Consumer Complaint: This letter is being sent to you in response to illegal findings and violations found within Claimants account with your company. Be advised that your claim is being disputed and validation and proof of claim of the disputed debt is requested in accordance with the Fair Debt Collection Practices Act 15 U.S.C 1692, The Fair Credit Billing Act ( FCBA ), and the Truth In Lending Act 15 U.S.C 1601 all of which work in conjunction with each other. It is not now, nor has it ever been my intention to avoid paying any obligation that is lawfully owed by the Claimant. In order to make arrangements to pay an obligation which may be lawfully owed, please document and verify the debt by complying, in good faith with the request for validation and return it to me within thirty ( 30 ) days of receipt of this letter. This is not a request for verification or proof of claimant mailing address but, a request for VALIDATION and PROOF OF CLAIM made pursuant to the above named title and sections. Consumer Complaint: I Have been a victim of identity theft I contacted Equifax and XXXX about these accounts : 1- XXXX XXXX XXXX opened XXXX/XXXXXXXX balance {$19000.00} 2- XXXX XXXX XXXX opened XX/XX/XXXXXXXX balance {$870.00} 3- Hard inquiry from XXXX XXXX XXXX XXXX XXXX XX/XX/XXXX I have informed them that these account are fraudulent and I didn't open them I have sent in a copy of my DL and SS card per there request as well as a copy of police reports that proves I didn't open these accounts I have asked for these account to be removed from my report. and nothing happens and they keep making me send in my id every time I call and the issue has not been fixed

I received an email from XXXX indicating the account was closed on the date listed above. However, the following month, I received an email indicating I still owed on this account as well as the preceding. It has been noted on my credit report with Equifax that the account is behind in payments and has adversely affected my score. I am looking to work again, and this is having an impact on my ability to clear my record.

I have a right to opt out of the company sharing my personal and financial information. Per 16 CFR 313.7 methods of opt out. I sent a written notice to the company of me reserving my rights verbal non verbal written non written. 15 Usc 6802 b ) Opt out ( 1 ) In general A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless ( A ) such financial institution clearly and conspicuously discloses to the consumer, in writing or in electronic form or other form permitted by the regulations prescribed under section 6804 of this title, that such information may be disclosed to such third party ; ( B ) the consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and ( C ) the consumer is given an explanation of how the consumer can exercise that nondisclosure option.
