting approved for a home loan. I want my concerns addressed and am requesting that action is taken in order to get me the solutions to the issues I clearly have a right to.
