Consumer Complaint: Hi i'm reaching out today because the credit reporting agencies are still reporting a illegal charged off account on my consumer report. I have made multiple complaints in regards to this account yet the law is still continuing to be broken. The continued reporting of this account is a direct violation of 15 USC 1681b as I never gave written consent to any of the major credit reporting agencies to report this account on my consumer report. This is also a direct violation of the privacy act of 1974 as I was never informed of my right to opt out of the reporting of this account. This is my formal notice that i'm opting out of the reporting of this account.

Consumer Complaint: Upon reviewing the Master Promissory Note ( MPN ) related to my student loan account, I observed discrepancies that raise concerns regarding the reporting process. The FCRA mandates that a financial institution, in this case, the loan servicer, must clearly and conspicuously disclose to the consumer, in writing or electronic form, that nonpublic personal information may be disclosed to a third party. The MPN does acknowledge this disclosure concerning the reporting to credit bureaus. However, as stipulated in 15 USC 6802 ( b ) ( 1 ) ( b ), the consumer should be given the opportunity, before the initial disclosure, to direct that such information not be disclosed to a third party. Regrettably, I was not provided with the privilege to exercise this nondisclosure option, nor was there an explanation offered on how I, as the consumer, could opt out, as outlined in 15 USC 6802 ( b ) ( 1 ) ( c ). I have attached a redacted copy of the MPN as evidence of my claim. On page 7 of 10, under section 21 regarding consumer agency reporting, it is evident that the document mentions reporting to credit bureaus while deliberately omitting the fact that I, as the consumer, had the option not to have my information reported, as required by consumer protection laws. Considering these concerns and potential violations of the FCRA and 15 USC 6802, I request that you furnish me with a copy of the document demonstrating where and how I was given the opportunity to opt out of having my information disclosed without my written consent. I anticipate your prompt attention to this matter and a thorough investigation into the inaccuracies and omissions outlined in this letter. I trust that you will take the necessary steps to rectify the reported discrepancies in my credit file.

Issue: Incorrect information on your report
Subissue: Account information incorrect
Consumer Complaint: Recently I've mailed multiple dispute letters to Equifax regarding an account which is reporting inaccurately. In the previous dispute letters I asked them to ensure that this account is reporting accurate information and to to remove anything that isn't accurate. They responded that this account is accurate but still even after multiple investigations I can prove that there are multiple inaccuracies reporting which is against 15 U.S. Code 1681i - Procedure in case of disputed accuracy, section ( 5 ) Treatment of inaccurate or unverifiable information. I am aware that it is the credit reporting agency 's duty to do what's fair and equitable for me as a consumer in which I believe I wasn't given a fair investigation. If Equifax responded that this information is accurate, how are there still multiple inaccuracies and violations reporting? Pursuant 15 U.S. Code 1681a - Definitions ; rules of construction section ( 2 ) Exclusions, subsection ( i ) report containing information solely as to transactions or experiences between the consumer and the person making the report ; I am aware that certain information is not included in a consumer report by definition which Equifax violated. They failed to properly investigate this account in which it reports totally different information than what the other credit reporting agencies are reporting. How can an account report 30 days late, then closed, 30 days late, then closed? The account number is completely different from what the other credit reporting agencies are reporting. I acknowledge that I have a right to privacy and in order for any account to be reported to my consumer report I must be given the right to opt out from this information being reported in which I never was never made aware of this from the creditor reporting this account. I would like to flex my option to opt out of this information being reported on my consumer report in which Equifax must abide by. By Equifax still reporting inaccurate information even after multiple attempts to investigate this account, my credit score is negatively impacted for their mistakes. Included in this complaint is a copy of my dispute letter and Equifax consumer report of the account with inaccurate information in which I believe is inaccurate. Attached to this complaint is a copy of this account that report to all 3 agencies which is reporting different information. Violations committed by Equifax : 15 U.S. Code 1681b - Permissible purposes of consumer reports 15 U.S. Code 1681 - Congressional findings and statement of purpose 15 U.S. Code 1681e - Compliance procedures 15 U.S. Code 6802 - Obligations with respect to disclosures of personal information 15 U.S. Code 1681a - Definitions ; rules of construction 15 U.S. Code 1681i - Procedure in case of disputed accuracy 15 U.S. Code 1666 - Correction of billing errors

Consumer Complaint: Equifax, XXXX, and XXXX are illegally furnishing a consumer report of me containing exclusions which is a violation of FCRA ( 15 U.S.C. 1681a ) which states that a " consumer report containing information solely as to transactions or experiences between the consumer and the person making the report '' is excluded from the consumer report. In case these consumer reporting agencies are not aware, I offer them an opportunity to remove these violations. I demand my privacy be taking seriously and if these agencies continue to violate I demand the CFPB fully enforce its obligations to hold these reporting agencies accountable for their actions in violation of the FCRA and consumer Privacy laws. Due to the serious nature of this claim I give Equifax, XXXX, and XXXX 5 days to correct this matter.
