Consumer Complaint: To Whom It May Concern, I am writing to you for the THIRD TIME, serving this letter as both a FINAL WRITTEN REQUEST and a Pre-Arbitration Notice regarding the disputed accounts on my credit report. This communication consolidates my previous concerns and is a definitive step towards initiating legal action under the Fair Credit Reporting Act ( FCRA ), specifically to seek redress and recover damages under Sections 616 and 617 for your continued willful and negligent noncompliance. Despite my prior written requests, specific unverified items remain on my credit report, which appears to be a clear violation of Federal Law. The FCRA requires you to maintain and provide evidence from the original creditor to verify that the information reported is accurate and pertains to me. However, the results of your investigations have failed to provide any substantive evidence or documentation. In light of these continued issues, I require answers to the following critical questions : Who in your company verified these accounts? How did they verify them? Please provide me with the name of the individual, business address, and telephone number of the person or business contacted during your reinvestigation. Also, why did you not send me copies of the verification like I asked? Under Sections 609 ( a ) ( 1 ) ( A ) & 611 ( a ) ( 1 ) ( A ) of the FCRA, you are obligated to provide any original documentation, such as a consumer contract with my signature. Your failure to provide this information is a direct breach of the FCRA. Furthermore, Section 611 ( 5 ) ( A ) mandates the prompt deletion of any information that can not be verified. As a litigious consumer, I am fully prepared to pursue legal action to enforce my rights under the FCRA. The responsibility of consumer reporting agencies extends beyond merely echoing information from other sources and requires a proactive and thorough approach to verification. Therefore, I demand immediate action either to verify or to delete the following accounts from my credit report. This letter should be taken as a Pre-Arbitration demand. Noncompliance will leave me no choice but to seek legal remedies as provided under Sections 616 and 617 of the FCRA. I expect a prompt and comprehensive response to this letter, addressing each point raised and outlining the specific steps you will take to rectify this situation. Failure to respond satisfactorily and in compliance with the law will result in immediate legal action. Issue: Problem with a company's investigation into an existing problem
Subissue: Their investigation did not fix an error on your report
Consumer Complaint: I am writing to express my dissatisfaction with the handling of my credit report and the multiple, unsuccessful attempts to correct inaccurate information related to removal of the charge-offs accounts. It has come to my attention that despite repeated efforts, these issues persist on my credit report, adversely affecting my creditworthiness and financial standing. However, these removal have not been reflected, and the incorrect information remains, impacting my credit score negatively. I have noticed inaccuracies regarding charge-offs on my credit report. Despite providing documentation to support the resolution of these accounts, the charge-off status persists, and I have observed no improvement in the reporting. Furthermore, attempts to rectify inaccuracies regarding these accounts have been unsuccessful. The persistence of this misinformation is not only frustrating but also detrimental to my financial standing. I kindly request a thorough and immediate investigation into these matters. Additionally, I expect timely updates on the progress of the investigation, including any actions taken to correct the inaccuracies on my credit report. To aid in your investigation, I have attached supporting documentation. I am asking for your assistance to remove the charge off accounts in my credit file : XXXX XXXX Balance : {$250.00} - I requested an investigation and the removal of the charge-off status. No changes were made. No investigation was conducted at all. You had optimal time to review this matter and make the appropriate corrections, you elected not to. Please remove this item immediately. XXXX XXXX Balance : {$0.00} - The limit to this account was a fraction of the amount due it as stated. That is utterly unfathomable! Had a proper investigation been conducted you would have seen the error and corrected it immediately. You failed to do your job ; you must now REMOVE THIS ITEM ALTOGETHER.
