Consumer Complaint: The XXXX XXXX XXXX in XXXX XXXX has recently sent a garnishment to my employer. The garnishment is for an XXXX store card in which I never had or applied for. Now i have contacted all 3 Credit agencies and this store card was no where to be found on my credit report. I also contacted XXXXXXXX XXXX which owns the XXXX XXXX card and reported this as fraudulent. The XXXX XXXX XXXX has not had good standings with the XXXX and most of the bad complaints are like mine in that the XXXX XXXX XXXX is persecuting people for debts not really owed. XXXXXXXX XXXX did tell me the card was taken out in my name and is investigation th allegation, when i tried to receive help from the XXXX XXXX XXXX it fell on deaf ears and they were extremely rude. Ponzi scheme if you ask me

At this point I am neither confirming or denying the debt is mine.

Consumer Complaint: Someone has committed Fraud with my bank account at XXXX XXXX XXXX and has to change my account 3 times. In doing so, I have had my personal information stolen. This started in XX/XX/XXXX, XX/XX/XXXX, Then in XXXX of XXXX. My personal information was used to acquire and credit card with XXXX XXXX for XXXX. Now Midland credit management has taken this account over and now the total is XXXX. Now I Iive on XXXX and made XXXX in XXXX. Now i live on XXXX a month. I have called capital one explaining to them that this was not done by me. Midland credit Managment has now filled papers to collect on this debit. During covid, i could not file a police report on this matter. I called the credit bureaus and filed this claim to them and had it removed from my credit report. I had to put freezes on my reports along with Fraud alert on them. I don't know what to do from here outside of what i already have done. XXXX told me to file this report with this agency. I hope this can be resolved.

Consumer Complaint: This debt collector engaged in abusive, deceptive, and unfair practices of the FDCPA which it prohibits. Midland furnished this account that we didn't agree upon, and I didn't sign an agreement on. A legal contract is signed by two parties, and I did not participate in any of it. More so they didn't follow the proper 5 step validation procedure which make these unfair practices. Furthermore, I was never sent correspondence notifying me that this account was sold to Midland Funding, nor have I received proper validation from the original creditor. When I contacted the original creditor to inquire about this unverified account, I noticed that the balance on my credit report is not the same balance that the original creditor is reporting. How is this valid? I also received nothing in the mail leading up to this collection being reported. Attached is the debt validation letter that was sent last month which is dated and time stamped. According to the FDCPA Im entitled to XXXX dollars per violation. I demand this company to delete this account from my credit report or I will have no choice but to forward this to my litigation attorney.

Consumer Complaint: In accordance with the fair credit reporting act Midland credit Management has violated my rights. 15 U.S.C 1681 Sect. 602 A states i have the right to privacy. 15 U.S.C. 1681 Sect 604 A Sect 2 it also states that, A consumer reporting agency can not furnish a account without my written instructions. Pursuant to Title 15 USC 1692c ( c ), I dispute the ALLEGED debt and refuse to pay the ALLEGED debt. Remove ANY AND ALL reporting of the debt collection activity from all consumer reporting agencies. I expect full compliance with this request within fifteen ( 15 ) days of the receipt of this letter. Failure to comply with this request will leave me no choice but to pursue all available legal remedies under the FDCPA and any other applicable laws to protect my rights. Sending a statement does not prove this is my debt. You also had someone trespass onto my property per my cameras to deliver a package not once, but twice that my dogs chewed up. You have also sold my information to 3rd party agencies as i am getting letters from attorneys about being sued. This again violates 15 USC 1681. Cease and desist immediately as well as remove the judgement.

They have not provided me a validated signed contract, for this collection account, or for fees that they are adding to this collection account balance. For months, they have been adding {$3.00} to {$4.00} onto the balance three to four times like every 6 to 7 days instead of reporting this account every month, they are reporting and increading the balance three times within the month, which is not allowed. I have tried to settle this account over a year ago, before I got sick. and under Doctors care, and I am unable to work. They would not settle at all and demanded the total amount, which now they are harassing me, and destroying my credit by reporting false information on my credit report,

I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' MIDLAND CREDIT MANAGEMENT , XXXX XXXX XXXX, XXXX, XXXX XXXX, XXXX, XXXX XXXX XXXX , XXXX XXXX , XXXX, XXXX XXXX XXXX are financial institutions by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' MIDLAND CREDIT MANAGEMENT , XXXX XXXX XXXX, XXXX, XXXX XXXX, XXXX, XXXX XXXX XXXX , XXXX XXXX , XXXX, XXXX XXXX XXXX are financial institutions and the Consumer reporting agencies XXXX, XXXX, and XXXX do not have my consent to furnish this information and they absolutely do not have my written consent. Any and all consent to XXXX, XXXX, and XXXX from MIDLAND CREDIT MANAGEMENT , XXXX XXXX XXXX, XXXX, XXXX XXXX, XXXX, XXXX XXXX XXXX , XXXX XXXX , XXXX, XXXX XXXX XXXX whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' MIDLAND CREDIT MANAGEMENT , XXXX XXXX XXXX, XXXX, XXXX XXXX, XXXX, XXXX XXXX XXXX , XXXX XXXX , XXXX, XXXX XXXX XXXX Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services immediately.
