Consumer Complaint: Upon reviewing my credit report, I noticed an unauthorized account from XXXX XXXX and charges on said account. I notified them this account was created without my consent. I also filed a fraud report, showing this theft had been reported. They continued to publish inaccurate information on my credit profile, with all three credit reporting agencies after giving them documentation. They closed the account and left it on my credit report. It was never my account and needs to be removed as it is affecting my overall ability to obtain credit.

On approximately XXXX XXXX I contacted Equifax about removing a bankruptcy from my consumer credit report that was listed fraudulently, they informed me they would have to investigate it. I received a letter dated XX/XX/2023 from Equifax stating the bankruptcy came back verified as mine and it was verified using XXXX, which could not be true because I called XXXX and they told me that I, indeed, have a freeze on my account.

Consumer Complaint: I have suffered identity theft and power of attorney fraud by the following companies. Pursuant to XXXX XXXX XXXX XXXX XXXX, a United States Court of Appeals for the XXXX XXXX in 2001 ruled and emphasized that for a creditor to rely on a consumer 's consent, it must be informed and voluntary. Mere inclusion of a consent provision in a contract does not automatically establish informed and voluntary consent. The nancial institution must demonstrate that the consumer explicitly provided consent, indicating their understanding and agreement to have information reported to credit bureaus. Pursuanbt to FCRA 605b and 15 USC 1681 c-2 i demand the acount be removed and blocked from my reporting or you may be held liable for noncompliance pursuant to 15 USC 1681o and 15 USC 1681n . It is imperative to understand that failure to disclose information that should be made available constitutes fraud. Additionally, the unauthorized use of another person 's identifying information, without proper consent, amounts to Identity Theft. Under XXXX XXXX XXXX XXXX you may be held liable for Identity Theft. U.S. Court of Appeals for the XXXX XXXX recently ruled that a consumer does not have to prove actual damages to recover statutory damages for willful violations of the Fair Credit Reporting Act, In XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX XXXX XXXX. ( XXXX ; Equifax ; XXXX ) has violated many consumer rights. Under Title 15 USC 1681 604 ( a ) ( 2 ) a consumer reporting agency CAN NOT furnish any account without my consent. ( XXXX ; Equifax ; XXXX ) continues to defy my demands and report inaccurate accounts. ( XXXX ; Equifax ; XXXX ) has failed to provide me with their investigation process. Has failed to provide me with any documents and proof of validation. ( XXXX ; Equifax ; XXXX ) has also abused my privacy rights. Under Title 15 USC 1681 602 ( a ) it states I have a right to privacy and ( XXXX ; Equifax ; XXXX ) continues to engage in abusing my rights. They have also engaged in defamation of my character. ( XXXX ; Equifax ; XXXX ) is in violation of FCRA section 611 part ( A ) ( 1 ) I never gave ( XXXX ; Equifax ; XXXX ) any written instructions to furnish any of these accounts which is a violation of Title 15 USC 1681b and ( XXXX ; Equifax ; XXXX ) has caused me severe anxiety, and stress due to their abusive and unfair practices. The standard for unfairness in the Dodd Frank act is that an act or practice is unfair when : ( 1 ) it causes, or is likely to cause substantial injury to consumers And ( XXXX ; Equifax ; XXXX ) has caused me emotional and financial injury. According to 15 USC 1681 ( a ) ( 2 ), an elaborate mechanism must be developed for investigating and evaluating the credit worthiness, credit standing, credit capacity, character, and general reputation of consumers. ( XXXX ; Equifax ; XXXX ) falsely reported information that resulted in defamation of my character. Further, ( XXXX ; Equifax ; XXXX ) created a deceptive form that made the creditors and employers believe that I was in debt, though you could not prove its validity. If the debts were valid, ( XXXX ; Equifax ; XXXX ) created a false impression that I was not able to pay the alleged debts. As a result, I was discriminated against and denied my right to extend credit. I also suffered emotional as well as financial hardship. Therefore, the ( XXXX ; Equifax ; XXXX ) Company is liable according to 15 USC 1681o. Consumer Complaint: I am writing to dispute the inclusion of Delinquent Child Support Payments, on my credit report. According to the recent notice from your agency, federal court rulings have determined that Delinquent Child Support Payments, do not arise from a credit transaction and should not be reported on credit reports. Credit Reports for collection of delinquent child support, judgments, fines and liens may no longer be permitted Federal courts recently have issued rulings about the use of consumer reports for the collection of an account under the Fair Credit Reporting Act ( FCRA ). 1 These cases note that certain definitions were added to the FCRA as part of the 2003 amendments ( FACT Act ). In particular, the word credit was defined. As a result of the new definition the position that is being advocated is that a collection of an account is a permissible purpose to obtain a consumer report only when the collection is in connection with a credit transaction. The courts have specifically rejected prior case law and FTC guidance that a judgment creditor had permissible purpose, noting that those decisions pre-dated the FACT Act. These cases have held that a delinquent child support obligation, municipal fines arising from parking tickets, and a statutory debt resulting from the towing and impound of an illegally parked vehicle did not arise from a credit transaction. As a result, the courts found that collection of those accounts was not a valid permissible purpose to obtain a consumer report. If you use XXXX consumer report services in connection with the collection of an account, we advise you to promptly review the new case law with your regular attorney or compliance advisor. XXXX will be contacting each customer that is a third-party collector to discuss this issue. We expect to confirm with you that you are in compliance with this new interpretation. Until then, unless you advise otherwise, we are relying upon you to comply with your contract with XXXX and this new interpretation of the law. This means that you may obtain XXXX reports for collection purposes only when collecting on an obligation arising from a credit transaction, or where you have the written authorization of the consumer or a court order to obtain a consumer report. As an example, for collectors of delinquent child support debt, judgments, fines, or liens, you must have in hand : A court order authorizing a consumer reporting agency to provide a consumer report, A written authorization from the debtor to obtain a consumer report, or Some type of contractual agreement with the consumer that rises to the level of a credit transaction under law.

Consumer Complaint: I REQUESTED MY CONSUMER REPORT AND SAW THAT THERE WAS INACCURATE INFORMATION being reported that I as the consumer not notified about before reporting. On XX/XX/2023 I sent out a debt validation letter to XXXX XXXX XXXX the debt collection agency, and have not gotten a response since. I reached out to the credit reporting agencies after 30 days, requesting proof of the account, the method used, and certified receipts just proof as to why the inaccurate account was still reporting, I was told by the credit reporting agencies that the furnisher validated the account and its final as if I the consumer have no legal rights to my consumer file. The consumer agencies are ABOVE LAW by not following the law. All this back and forth without a solution has caused me XXXX XXXX XXXX, and financial stress.
