Issue: Problem with a company's investigation into an existing problem
Subissue: Their investigation did not fix an error on your report
Consumer Complaint: I don't understand why it took XXXX and Equifax so long to investigate and applied the necessary solution to these accounts. XXXX XXXX XXXX - XXXX XXXX XXXX XXXX - XXXX XXXX have them deleted back in XX/XX/2023. Confirmed that these accounts were incorrectly and inaccurately reported. As a consumer, I understand that under the FCRA law, they have clearly emphasized that Consumer Reporting Agencies should have an automated system in place for furnishers of the information to communicate the inaccurate and incomplete information with other consumer reporting agencies ESPECIALLY if the accounts are reporting the same information. Moreover, FCRA also stated that once a furnisher deems an account to be inaccurate or incomplete they must relay/communicate the information with all consumer reporting agencies that they are furnishing the information to. It's very upsetting that XXXX and Equifax are not taking this law seriously and are not doing their due diligence of practicing fair and impartial resolution.

Consumer Complaint: This correspondence serves as my THIRD and FINAL WRITTEN REQUEST, as well as a Pre-Arbitration Notice, regarding the disputed unverified accounts and late payments as well as the unauthorized soft inquiries still found on my credit report. This letter consolidates my previous concerns, signaling my intent to pursue legal action under the Fair Credit Reporting Act ( FCRA ), specifically under Sections 616 and 617 for willful and negligent noncompliance. In addition to the unverified items previously discussed, I have identified multiple soft inquiries on my credit report that I did not authorize. This not only raises concerns about a breach of my privacy but also indicates potential violations of federal law. Alongside my demand for the verification or deletion of the unverified accounts, I request the immediate deletion of all unauthorized soft inquiries from my credit report. Furthermore, I require specific answers to the following questions : 1. Who in your company verified these accounts? 2. How did they verify them? 3. Please provide me with the name of the individual, business address, and telephone number of the person or business contacted during your reinvestigation. 4. Why have you not sent me copies of the verification as previously requested? Under Sections 609 ( a ) ( 1 ) ( A ) & 611 ( a ) ( 1 ) ( A ) of the FCRA, you are obligated to provide any original documentation, such as a consumer contract with my signature. Your failure to provide this information is a direct violation of the FCRA. Section 611 ( 5 ) ( A ) specifically requires the prompt deletion of any information that can not be verified, including unauthorized inquiries. I wish to highlight Section 616 [ 15 U.S.C. 1681n ], which addresses civil liability for willful noncompliance. This section outlines the legal consequences for any consumer reporting agency that knowingly and willfully fails to comply with the requirements of the FCRA, resulting in damages to the consumer. As a litigious consumer, I am fully prepared to enforce my rights through legal action. The responsibility of consumer reporting agencies goes beyond simply echoing information from other sources and necessitates a proactive, thorough approach to both verification and authorization. Therefore, I demand immediate action to verify or delete the disputed accounts and to remove all unauthorized soft inquiries from my credit report. Treat this letter as a Pre-Arbitration demand. Noncompliance will lead me to seek legal remedies as provided under Sections 616 ( willful noncompliance ) and 617 of the FCRA. I expect a prompt and comprehensive response, addressing each point raised and detailing the specific actions you will undertake to correct these issues. Failure to respond in accordance with the legal requirements will result in immediate legal action. Consumer Complaint: I am the author of this complaint and I have attached a copy of my driver 's license and social security card to verify my identity. I tried to apply for credit and was swiftly denied, which led me to check my credit report. I noticed several creditors and collection agencies that are reporting incomplete, incorrect, and downright fraudulent information. I have attached letters below in the attachments which will show the accounts that I am calling into question. The credit bureaus are allowing reporting in such a way that violates the Fair Credit Reporting Act and the Fair Debt Collection Practices Act. 15 USC 1681s-2b and 15 USC 1681b are being blatantly violated and from my research all parties can be held civilly liable. The credit bureaus are not conducting a reasonable investigation like they are obligated to do
