Consumer Complaint: I am filing a formal complaint against Equifax XXXX XXXX XXXX for clear violations of the Fair Credit Reporting Act and the Identity Theft Red Flags Rule. Despite providing comprehensive documentation and following the prescribed dispute process, Equifax has failed to address compromised accounts on my credit report. I submitted a thorough dispute to Equifax, including FTC reports, a police report, a state of XXXX XXXX XXXX, a social security card, and a handwritten letter specifying the compromised accounts I wanted blocked. Despite these efforts, Equifax has verified the accounts through an alternate process, and as a result the compromised accounts are still being furnished and my entire Equifax credit report is still profoundly inaccurate preventing me from becoming a first time home buyer. Equifax 's refusal to block the compromised accounts is a direct violation of my rights under the FCRA ( 15 U.S.C. 1681 ). The FCRA mandates accurate and fair reporting of consumer information. The accounts in question were reported as compromised, and Equifax 's failure to act appropriately contradicts the FCRA guidelines.Non-Compliance with Identity Theft In addition, Equifax 's actions raises my concerns about its adherence to the Identity Theft Red Flags Rule XXXX XXXX XXXX XXXXXXXX ). This rule requires financial institutions to detect and respond to potential identity theft indicators. By neglecting to block the compromised accounts, Equifax is not fulfilling its obligations under this rule. Lastly, when I compared the CFPB guidelines with FCRA I have concluded Equifax 's deviation from the documented dispute process outlined in my submission, Equifax has contradicted the guidelines set by the Consumer Financial Protection Bureau for handling identity theft disputes. I request the Consumer Financial Protection Bureau to investigate this matter thoroughly and take appropriate action to ensure Equifax complies with consumer protection laws. Specifically, I seek the following : A reevaluation of my dispute by Equifax, considering the evidence and documentation provided. Blocking of the compromised accounts as per my original request. Assurance that my credit report accurately reflects the resolution of this matter. Failure to address these concerns in a timely and satisfactory manner may necessitate further action, including seeking legal counsel and reporting the issue to other regulatory authorities.Thank you for your prompt attention to this complaint. Consumer Complaint: The FDIC gave XXXX XXXX XXXX a consent order in 2023 saying the bank participated in unsafe and unsound banking practices relating to fair lending laws and XXXX XXXX XXXX failed to establish and maintain internal controls, information systems, and prudent credit underwriting practices ''. I am a VICTIM of these unsafe and unsound lending practices. This account is not mine and needs to be removed ASAP. I have attached the FTC identity theft report here. I have notified BOTH XXXX AND XXXX multiple times stating that this is NOT MY ACCOUNT and it still remains on my credit report. Both XXXX and XXXX are in VIOLATION of 15 U.S. Code S 1681c-2. " A consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identify theft, no later than 4 business days after the date of receipt. Consumer Complaint: My name is XXXX XXXX, and I am writing to bring to your attention some inaccuracies I have identified in the information pertaining to my account, specifically account XXXX XXXX XXXX. I recently obtained a copy of my credit report and observed discrepancies that require immediate attention and resolution. Upon reviewing the details of the account, I have noted the following discrepancies : * Balance Discrepancy : - According to the provided information, my account status is listed as " Account charged off. {$31000.00} written off. {$8400.00} past due as of XX/XX/XXXX. '' However, the balance mentioned is inconsistent with the original balance and the written-off amount. I kindly request clarification on how these figures were calculated and why there is a significant discrepancy. * Payment History Inconsistencies : - The payment history indicates missed payments and charge-offs for the months of XXXX, XXXX, and XXXX in XXXX, and throughout XXXX and XXXX. However, I have evidence of timely payments, and the last recorded payment date is listed as XX/XX/XXXX. If account is charged off why is it still reporting as a missed payment and a charge off is considered as taxable income for me the consumer and taxable income should not be reported on a credit report as per the IRS Publication 4681 Canceled Debts, Foreclosures, Repossessions, and Abandonments. I request this account be deleted for inaccuracies per 15 USC 1681 and update my records accordingly. * Terms Met Inconsistency : - The " Current / Terms met '' section suggests that the account is current and the terms have been met. However, the status indicates a charged-off account with a substantial past due amount. I seek clarification on how the account can be considered current while being charged off. This account should be deleted because of inaccuracies. Also per the FCRA as a federally protected consumer, I am opting out of any and all authorizations I the consumer may have given you, written and unwritten or verbal and nonverbal per 15 USC 6802. I also have never received a 1099 from XXXX XXXX and as per the IRS Publication 4681 Canceled Debts, Foreclosures, Repossessions, and Abandonments Canceled or forgiven debts may be considered taxable income, and the Internal Revenue Service ( IRS ) generally requires reporting of such income on your federal tax return. I am committed to resolving this matter amicably, and I kindly request your prompt investigation into deleting this account for discrepancies under 15 USC 1681. I understand the importance of accurate credit reporting and believe that rectifying these inaccuracies will contribute to a fair representation of my credit history. These inaccuracies should give more then enough reason to delete this account from my credit report. I appreciate your attention to this matter and request that you provide a written response within 30 days, as per the guidelines outlined in the Fair Credit Reporting Act ( FCRA ). Consumer Complaint: To Whom It May Concern, This letter is a formal complaint that you are reporting inaccurate and incomplete credit information. I am distressed that you have included the information below in my credit profile and that you have failed to maintain reasonable procedures in your operations to assure maximum possible accuracy in the credit reports you publish. Credit reporting laws ensure that bureaus report only 100 % accurate credit information. Every step must be taken to assure the information reported is completely accurate and correct. The following information therefore needs to be re-investigated. According to the Fair Credit Reporting Act, Section 609 ( a ) ( 1 ) ( A ), you are required by federal law to verify, through the physical verification of the original signed consumer contract, any and all accounts that you post on a credit report. Otherwise anyone paying for your reporting services could fax, mail or email in a fraudulent account. I demand to see verifiable proof ( i.e. : an original consumer contract with my signature on it ) that you have on file for the account listed below. Consumer Complaint: I am writing to inform you that, based on my review of my credit reports and communication with your agency, it has come to my attention that there have been multiple violations of federal laws, specifically 15 U.S. Code 1681 and 15 U.S. Code 1692. 15 u.s. code 1681 ( No Damage Defamation of charter ) ( a ) Accuracy and fairness of credit reporting The Congress makes the following findings : ( 1 ) The banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. ( 2 ) An elaborate mechanism has been developed for investigating and evaluating the credit worthiness, credit standing, credit capacity, character, and general reputation of consumers. ( 3 ) Consumer reporting agencies have assumed a vital role in assembling and evaluating consumer credit and other information on consumers. ( 4 ) There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. ( b ) Reasonable procedures It is the purpose of this subchapter to require that consumer reporting agencies adopt reasonable procedures for meeting the needs of commerce for consumer credit, personnel, insurance, and other information in a manner which is fair and equitable to the consumer, with regard to the confidentiality, accuracy, relevancy, and proper utilization of such information in accordance with the requirements of this subchapter 15 u.s. code 1692g ( a ) Notice of debt ; contents Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing ( 1 ) the amount of the debt ; ( 2 ) the name of the creditor to whom the debt is owed ; ( 3 ) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector ; ( 4 ) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector ; and ( 5 ) a statement that, upon the consumers written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor. ( b ) Disputed debts If the consumer notifies the debt collector in writing within the thirty-day period described in subsection ( a ) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or a copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector. Collection activities and communications that do not otherwise violate this subchapter may continue during the 30-day period referred to in subsection ( a ) unless the consumer has notified the debt collector in writing that the debt, or any portion of the debt, is disputed or that the consumer requests the name and address of the original creditor. Any collection activities and communication during the 30-day period may not overshadow or be inconsistent with the disclosure of the consumers right to dispute the debt or request the name and address of the original creditor. ( c ) Admission of liability The failure of a consumer to dispute the validity of a debt under this section may not be construed by any court as an admission of liability by the consumer. Consumer Complaint: As I am currently looking for a new home for my family and I, I wanted to make sure that the Credit Reporting Agencies have all accurate information. Upon discovery, I see inconsistencies in the information amongst the top 3 credit reporting agencies ( XXXX, Equifax, and XXXX ). As these companies know 15 USC 1681c ( 1 ) ( a ) ( 4 ) states that no accounts placed for collections shall be included in the consumer report. XXXX, Equifax and XXXX has not received any written expressed consent from me, the consumer, in fact, XXXX XXXX, granting permissions for inaccurate information to be on my consumer report. I have been in dispute with the XXXX credit reporting agencies for over a month with accounts coming back verified and I never verified any information which is also a stipulation under the FCRA. I have requested this information from the furnishers as well as the agencies.

Consumer Complaint: I constantly dispute this item XXXX XXXX XXXX FROM MY CREDIT REPORT AND THEY ARE JUST VERIFYING AND UPDATE THE ACCOUNT AND I DONT HAVE ANY BUSINESS WITH THE COLLECTION REPORTING. I never had a contract with this debt collector for any debt.Please provide proof from the original creditor that this debt collector owns this debt and has the legal authority to collect it or delete this account.
