Issue: Attempts to collect debt not owed
Subissue: Debt is not yours
Consumer Complaint: Midland Credit Management is attempting to collect a debt from me. The debt is not mine. Per a previous debt claim from MCM, I was told by an MCM supervisor, on XX/XX/23, that I would not be contacted again by MCM. On XX/XX/23, I recieved more debt claims from MCM. MCM has already established that the debt does not belong to me, my address, or my phone number. However, they continue to make claims.

Consumer Complaint: I havent provided evidence in accordance with the doctrine, so you XXXX assume, under the doctrine of estoppel by silence, that there is no proof of the purported debt and, as a result, no such liability, if the debt collector has not provided the requested proof of the alleged debt within 30 days. In a good faith effort to resolve the matter amicably, I restate my demand for proof of the debt, specifically the alleged contract or other instrument bearing my signature, as well as proof of your authority in this matter. Absent such proof, you must terminate this collection action, and correct any erroneous reports of this debt as mine. For the record, I state again : As I have no account with you, nor am I your customer, nor have I ever entered a contract with you, I must ask you to provide the following information : 1. Please evidence your authorization under 15 USC 1692 ( e ) and 15 USC 1692 ( f ) in this alleged matter. 2. What is your authorization of law for your collection of information? 3. Subissue: Debt was result of identity theft
Consumer Complaint: I have two accounts being collected by Midland Credit Management for XXXX XXXX accounts that were not my accounts prior to being sold to Midland. I notified XXXX XXXX of this prior to the debt being charged off and they confirmed the debt was written off as identity theft, NOT as a balance owed under my name. I have spoken to countless individuals at Midland, XXXX XXXX, and disputed via my credit bureaus in an attempt to get this information corrected, but more than two years later, the accounts still show on my credit report under the collections section. I'm first referred to XXXX XXXX to have the balance corrected, yet XXXX XXXX then refers me back to Midland since the debt is no longer theirs. Yet no one can seem to point me properly to the right place to get this corrected. I would like to say that everyone at Midland has been pleasant, unlike other debt collection companies I've dealt with ( so thank you for hiring professional people ). Unfortunately, they do not seem to be able to help me resolve the issue at hand.

Consumer Complaint: Subject : Pre-Arbitration Settlement Offer - Collection Account ( Account Number : XXXX ) and Obligation to Honor Arbitration Agreement To Whom It May Concern, I am writing to address the ongoing issue concerning the collection account associated with XXXX XXXX XXXX account number XXXX, which has significantly impacted my credit report. Despite prior attempts to resolve this matter, the situation remains unresolved, causing substantial financial hardship and distress. I have denial letters to prove the financial pain and stress this fraudulent account has put me through. I want to emphasize that with the acquisition of this collection account, Midland Credit Management has assumed all rights and obligations, including those stipulated in the original contract, such as the arbitration agreement. This agreement is legally binding and requires that disputes be settled through arbitration rather than traditional litigation. Given this obligation, I propose a one-time settlement offer to expedite a resolution and avoid further legal complexities and expenses. Midland Credit Management has the opportunity to settle this matter by agreeing to the following terms : Payment of {$5000.00} in full settlement of the collection account. Deletion of the account and all associated information from my credit report. By upholding the arbitration agreement, Midland Credit Management demonstrates its commitment to equitable resolution practices. Please give due consideration to this settlement offer and respond promptly. Accepting this proposal not only upholds your contractual responsibilities but also leads to a more advantageous outcome for both parties involved. I request written confirmation of your acceptance of this settlement offer and the subsequent actions taken to fulfill the terms outlined above. Thank you for your attention to this matter, and I look forward to your timely response. Sincerely, XXXX XXXX
