Consumer Complaint: Per 15 USC 1681 ( c ) ( 2 ), BLOCK OF INFORMATION RESULTING FROM IDENTITY THEFT - Except as otherwise provided in this section, a consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, not later than 4 business days after the date of receipt by such agency. Unfortunately, my personal identifiable information was compromised and used to open 2 fraudulent credit card accounts. I was a victim of Identity Theft. I am attaching my FTC Identity Theft Report to have these 2 accounts removed from my credit file by this Creditor. There are 2 addresses on my credit file that I do not recognize and they need to removed too. Consumer Complaint: I received a copy of my credit report and found the following items to be reported in error. Upon doing a thorough research on my reports I found improper inaccuracies on the reports even after they did the thorough verification. By the provision of the fair credit reporting act I demand these items be investigated and removed from my credit report it is my understanding that you will reverify these accounts with the creditor that posted them. Please remove any information that the creditor can not verify I understand that under 15 U.S.C section 1681 ( i ) a you must complete this reinvestigation within 30 days of the receipt of this letter.These entries are in violation of my consumer rights under federal and state laws. Inaccurate Reporting : I have reason to believe that the reporting of this charge-off and collection is inaccurate, and I have not been provided with sufficient proof of the debt 's validity or any prior validation, as required by the FDCPA. Lack of Verification : The debt was never properly validated as required by the FDCPA. As a consumer, I have the right to demand validation of a debt before it is reported on my credit report or pursued for collection. Consumer Complaint: I have provided Equifax will all requested documents for my identity theft case and unlike the other XXXX credit bureaus they continue to refuse to remove fraudulent information from my credit report. I have provided an FTC identity theft report, a police report affidavit and all identity verification documents that are required. This is in regard to the fraudulent account opened in my name with XXXX XXXX. XXXX complied with the requests and the law but Equifax is refusing to do so. Equifax is in violation of the Fair Credit Reporting Act in continuing to not remove a fraudulent account from my report. They are basically saying I am a liar when i have been the victim. You are harming my ability to obtain any new credit. As clearly shown by the legislative history of the FCRA identity theft revisions, of which section 605B is the key provision, the purpose was to avoid any involvement of the furnisher or CRA in investigating the issue of asserted identity theft. If the consumer is willing to make a sworn statement before law enforcement, which carries criminal penalties for knowingly false statements, then that assertion itself is adequate to block the information from the consumer 's credit report. Conducting an investigation of the furnisher 's reporting is not part of the identity theft blocking process, and is not basis for denying the block under section 605B. Their action appears to thus be willful noncompliance with the statute, subjecting them to punitive damages and court/legal fess, per FCRA 616. I will be seeking these damages against Equifax if this fraudulent account information is not removed from my credit report immediately.
